Implementing the Capital Law 2024 into life

The Capital Law 2024 takes effect from January 1, 2025 with many outstanding policies on attracting talent and increasing income for civil servants and public employees working at state agencies under the management of Hanoi city.

Stronger, more innovative

One of the important new features of the 2024 Capital Law is the regulation on recruitment of cadres, civil servants and public employees. Accordingly, Vietnamese citizens with outstanding moral qualities, qualifications, abilities, practical experience, working in the country or abroad with special projects, products, achievements, merits or contributions to the development of a field or industry of the Capital will be considered for recruitment and admission to work as civil servants and public employees...

In particular, cadres, civil servants and public employees working in state agencies, the Vietnam Fatherland Front, socio-political organizations and public service units whose regular expenditures are fully guaranteed by the state budget under the management of Hanoi city are entitled to additional income based on their capacity and work efficiency. This is considered a stronger and more innovative policy to attract talents to state agencies instead of private and foreign companies.

It is also worth noting that the Hanoi People's Council is allowed to decide to use the remaining salary reform fund after ensuring sufficient funds to implement salary reform for the entire period of budget stabilization according to regulations of competent authorities and ensuring social policies, social security, and social welfare issued by the Central Government to implement additional income expenditure for cadres, civil servants, and public employees according to regulations in Clause 3, Article 15 of this Law; the total expenditure level shall not exceed 0.8 times the basic salary fund of cadres, civil servants, and public employees under the management of Hanoi City.

The 2024 Capital Law and its specific documents also increase the basic salary for talents, especially scientists and high-tech experts. Individuals considered to be the target of attracting talents have been defined comprehensively and internationally, specifically "Vietnamese citizens with outstanding qualities, qualifications, abilities, and practical experience...", "foreigners with high professional qualifications and much practical experience...".

Degree should only be one criterion

According to Dr. Tran Anh Tuan, Chairman of the Vietnam Association of Administrative Science and former Deputy Minister of Home Affairs, these policies, if well and effectively implemented, will be the lever, driving force and foundation for implementing policies on building and developing the capital.

However, to retain talent in the long term, without a “brain drain” in state administrative agencies in general and in Hanoi in particular, is not simple. There was a period when Hanoi honored 1,879 excellent valedictorians, only 10% of them (186 people) went to work in departments, branches, districts, towns and public service units of the city and during the working process, many recruited talents “left”.

Master Dao Thi Hong Ngoc, lecturer at Hanoi Capital University, commented: “There are many different reasons for the above situation, but the main cause can be attributed to the policy that focuses almost exclusively on attracting talent without paying attention to developing high-quality human resources. The criteria for recruiting and attracting talent are mainly based on qualifications, such as: graduating from university with honors; having a doctorate degree... but not paying attention to those with capacity and practical experience”. To overcome this situation, according to Master Bui Hong Ngoc, there needs to be a talent development fund, creating an open and outstanding mechanism for talent to contribute better to the capital and the country.

From another perspective, Master Nguyen Thi Minh Thao, lecturer at the Faculty of State and Law, Le Hong Phong Cadre Training School, Hanoi, said that in order for the policy of attracting and using talented people to be close to reality, not just a formality or slogan, in addition to the regime and treatment, Hanoi needs to have specific regulations on how to use talented people after being attracted, the working environment, promotion, etc. The assignment and arrangement must ensure the right person, the right job, and the right expertise for which individuals are trained.

“Attracting talent, but they are not arranged and assigned to the right expertise, capacity and job position, leading to the situation where the attracted people lack the ability to be independent, decisive in solving problems, and are passive in performing tasks. In fact, many people are good at their expertise, but are not necessarily good managers. Even those who are good at their expertise do not care about administrative positions, but need a suitable treatment regime for them in their professional ranks,” emphasized Master Nguyen Thi Minh Thao.
