It is necessary to clarify the "subordinate" nature of the member organizations of the Vietnam Fatherland Front.

On May 21, the National Assembly heard the presentation and report on the draft Law amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth and the Law on Implementing Democracy at Grassroots Level.

The draft law was presented by Chairman of the Central Committee of the Vietnam Fatherland Front Do Van Chien, amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front to fully institutionalize the Party's guiding viewpoints, especially the Project on streamlining and merging the Vietnam Fatherland Front agencies, socio-political organizations, and mass organizations assigned tasks by the Party and State at the central, provincial and communal levels.

At the same time, the draft law closely follows and fully concretizes the amended and supplemented provisions of the 2013 Constitution directly related to the Vietnam Fatherland Front and socio-political organizations; focusing on amending and supplementing provisions directly related to the position, role, functions, tasks, rights, responsibilities, organizational structure and activities of the Vietnam Fatherland Front, socio-political organizations and mass organizations assigned by the Party and State.

The draft law consists of 5 articles, amending and supplementing a number of provisions of the Law on the Vietnam Fatherland Front. In particular, the draft affirms that the Vietnam Fatherland Front is a part of the political system of the Socialist Republic of Vietnam; the Vietnam Fatherland Front plays a leading role, socio-political organizations coordinate with other member organizations, and at the same time promote the initiative and creativity of each organization in democratic consultation and unified action.

The draft law amends and supplements a number of provisions of the Trade Union Law, including provisions on the position and tasks of trade unions, which affirms that trade unions "are member organizations under the Vietnam Fatherland Front" and "represent workers at the national level in labor relations and international relations on trade unions".

The bill also amends and supplements a number of provisions of the Youth Law, affirming that the Ho Chi Minh Communist Youth Union is a member organization under the Vietnam Fatherland Front...

Presenting the report on the review of the draft law, Chairman of the Committee on Culture and Society Nguyen Dac Vinh stated that the committee agreed with the necessity of promulgating a law amending and supplementing 4 laws with the scope of amending and supplementing a number of articles directly related to the arrangement of the organizational apparatus; position, role, functions, principles and organization of activities of the Vietnam Fatherland Front, socio-political organizations, and mass organizations assigned by the Party and State in the Law on the Vietnam Fatherland Front, the Law on Trade Unions, the Law on Youth, and the Law on Implementing Democracy at the Grassroots Level.

However, the committee recommends that it is necessary to promptly update the amendments and supplements to the 2013 Constitution and related laws to ensure the constitutionality, consistency, synchronization and feasibility of the legal system; continue to clarify the "subordinate" nature of member organizations of the Vietnam Fatherland Front, the working relationship between the Fatherland Front and its subordinate members while still ensuring relative independence, proactive creativity, and operation according to the law and charter of each organization in accordance with the spirit of the Constitution and Resolutions of the Central Committee...

Regarding the monitoring and criticism activities of the Vietnam Fatherland Front and its member organizations, the committee recommends that this content should be specifically regulated in the Charter of the Vietnam Fatherland Front to ensure "relative independence" in the monitoring and criticism activities of its member organizations; to ensure that its member organizations can proactively carry out a number of monitoring activities on subjects and contents related to their members and to perform the political functions and tasks assigned by the Party and the State.
