Continuing the agenda, during the week, the National Assembly held sessions to contribute to draft laws with different opinions. Ms. Le Thi Thanh Lam, member of the Provincial Party Committee, Deputy Head of the National Assembly Delegation of Hau Giang Province, contributed many opinions to the draft Law on Forces Participating in Protecting Security and Order at the Grassroots Level.
Ms. Le Thi Thanh Lam commented on the draft Law on Forces participating in protecting security and order at the grassroots level.
Regarding the scope of regulation, she said that regulations on positions, functions, tasks, principles, and organization of activities are not enough; to ensure that this force operates effectively, she suggested that the Drafting Committee supplement regulations on the authority of the force participating in protecting security and order at the grassroots level so that when the law comes into force, it will be easier to implement.
The Deputy Head of the delegation discussed that the draft regulation stipulates that the age of participation in the security and order protection force at the grassroots level is Vietnamese citizens aged 18 and over, but the maximum age is not yet specified, which is incomplete.
Reiterating the explanation and acceptance of the National Assembly Standing Committee: One of the criteria for citizens to be selected to join the force to protect security and order at the grassroots level is to ensure health standards according to regulations; if there is a maximum age limit, it will be difficult to attract people to participate... and Ms. Le Thi Thanh Lam suggested that the Drafting Committee should consider regulating the maximum age for this force.
Explaining why it is necessary to add, according to Ms. Lam, there are currently many types of reckless and reckless crimes, often also against law enforcement officers, which can easily cause injuries to the participating forces while performing their duties. If the elderly, although healthy, may not be agile, or not strong enough to support the suppression of violators and it is very difficult to complete the task at the grassroots level.
Regarding training and support for people participating in the security and order protection force at the grassroots level, Clause 1, Article 23 of the draft has regulations, but to ensure regular payment policies and regimes, if the support level is decided by the Provincial People's Council, this force will only receive partial financial support, which will be more disadvantaged and difficult in attracting volunteers to participate.
In reality, Ms. Lam said that the People's Council's budget in each locality has different sources of revenue, so the spending and support regimes are also different, which will require comparison. Therefore, the Drafting Committee needs to study the payment regime and policies for the forces participating in protecting security and order at the grassroots level with specific salaries calculated according to the salary coefficient to ensure that the salary for the subjects meets the needs of life, attracting more active and effective participants.
The Deputy Head of the National Assembly Delegation of Hau Giang province also added: The draft stipulates many tasks for this force, while there is no provision defining its authority, so it is very difficult to implement effectively.
“I propose that the Drafting Committee consider continuing to review the regulations on the tasks of the force participating in protecting security and order at the grassroots level to be consistent with the functions, tasks and powers of the force. This will also avoid duplication with the tasks of the people's police and ensure consistency with other relevant regulations in the legal system.
