Ministry of Health informs about state inspection regulations for imported food

The Food Safety Department has sent a document to organizations and individuals producing and trading food and food additives regarding state inspection of food.

Recently, the Food Safety Department has received many official dispatches from organizations and individuals asking about state inspection of food safety for imported goods according to the provisions of Circular No. 15/2024/TTBYT of the Ministry of Health dated September 19, 2024 promulgating the list of foods, food additives and food containers, packaging materials in direct contact with food that have been identified with commodity codes according to the list of Vietnamese export and import goods subject to state inspection of imported food safety under the management of the Ministry of Health.

Regarding this content, the Food Safety Department has comments, specifically:

In case the product is a food additive listed in the List of Circular 15/2024/TT - BYT, state inspection shall be conducted according to the provisions of Circular No. 15/2024/TT-BYT.

In case the product is listed in the List of Circular 15/2024/TT - BYT used as food ingredients, not intended for use as food additives or food processing aids, it is not subject to state inspection on food safety according to the provisions of Point b, Clause 4, Article 3 of Circular No. 15/2024/TT - BYT.

In case the product is only used for the production, processing of export goods or for internal production of organizations and individuals, and is not consumed in the domestic market, it is exempted from self-declaration procedures and from state inspection of imported food safety (except in cases where there are food safety warnings) according to the provisions of Clause 2, Article 4 and Clause 7, Article 13 of Decree No. 15/2018/ND-CP dated February 2, 2018 of the Government guiding the implementation of a number of articles of the Law on Food Safety.

In case of products used as health protection foods: Organizations and individuals are requested to register for product declaration according to the provisions of Article 6 of Decree No. 15/2018/ND-CP. The dossier and procedures for registering product declarations are according to the provisions of Article 7 of Decree No. 15/2018/ND-CP, the competent authority receiving product declarations is according to the provisions of Point a, Clause 1, Article 8 and Clause 5, Article 37 of Decree No. 15/2018/ND-CP. Products that have been granted a Certificate of Acceptance of Product Declaration Registration are exempted from state inspection of imported food safety (except in cases of food safety warnings) according to the provisions of Article 13 of Decree No. 15/2018/ND-CP.

Regarding the determination of commodity codes, organizations and individuals are requested to contact the Customs authority for specific instructions in case of differences or inconsistencies in the classification and determination of commodity codes.
