Ho Chi Minh City People's Committee has just released a report summarizing the results of collecting opinions on the draft Resolution amending and supplementing a number of articles of the 2013 Constitution ( 2013 Constitution ).
Over 1.8 million comments
Ho Chi Minh City has organized many direct and indirect measures, promoting the creative role of the grassroots in mobilizing individuals to contribute opinions on the draft Resolution. In particular, giving opinions via the VNeID application is a new form, fast, easy, effective, convenient for people and for the statistical synthesis process.
Ho Chi Minh City also promotes the Community Digital Technology Team and Project 06 Working Group at all levels in coordination with the police force and forces participating in protecting security and order at the grassroots level. Thereby, establishing fixed and mobile teams with the motto of "going to every alley, knocking on every door, checking every person" to guide people to install and give comments on the draft Resolution, increasing the number of people installing level 2 electronic identification accounts.
In addition, agencies, organizations and localities in Ho Chi Minh City also organized 1,364 conferences, seminars and talks to collect opinions from subjects under their management, experts, scientists , etc.
As a result, Ho Chi Minh City recorded 1,819,443 comments with 5,371 comments from agencies and organizations and 1,814,072 comments from individuals.
Clarifying the duties and powers of local authorities
According to the report of the Ho Chi Minh City People's Committee, most opinions agreed and highly agreed with the necessity and content of the draft Resolution. However, there were also some concerns about the detailed content of each amended clause, demonstrating the sense of responsibility and awareness of the people of the City to participate in contributing to the construction of the Constitution and the construction of local government.
For example, in the content of the amendment and supplement to Article 84, there are opinions suggesting adding the right to submit draft laws and draft ordinances to socio -political organizations to ensure the representation rights of legitimate representative groups for the people. At the same time, it strengthens democracy, promotes people's participation through representative organizations and is consistent with the trend of modern legislative development.
Regarding the content of the amendment and supplement to Article 110, there is a proposal to consider adding “special administrative-economic units”. Accordingly, it is proposed that our country’s administrative units include provinces, centrally run cities and administrative units below provinces and centrally run cities; special administrative-economic units are established by the National Assembly.
Regarding the content of the amendment and supplement to Clause 2, Article 111, there are opinions stating that not organizing People's Councils in some places (as previously piloted in Ho Chi Minh City) needs to be cautious if expanded. However, there are also opinions suggesting adding wards as state administrative units in urban areas, directly elected by the people and appointed by the Chairman of the People's Committee of the province or centrally-run city. This opinion states that the pilot of not organizing People's Councils in wards is effective, consistent with the policy of streamlining payroll and urbanization.
Regarding the content of amendments and supplements to Clause 2, Article 112, there are opinions that it is necessary to study carefully to avoid concentration of power which will give rise to many negative aspects and corruption. At the same time, it is proposed to clarify the tasks and powers of local authorities as stipulated by legal documents issued by the Government; control state power, clearly define, avoid overlapping functions...
Regarding some other contents, there are opinions suggesting adding provisions to encourage the development of the digital economy, protect personal data and support technology startups. For example, regulations on access to technology and protection of intellectual property rights in the context of the 4.0 industrial revolution will promote innovation.
There are opinions that the Constitution should more clearly affirm the role of women in leadership, management and development of the country in the new period. This opinion also proposes strengthening measures to protect children in cyberspace (digital transformation) and legal mechanisms for children to participate in giving opinions on policies related to children...
