At the meeting of the National Assembly Standing Committee on the morning of June 4, discussing the draft Law amending and supplementing a number of articles of the Law on Advertising, Chairman of the Committee on Culture and Society Nguyen Duc Vinh said that in order to overcome the situation where some celebrities and influencers advertise falsely, advertise fake and counterfeit goods, the draft law stipulates the obligation to "verify the credibility of the advertiser" to increase the responsibility of the person who transmits the advertising product to the community and society. The draft law also adds regulations on the time and form of notification before the influencer transmits the advertising product.
Regarding the proposal to add the obligation of the person who delivers the advertising product to be jointly responsible for compensation for false advertising, Mr. Nguyen Dac Vinh stated that to advertise a product, many entities are involved and each entity is responsible for fully performing its obligations when participating in advertising activities. When there is a violation, depending on the nature and extent of the violation, it must be subject to the corresponding form of handling.

Regarding the proposal to tighten regulations on the person who transmits advertising products as an influencer in the direction that only those with expertise related to the product can transmit advertising products, the representative of the inspection agency commented that, currently, in the market mechanism, the participation of famous people in advertising activities is a commercial activity with positive meaning, contributing to promoting production, business, economic development, and encouraging innovation in advertising activities. The law on food safety also specifically regulates the advertising activities of medical facilities, medical staff, etc.
"Therefore, the draft law requests to keep the regulation of not restricting advertising for influencers," Mr. Nguyen Dac Vinh stated.

Chairing the discussion session, Vice Chairwoman of the National Assembly Nguyen Thi Thanh emphasized that adding specific and clear regulations on the rights and obligations of those who transmit advertising products is one of the contents that received many comments from National Assembly deputies on the draft law.
Acknowledging the “power” of influencer advertising in the era of idol-based consumption, Vice Chairman of the National Assembly Le Minh Hoan said that during a business trip to China, he received information that a famous Tiktoker livestreamed for 5 hours and sold up to 650 million USD worth of durian.
“This very effective form of advertising cannot be ignored, but the draft law needs to have very clear regulations so that influential people are aware of and properly enforce the law, because they are very diverse in age, education level, and legal understanding,” Vice Chairman of the National Assembly Le Minh Hoan commented.

Meanwhile, Head of the Delegation Affairs Committee Nguyen Thanh Hai raised the issue of whether National Assembly deputies, who are also influential figures, when appearing in public and using products with the logo of a business, is considered advertising for the product or not; how to determine the "profit factor", if so, is it prohibited?...
