Prioritize transparency and personal data protection when applying AI in law

According to Associate Professor Dr. Hoang Cong Gia Khanh, Principal of the University of Economics and Law, VNU-HCM, in reality, artificial intelligence (AI) is moving faster than the law and standards for AI are being formed in the world. In Vietnam, the Law on Digital Technology Industry, issued in June 2025, is a fundamental step but specific regulations and effective implementation are needed.

Citing international experience on AI and law, Associate Professor Dr. Ngo Huu Phuoc, Deputy Dean in charge of the Faculty of Economic Law, University of Economics and Law, recommended that Vietnam not issue a separate Law on AI. Because the AI ​​ecosystem is still young and not mature enough to be legalized.

In addition, AI research, application and businesses in Vietnam are still fragmented and small-scale; there are not many influential commercial AI products, and a rigid legal framework will hinder innovation. In addition, State management resources are limited, and the AI ​​management and supervision team is not strong enough in terms of expertise. Post-auditing, testing and monitoring the AI ​​market requires huge costs and technical capacity, while Vietnam is not ready.

Experts say that laws are always behind technology, AI changes very quickly, the promulgation of laws can lead to the risk of falling behind, becoming outdated quickly, causing difficulties for businesses and management. Therefore, Vietnam can promulgate an AI ethics framework; an AI Sandbox for testing; amend and supplement the current legal ecosystem.

Also citing prominent countries in AI development such as Singapore and Estonia, Dr. Duong Van Thinh, Vice President of Veron AI Group, said that Vietnam needs to invest in data infrastructure before deploying AI; be absolutely transparent about how AI makes decisions and start with simple cases, then gradually expand.

In addition, it is necessary to invest in supporting tools, not completely replacing humans, and public-private partnerships to develop appropriate technology. In particular, transparency and protection of personal data are prioritized.
