Supplementing regulations on intellectual property protection for virtual assets and artificial intelligence

Continuing the 10th Session, on the afternoon of October 27, Minister of Science and Technology Nguyen Manh Hung, authorized by the Prime Minister, presented the draft Law on amending and supplementing a number of articles of the Law on Intellectual Property (IP).

Minister Nguyen Manh Hung mentioned the policy of "updating new issues in intellectual property protection in the world in accordance with Vietnam's policies and socio -economic development level".

Accordingly, amend and complete the regulations on objects protected by industrial designs (to protect both industrial designs for user interface designs and virtual assets).

Regarding the reason, Minister Nguyen Manh Hung said it is to create a complete and clear legal basis to protect industrial property rights for virtual assets and user interface design.

Regarding new additional content, additional provisions are added to protect inventions for computer programs, algorithms, business methods in some specific cases, and protect trademarks related to signs indicating national geographical origin (Articles 59 and 74).

Supplementing regulations to protect intellectual property rights for virtual assets and issues related to artificial intelligence to handle problems arising from new trends in technology and innovation, and digital transformation (Articles 4, 7, 22).

This is to create a clear legal basis to handle a number of issues arising from new trends in technology development, innovation and digital transformation.

Another content is the policy of “supporting the creation and commercial exploitation of intellectual property objects to promote innovation”.

Amending and perfecting the concept of intellectual property rights. Clarifying state management of intellectual property rights, including raising awareness, capacity to exploit and develop intellectual property rights objects.

Amend and complete regulations on cases of limitation of copyright and related rights in broadcasting activities; on the right to register intellectual property and commercially exploit these rights for the results of scientific and technological tasks using the state budget.

Amend and perfect regulations against abuse of intellectual property rights and abuse of intellectual property protection measures.

The reason is to create a legal basis to promote the commercial exploitation of intellectual property rights, ensuring compliance with civil law and international commitments.

Regarding new additional content, additional provisions on handling intellectual property conflicts are added to facilitate commercial exploitation (Article 7).

Supplementing contents on State policies in supporting the creation and commercial exploitation of intellectual property objects to promote innovation.

Accordingly, support the creation, establishment, exploitation, management, and development of intellectual property rights objects; support the valuation and application of intellectual property rights transfer models and intellectual property rights sharing mechanisms; the State gives priority to purchasing intellectual property rights for objects important to national security and socio-economics.

Pioneer in ordering, purchasing, and using products and services created based on computer programs, inventions, layout designs, and plant varieties created in Vietnam; supplement policies for developing the IP ecosystem, and encourage organizations and individuals to invest in start-up businesses.
