HCMC: Many companies and pharmacies were fined for violations

Minh Chau 18 Pharmacy (141 Minh Phung, Ward 9, District 6) was fined for trading in goods of unknown origin.

Fined Sabin 1 Business Household (No. 28 Bong Van Dia, Hamlet 1, Tan Kien Commune, Binh Chanh District) 25 million VND; Phuc Minh Pharmacy (012 Lot C, Hung Vuong Apartment, Mac Thien Tich, Ward 11, District 5) 20.8 million VND; Bui Thi Bich Van Business Household (F1/17B Hamlet 6, Vinh Loc A Commune, Binh Chanh District) 25 million VND; Thu Hang 62 Medicinal Herbs Store (62 Hai Thuong Lan Ong, Ward 10, District 5) 4 million VND.

Fined Minh Chau Pharmacy 18 (141 Minh Phung, Ward 9, District 6) 32 million VND; forced to destroy drugs of unknown origin; Huu Nghi Pharmacy 2 (309 Hoang Dieu, Ward 9, District 4) 31 million VND; Thanh Mau Pharmacy (355 Dien Bien Phu, Ward 4, District 3) 46.5 million VND; revoked the right to use the pharmacy practice certificate of Ms. Dam Bao Tram for 4.5 months; Thong Nhat Pharmacy (257 Binh Tien, Ward 8, District 6); Tam An Pharmacy 7 (36/91/1 KP5, Trung My Tay Ward, District 12) 20 million VND; Funny Pharma Pharmacy (518/1 Vo Van Kiet, Cau Kho Ward, District 1) 15.8 million VND; forced to destroy drugs of unknown origin.

The above pharmacies violated the following errors: selling drugs without a certificate of eligibility for pharmaceutical business, selling prescription drugs without a prescription, trading in goods of unknown origin; buying and selling drugs (traditional medicine, medicine from medicinal herbs) without a certificate of eligibility for pharmaceutical business...

The Inspectorate of the Ho Chi Minh City Department of Health also decided to fine the business location of Digital World Joint Stock Company (No. 6 Tan Thoi Nhat 8, Ward 5, Tan Thoi Nhat Ward, District 12) VND 58 million; suspend the pharmaceutical business activities of the business location until the facility reports to the Ministry of Health but not more than 24 months and force Mr. Phan Minh Hai to return the pharmacy practice certificate issued by the Ho Chi Minh City Department of Health. The reason is that the facility has not completed the training program, updating professional knowledge on pharmacy within 3 years from the date of the most recent certificate of completion of the training program, updating professional knowledge on pharmacy; did not submit a request for periodic assessment of maintaining compliance with good practice in drug distribution according to the provisions of law.

Fined Minh Sang Pharmaceutical Trading Company Limited (Kios D24, No. 134/1 To Hien Thanh, Ward 15, District 10) 139 million VND; forced to destroy the entire quantity of 20 drugs of unknown origin. The reason is that the company repaired and changed the structure and arrangement of the storage warehouse without the drug wholesaler reporting the changes with technical documents corresponding to the changes according to the provisions of law; sold drugs to establishments without a certificate of eligibility for pharmaceutical business; traded in goods of unknown origin (the goods are medicines)...

Fine Minh Khuong Trading Company Limited (3A Tran Khanh Du, Tan Dinh Ward, District 1) 150 million VND; force to recall and eliminate the violating elements; force to recall and destroy cosmetic products with formulas that do not match the declared documents; force to return the receipt number of the cosmetic product declaration form because the product has a formula that does not match the declared documents. Reasons, information, advertising, marketing, consulting, labeling, instructions for use of food, cosmetics and other products that are not drugs that have the effect of preventing, curing, diagnosing, treating, alleviating diseases, and adjusting physiological functions of the human body that make consumers misunderstand those products as drugs; trading in cosmetics with formulas that do not match the approved declared documents

Fined Elken International Vietnam Co., Ltd. (No. 290/15 Nam Ky Khoi Nghia Street, Vo Thi Sau Ward, District 3) VND 50 million; forced to recall and destroy the violating cosmetic products. Reason: putting cosmetic products into circulation without being granted a cosmetic product declaration receipt number by a competent state agency (Product Elysyle Ginseng Essence Massage Cream, BCC1661, MFG: March 19, 2024, EXP: March 18, 2027 was circulated on the market before being granted a cosmetic product declaration receipt number).

Fined Gamma Pharmaceutical and Cosmetic Production Company Limited (No. 18, Nguyen Hau Street, Tan Thanh Ward, Tan Phu District) 87 million VND; forced to recall and destroy the entire batch of products that do not ensure quality; forced to return the receipt number of the cosmetic product declaration form due to not ensuring quality; forced to recall goods and force to label goods according to regulations before continuing to circulate for products that violate product labeling and forced to return the amount of administrative violation money that has been consumed, dispersed, and destroyed in violation of the law.

Reason: producing cosmetics with formulas that are not in accordance with the cosmetic product declaration dossier; producing, importing, transporting, storing, trading goods with labels (including secondary labels) or accompanying documents that do not fully or incorrectly state the mandatory contents on the product label or the mandatory contents that must be shown according to the nature of the goods according to the law on product labels.

The Health Department Inspectorate also decided to fine Ms. Truong Thi Bich Lan (No. 87 Bui Quang La, Ward 12, Go Vap District) 35.5 million VND for practicing pharmacy without a pharmacy practice certificate; buying and selling drugs without a certificate of eligibility for pharmaceutical business.
