Identify specific criteria for strategic digital technology

NDO - National Assembly delegates proposed defining strategic digital technology with specific criteria to create transparency and consistency in management and incentives, as a basis for determining public investment, key research, human resource training and controlled testing (sandbox).

On the afternoon of May 9, under the direction of Vice Chairman of the National Assembly Le Minh Hoan, the National Assembly discussed in the hall a number of contents with different opinions of the draft Law on Digital Technology Industry.

Regarding the definition of strategic digital technology, delegate Thach Phuoc Binh (Tra Vinh delegation) cited Clause 2, Article 3 of the draft Law, which stipulates that strategic digital technology is a type of strategic technology that plays a decisive role in the country's development and has a great impact on competitiveness, national security and long-term economic growth.

These include technologies such as artificial intelligence, big data, cloud computing, the Internet of Things, virtual reality, augmented reality, semiconductors and other strategic digital technologies.

Delegates said that open listing can easily lead to conflicts when determining preferential policies without a clear legal basis for determining strategies, causing difficulties for State agencies when applying, especially in reviewing sandbox projects and allocating resources.

Therefore, delegate Binh proposed replacing the above definition with a definition with specific criteria to create transparency and consistency in management and incentives, as a basis for determining public investment, key research, human resource training and sandbox testing.

Accordingly, strategic digital technology is a fundamental technology that directly affects national security, international competitiveness, innovation speed and sustainable economic growth.

The determination of the list of strategic digital technologies is decided by the Prime Minister based on the proposal of the Ministry of Science and Technology and based on criteria such as the level of impact on priority development sectors and fields, the ability to create breakthroughs in productivity and efficiency, the ability to widely apply in society and the digital economy, and the impact on digital rights and national data security.

Another issue that was also mentioned by the Tra Vinh delegation was the sandbox controlled testing mechanism. According to delegate Binh, Article 51 stipulates the legal framework for the sandbox but does not clearly define the criteria for selecting products and services that are allowed to be tested. Lack of transparency can lead to arbitrary approval or abuse of policies and exemption from responsibility.

Delegates proposed adding a separate clause in Article 51 or a decree guiding the criteria for selecting products and services eligible for testing. For example, there may be new technology elements that integrate multiple technologies that are not clearly regulated by current laws, have the potential to solve practical problems in digital transformation, improve the efficiency of public services or business productivity, have a clear risk control plan regarding data security, privacy, consumer rights, and do not violate regulations on national defense, security, or social ethics.

“This addition will ensure transparency and fairness for innovative startups, serve as a basis for risk assessment, and responsibly grant testing licenses,” said delegate Thach Phuoc Binh.

Need to clearly distinguish digital asset groups

Discussing at the meeting, delegate Luu Ba Mac (Lang Son delegation) proposed adding regulations requiring artificial intelligence (AI) systems with high risks or large impacts to be assessed and appraised by independent inspection organizations designated by the state, before being deployed to ensure safety and effectiveness in state management.

Regarding digital assets, delegate Trinh Tu Anh (Lam Dong delegation) proposed adding regulations on "uniqueness or replaceability" because this is an important characteristic of digital assets, directly affecting the transactions and use of digital assets.

“Uniqueness creates scarcity and unique value for each type of digital asset. Fungibility allows for easy exchange and use of digital assets as a currency, creating liquidity and promoting commercial transactions,” the delegate said.

Delegate Dong Ngoc Ba (Binh Dinh delegation) noted that the criteria for classifying digital assets in the draft Law are still unreasonable and unclear. "If we only talk about virtual assets in general and then distinguish them by determining which assets can be used for exchange and investment, I think implementation will be difficult," the delegate said, adding that it is necessary to base on technical criteria to distinguish 3 groups of digital assets, including virtual assets, encrypted assets and other digital assets, thereby providing appropriate management criteria.

Create a strong push to promote the development of digital technology industry

Speaking to explain and clarify a number of issues, Deputy Prime Minister Nguyen Chi Dung emphasized that the Law on Digital Technology Industry was built with the desire to create a strong push to promote the development of the extremely important digital technology industry today.

At the same time, it is necessary to achieve four goals: developing the digital technology industry into an important economic sector and making a worthy contribution to the country's economy; forming and developing an ecosystem of digital technology enterprises; basically shifting step by step from assembly and processing to stages with higher quality and content; developing modern and synchronous industrial and digital technology infrastructure; attracting and forming a high-quality workforce in this industry.

The Deputy Prime Minister said that after the 8th Session, the drafting agency closely coordinated with the reviewing agency, actively studied and fully absorbed the opinions of National Assembly deputies.

Along with that, we have updated, supplemented and fully absorbed the new policies stated in the three recent resolutions of the Politburo (Resolution 57, Resolution 66 and Resolution 68) to reflect in this draft and ensure the principle of both management and development creation.

Regarding the issues raised by National Assembly deputies during the discussion session, Deputy Prime Minister Nguyen Chi Dung affirmed that he will seriously study and absorb them to revise and perfect the draft Law, ensuring the best quality for submission to the National Assembly for approval at this session.
