
Under the new regulations, couples have the right to decide when to have children, the number of children and the spacing between births, based on age, health status, education, work, income and child-rearing ability of each individual and couple, on the basis of equality. The Ordinance takes effect from the date of its adoption.
Minister of Health Dao Hong Lan said the amendment aims to correct the fertility gap between regions and target groups, and prevent the fertility rate from falling too low and falling short of replacement levels. Prolonged low fertility rates could affect future economic , social, security and defense development.
The government believes that the current regulations on the number of children are no longer suitable for reality when the birth rate in Vietnam is decreasing. The national birth rate has decreased from 2.11 children/woman (2021) to 2.01 (2022), 1.96 (2023) and 1.91 (2024) - the lowest level in history - and may continue to decrease in the coming years.
According to forecasts, by 2039, Vietnam will end its golden population period. By 2042, the working-age population will peak, and after 2054, the population may experience negative growth. This situation will lead to labor shortages, population decline and accelerated aging, thereby affecting socio-economic development.
Previously in March, the Central Inspection Commission issued Instruction No. 15 amending a number of articles in the 2022 Instruction on disciplinary action against party organizations and party members who violate the law. Accordingly, party members who have a third or more children will not be subject to disciplinary action.
