Completely resolve the situation of "backlog of documents" detailing regulations and instructions for law implementation

On the morning of November 22, presenting the introductory report at the first Law-making Forum, Chairman of the Committee on Law and Justice Hoang Thanh Tung suggested 6 groups of key issues for delegates to focus on discussing in order to create consensus and spread innovative thinking, and agree on solutions to continue improving the quality and effectiveness of the National Assembly's legislative work in the coming time.

Firstly, innovating legislative thinking towards being proactive, creative and leading development is a fundamental shift. Legislation needs to shift from the mindset of “pre-checking” and “absolute safety” to proactively accepting controlled risks, expanding space for innovation. It is necessary to strongly legislate the sandbox mechanism; improve the quality of policy forecasting; build a team of “institutional architects” with comprehensive, cross-disciplinary thinking, capable of grasping global trends and creating new models.

Second, perfecting the modern market economic institution in the context of digital transformation, green economy and the emergence of new economic models is an urgent requirement. The Chairman of the Law and Justice Committee said that the legal framework regulating this content needs to be built and perfected to be one step ahead, instead of just following reality; economic institutions and laws must become the driving force for rapid and sustainable growth.

Third is the issue of synchronous and effective operation of the two-level local government model and promoting decentralization and delegation of power in accordance with the motto "locality decides, locality does, locality is responsible". Chairman Hoang Thanh Tung stated that this not only requires reviewing and completing the amendment of a large number of relevant laws in accordance with the two-level local government model by 2027 as the target set out in Resolution 66-NQ/TW, but also ensuring that newly issued legal regulations maximize the capacity of two-level local governments and are consistent with practical management requirements.

Fourth, perfecting the law on human rights and civil rights in the digital age. According to the Chairman of the Committee on Law and Justice, legislative work will have to continue to focus on ensuring and effectively protecting privacy in the online environment, the right to access digital services, the right to protect personal data, etc.

Fifth, perfecting the law on preventing and combating corruption, waste and controlling power is still an urgent requirement to strengthen integrity and social trust. Regarding the work of law-making, Chairman Hoang Thanh Tung emphasized the need to continue reviewing to improve and ensure transparency in the stages of the process of building and promulgating documents, avoiding loopholes, negativity and the mechanism of asking and giving in legal regulations. At the same time, strengthening the work of monitoring and inspecting law enforcement and improving the effectiveness of recovering corrupt assets, ensuring real deterrence.

Sixth, regarding the completion of the legal system structure and the continued completion of the law-making and promulgation process, the Chairman of the Committee on Law and Justice stated that it is necessary to shorten the time but at the same time improve the quality of the stages in the process, especially the stages of policy-making, planning and policy impact assessment; enhance transparency, accountability and responsibility in the legislative process; and completely overcome the "backlog of documents" detailing and guiding the implementation of laws.

Within the framework of the first Law-making Forum, delegates listened to representatives of the Central Policy and Strategy Committee, the Ministry of Justice , the National Assembly's Economic and Financial Committee, the People's Committee of Da Nang City, and Hanoi Law University present papers on the following topics:

The role of institutions in liberating resources, making science, technology, innovation and digital transformation become important driving forces for Vietnam's rapid and sustainable development, towards the goal of a developed, high-income country by 2045.

Innovating and perfecting the structure of Vietnam's legal system to meet the requirements of national development in the new era associated with the development of the legislative orientation for the term of the 16th National Assembly.

Innovate and perfect the law on socialist-oriented market economy to create national competitive advantages and effectively attract all resources for national development.

Implementation of legal regulations on decentralization, decentralization, and delegation of power in the operation of the 2-level local government model - Looking from local practice, recommendations, and solutions.

Breakthrough solutions to improve the quality of human resources in law making and enforcement.

Strengthening power control, preventing group interests and local interests in policy making

In his closing speech at the Forum, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the comments and discussion statements contributed to clarifying many issues and innovations in the legislative activities of the 15th National Assembly, the results achieved, shortcomings, limitations, causes, lessons learned, requirements and solutions to continue to strongly innovate the legislative activities of the National Assembly in the coming time.

Through discussions, delegates unanimously assessed that the legislative activities of the 15th National Assembly have had strong innovations in thinking, construction processes, proactiveness, creativity, positivity, early preparation, promoting the role of "being one step ahead in terms of institutions", promptly responding to new situations, meeting the requirements of practical life. The legal system in recent times has been increasingly improved, achieving a number of outstanding results...

In addition, the presentations and opinions stated that in the work of building and perfecting institutions and laws, there is still a situation where power is not fully controlled, responsibilities are not clearly defined, transparent, and not substantive. For many years, decentralization and delegation of power have always been considered the focus of administrative reform, but the results have not been as expected.

The current legal system still lacks stability and predictability. The issuance and amendment of legal documents takes place with high frequency, often without full impact assessment, causing difficulties for enterprises in developing production and business plans, long-term strategic planning...

Agencies, organizations, delegates and experts have proposed 5 groups of tasks and solutions to continue perfecting the legal system in the coming time:

Firstly, continue to strongly innovate thinking, promote strategic breakthroughs, create a new development ecosystem, focus on comprehensively perfecting and synchronizing institutions for rapid and sustainable national development.

Second, the National Assembly Standing Committee needs to focus on directing the development of the Project on Legislative Orientation for the 16th National Assembly term, ensuring consistency and unity with the Project "Perfecting the structure of Vietnam's legal system to meet the requirements of national development in the new era" prepared by the Ministry of Justice.

Third, strengthen control over power in law-making activities, prevent group interests and local interests in policy-making, and ensure that all decisions put national and ethnic interests and the interests of the people above all else.

Fourth, synchronously implement breakthrough, comprehensive and drastic solutions to create fundamental changes in the quality of human resources in law-making and law enforcement, meeting the requirements of rapid and sustainable development of the country.

Fifth, in the context of digital transformation, digital economy, and digital data being applied more and more deeply and widely in all areas of national governance, the work of perfecting institutions and laws cannot stand outside that flow.
