The Ministry of Home Affairs is finalizing the draft Decree of the Government regulating the organization of specialized agencies under the People's Committees of provinces and centrally run cities and the People's Committees of communes, wards and special zones under the provincial level. Accordingly, the Ministry of Home Affairs proposes that specific Departments be organized in a number of localities, including: Department of Foreign Affairs; Department of Ethnicity and Religion; Department of Tourism ; Department of Planning and Architecture be established in Hanoi and Ho Chi Minh City.
Department of Foreign Affairs
The Decree stipulates that the Department of Foreign Affairs will advise and assist the Provincial People's Committee in performing the state management function on: Foreign affairs and national border and territorial affairs (for provinces with borders).
The conditions for establishing a Department of Foreign Affairs are when the locality meets one of the following criteria: Having an international land border gate; Having an international air border gate; Having an international seaport.
The Department of Foreign Affairs is also established for localities with 500 or more foreign investment projects (or total foreign investment capital of over 100,000 billion VND) operating in the locality, with over 4,000 foreigners currently living and working in the locality, with annual import-export turnover of 100,000 billion VND or more, and having signed international cooperation agreements with 5 or more localities.
For localities that do not have a separate Department of Foreign Affairs, merge and transfer functions and tasks to the Office of the Provincial People's Committee.
Department of Ethnic and Religious Affairs
The Department of Ethnic Minorities and Religions will advise and assist the Provincial People's Committee in performing the function of state management of ethnicity, belief and religion.
The Department of Ethnic Minorities and Religions is established when the following criteria are met: There are at least 20,000 ethnic minorities living in concentrated village communities; There are at least 5,000 ethnic minorities in need of the State's focus on helping and supporting development; There are ethnic minorities living in areas of importance to security and national defense; areas of intercropping, inter-residential areas or border areas where many ethnic minorities from our country and neighboring countries frequently travel back and forth.
For localities that do not have a separate Department of Ethnic Minorities and Religion, the functions and tasks will be transferred to the Department of Home Affairs.
Department of Tourism
The Department of Tourism is an advisory unit, assisting the Provincial People's Committee in performing the state management function in the field of tourism.
The Department of Tourism is established when it meets all of the following criteria: Having a tangible cultural heritage recognized by the United NationsEducational , Scientific and Cultural Organization (UNESCO) as a World Heritage Site or having outstanding tourism resources and potential (having a national tourist area, national tourist destination or tourist city, large-scale, prominent sightseeing and resort);
Localities are allowed to establish a Department of Tourism when tourism is identified as a key economic sector in the local socio-economic development orientation and the economic value from tourism contributes to the local annual gross domestic product (GDP) with a proportion of 10% or more for 5 consecutive years.
For localities that do not have a separate Department of Tourism, merge and transfer functions and tasks to the Department of Culture and Sports and change the name to the Department of Culture, Sports and Tourism.
Department of Planning and Architecture
Hanoi and Ho Chi Minh City alone have established the Department of Planning and Architecture. This is an advisory unit, assisting the City People's Committee in performing the function of state management of construction planning and architecture.
In case Hanoi and Ho Chi Minh City do not have separate Departments of Planning and Architecture, they will merge and transfer functions and tasks to the Department of Construction.
