First, the Ho Chi Minh City Police Investigation Agency will verify and investigate whether the above assets belong to Ngan 98 or whether these assets are related to Ngan 98's criminal acts in order to take coercive measures to ensure the execution of the judgment.

This verification and investigation is to avoid infringing on the rights of others when implementing enforcement measures if any of the above assets does not belong to Ngan 98 or is obtained from criminal acts.

These assets may be seized under Article 128 of the 2015 Criminal Procedure Code for confiscation into the state budget or to ensure compensation for damages.
However, the competent authority will only seize the portion of property corresponding to the amount that can be confiscated or compensation for damages must be paid.
In case of confiscation of assets to be paid into the state budget; in case of having to compensate for damages:
If the buyer of Ngan 98's products participates in the litigation as a victim and provides evidence to request compensation, part or all of the above assets will be seized to ensure compensation for the victim.
Article 45 of the 2015 Penal Code stipulates: " Property confiscation is the confiscation of part or all of the property owned by the convicted person to be paid into the state budget. Property confiscation is only applied to persons convicted of serious crimes, very serious crimes or especially serious crimes against national security, drug crimes, corruption or other crimes prescribed by this Code".
Article 47 of the 2015 Penal Code stipulates:
"1. Confiscation into the state budget or confiscation and destruction shall be applied to:
Objects or money obtained from committing crimes or from buying, selling, or exchanging such things; illegal profits from committing crimes;"
From the above provisions, if it is proven that the above assets were obtained by Ngan 98 from selling counterfeit goods, part or all of the assets may be confiscated to the state budget.
