8 specific mechanisms and policies to implement national target programs

On February 5, National Assembly Chairman Vuong Dinh Hue signed and issued Resolution No. 111/2024/QH15 dated January 18, 2024 of the National Assembly on a number of specific mechanisms and policies to implement national target programs.

This Resolution stipulates a number of specific mechanisms and policies to implement the National Target Program on New Rural Development for the 2021-2025 period, the National Target Program on Sustainable Poverty Reduction for the 2021-2025 period, and the National Target Program on Socio -Economic Development for Ethnic Minority and Mountainous Areas for the 2021-2030 period.

In the Resolution, the National Assembly resolved on 8 specific mechanisms and policies in implementing national target programs, including:

On allocation and assignment of annual central budget regular expenditure estimates

The National Assembly decides to allocate the annual central budget regular expenditure estimates to each locality according to the total expenditure of each national target program. The Prime Minister assigns the annual central budget regular expenditure estimates to each locality according to the total expenditure of each national target program. The provincial People's Council decides to allocate or delegate to the district People's Council the decision to allocate the annual central budget regular expenditure estimates of each national target program in detail to component projects.

On adjusting the state budget estimate, adjusting the annual state budget capital investment plan

The Provincial People's Council decides to adjust the 2024 state budget estimate (regular expenditure) and the undisbursed state budget estimate in 2023 (including investment expenditure and regular expenditure) of national target programs that have been transferred to 2024 according to the provisions of Resolution No. 104/2023/QH15 dated November 10, 2023 and Resolution No. 108/2023/QH15 dated November 29, 2023 of the National Assembly.

According to the decentralized authority, the People's Committees at the provincial and district levels decide to adjust the state budget investment plan of national target programs that have not been fully disbursed in 2023 and have been transferred to 2024 according to the provisions of Resolution No. 104/2023/QH15 dated November 10, 2023 and Resolution No. 108/2023/QH15 dated November 29, 2023 of the National Assembly.

Adjustment principle: Adjusting the state budget estimate from a component project that is no longer eligible for support or does not meet the conditions for disbursement of funds according to regulations or has a low disbursement rate to supplement the implementation estimate for other component projects in the same national target program must ensure that it does not exceed the total state budget estimate and does not change the structure of investment and regular expenditures of each national target program assigned by competent authorities.

Adjusting the annual state budget investment plan between investment projects in the list of medium-term public investment projects for the 2021-2025 period within the same national target program must ensure that it does not exceed the total investment capital assigned by the competent authority in the medium-term public investment plan of each project and the total capital in the year of each national target program.

On promulgating regulations on procedures, criteria, and sample documents for selecting production development projects

The provincial People's Committee shall decide on the order, procedures, criteria, and sample dossiers for selecting projects in production development support activities within the content of national target programs in cases where the provincial People's Council has not yet issued regulations on these contents.

In case it is necessary to amend or supplement the procedures, criteria, and project selection dossier forms in production development support activities within the content of national target programs promulgated by the Provincial People's Council, the Provincial People's Committee shall decide to amend or supplement after receiving the approval of the Standing Committee of the Provincial People's Council and report to the People's Council of the same level at the nearest session.

On the use of state budget in case the project owner is assigned to purchase goods and services to implement production development projects.

The project owner decides to purchase goods and services within the content of the production development support project approved by the competent authority.

Based on the decision to approve the production development support project, the project management agency shall pay support money from the state budget to the project owner to purchase goods and services as follows: In case the project owner directly produces and supplies goods and services in its business line, the project management agency shall directly pay the cost of production and supply of goods and services to the project owner according to the support level prescribed by the Provincial People's Council. In case there is no regulation of the Provincial People's Council on the support level, the project management agency shall pay according to the price of goods and services approved in the project approval decision of the competent authority; the competent authority approving the project shall decide on the price of goods and services based on the price of goods and services of the same type purchased and sold in the project implementation area proposed by the specialized financial agency under the People's Committee of the same level; In case there are no similar goods or services for sale in the project implementation area, the specialized financial agency under the People's Committee at the same level shall refer to the selling price of similar goods and services in the province to make a proposal; for projects approved by the Chairman of the People's Committee at the commune level, the specialized financial agency under the People's Committee at the district level shall make a proposal.

In case of using goods and services directly produced and supplied by local people in the project implementation area, the project management agency shall directly pay the cost of production and supply of goods and services to the project owner according to the price of goods and services purchased and sold at the commune level, confirmed by the People's Committee of the commune level. In case there are no similar goods and services for sale in the project implementation area, the project management agency shall refer to the selling price of similar goods and services in the province to decide on support payment to the project owner.

In case the project owner signs a contract for the purchase of goods and services with a supplier who is not a member of the production development project, the project management agency shall pay the supplier of goods and services according to a sales contract with confirmation from three parties, including the project owner, the supplier of services and goods, and the project management agency. The project owner shall be responsible for providing full documents proving the procurement activities, including sales invoices and other documents (if any) to the project management agency no later than 15 days from the date of receipt of goods and services from the supplier.

On management and use of assets formed in production development support projects

Assets formed from production development support projects are not subject to the provisions of law on management and use of public assets in the following cases:

Assets with a value of less than 500 million VND are supported with full or partial capital from the state budget.

Assets to support the community to participate in project implementation.

Assets with a value of 500 million VND or more are supported with capital from the state budget not exceeding 20% ​​of the asset value.

The project management agency is responsible for monitoring and supervising the management and use of assets during project implementation.

On the entrustment of local budget capital through the Social Policy Bank system

The National Assembly requests: Based on the local budget balance capacity, the People's Councils at provincial and district levels are allowed to decide on the allocation of local budget capital, including public investment capital, other development investment capital, regular expenses, and assign the People's Committees at the same level to entrust the local Social Policy Bank to support the implementation of the following activities of national target programs: developing production and business, creating jobs, stabilizing livelihoods, supporting housing improvement; developing products under the One Commune One Product Program; maintaining and developing traditional craft villages; developing rural tourism.

Subjects eligible for preferential loans include enterprises, cooperatives, and cooperative unions in ethnic minority and mountainous areas, rural areas, and poor districts; ethnic minority individuals, poor households, near-poor households, newly escaped poverty households, households with average living standards, and workers in areas within the scope of implementation of national target programs.

The submission, approval and assignment of medium-term public investment plans and annual capital investment plans to the local Social Policy Bank do not require the establishment of a list of programs and projects according to the provisions of the Law on Public Investment.

Provincial People's Committees shall prescribe the conditions, contents, and preferential loan levels to implement each credit policy supporting preferential loans as prescribed in Point a and Point b of this Clause.

On the pilot mechanism of decentralization to district level in managing and organizing the implementation of national target programs for the period 2024 - 2025

The Provincial People's Council is authorized to select no more than two districts to pilot the decentralization mechanism. The Provincial People's Committee decides to assign specific goals, tasks, and requirements for each national target program to the selected pilot districts.

District-level People's Councils are allowed to decide on adjusting the plan for allocating public investment capital and regular expenditures among national target programs in the medium-term public investment plan, annual capital investment plan, and annual state budget estimates assigned by competent authorities; the structure of state budget capital sources between investment expenditures and regular expenditures of component projects that are no longer eligible for support to focus capital on implementing other component projects under national target programs for the 2021-2025 period.

The annual state budget settlement of the district implementing the pilot mechanism is carried out according to the medium-term public investment plan, annual capital investment plan, and annual state budget estimate adjusted by the District People's Council according to the provisions at Point b of this Clause.

On the assignment of medium-term public investment plans and annual capital investment for small-scale, technically uncomplicated construction investment projects

Based on the list of expected projects reported to the District People's Council, the People's Committee at the same level assigns the medium-term public investment plan to implement small-scale construction investment projects with uncomplicated techniques according to the total capital to implement the projects; it is not required to assign the project list in the medium-term public investment plan.

The allocation and assignment of annual capital investment plans to implement small-scale, technically uncomplicated construction investment projects in detail for each project is carried out according to the principle that the total support capital from the state budget accumulated up to the time of capital allocation must not exceed the total capital to implement these projects in the medium-term public investment plan./.
