Amending the 2024 Land Law in line with the operation of two-level government
According to the Ministry of Agriculture and Environment , the 2024 Land Law and its implementing documents are gradually perfecting the institution, improving the effectiveness and efficiency of land management, especially through promoting decentralization and delegation of power to localities. This content has been stipulated throughout previous versions of the law and continues to be strongly specified in the current period.

Accordingly, the Central level only retains part of the authority related to land use planning and planning. Other state management contents in the land sector have been decentralized to local authorities such as: land allocation, land lease, permission to change land use purposes, compensation, support, resettlement when the State reclaims land... Regulations related to decentralization of authority to local authorities according to current land laws are contributing to early implementation of land policies into real life, reforming administrative procedures on land, and enhancing the responsibility of local authorities at all levels in land management and use.
In addition, implementing the policy of arranging administrative units and organizing a two-level local government model, the Ministry has proactively reviewed the land law system, thereby advising the Government to issue Decree No. 151/2025/ND-CP dated June 12, 2025. The Decree has promptly clearly defined the authority between the provincial and communal levels, ensuring effective implementation of the decentralization mechanism in the new context.
"After 1 year of implementing the Land Law, it is shown that there are still some shortcomings and problems that require continued research and amendment to continue institutionalizing the Party's viewpoints and orientations. At the same time, removing difficulties and problems in the process of organizing the implementation of the Land Law is necessary to meet the requirements of the country's socio -economic development in the current period.
The Ministry of Agriculture and Environment proposed amendments and supplements to fully and promptly institutionalize the Party and State's viewpoints and policies on land policy after 3 years of implementing Resolution No. 18-NQ/TW and 1 year of implementing the 2024 Land Law, on the organization and organization of the apparatus and administrative units according to the two-level government model, on private economic development, on breakthroughs in science and technology development, innovation and national digital transformation, international integration in the new situation, on innovation in law-making and enforcement; ensuring inheritance, stability and consistency of the legal system.
At the same time, promptly resolve priority and urgent issues in the land sector to promptly resolve new issues arising from practice, remove institutional "bottlenecks", and contribute to achieving socio-economic development goals," said a representative of the Ministry of Agriculture and Environment.
Amend 3 groups of land content
The Draft Law consists of 2 articles, of which Article 1 amends and supplements a number of articles of the Land Law, including 68 clauses, including 3 groups of contents: Group of institutional contents, viewpoints, objectives, tasks, solutions to amend and supplement Resolution No. 18-NQ/TW proposed by the Government Party Committee and approved by the Central Executive Committee in Resolution No. 69-NQ/TW dated July 19, 2025.

Article 2 stipulates the effective date. The consultation demonstrates the spirit of openness and mobilization of collective intelligence in amending land policy, a key area that affects all aspects of the country's socio-economic life, national defense, security, and environmental protection; plays a central role in the land law system, and is related to many other provisions of law.
Previously, on July 26, the Ministry of Agriculture and Environment issued Official Dispatch 4779 to 14 central ministries and branches; 5 socio-political and professional organizations; and 34 People's Committees of provinces and centrally-run cities to solicit opinions on the draft Law amending and supplementing a number of articles of the Land Law. Comments are requested to be sent to the Department of Land Management, Ministry of Agriculture and Environment before August 10, 2025 for synthesis and completion of the dossier to be submitted to the Government.
