Consider regulations to expand vehicle license plate auctions

In the report on explanation, acceptance and revision of the draft Law on Road Traffic Safety, the National Assembly Standing Committee said that the majority of opinions suggested studying and evaluating the implementation results to supplement the draft Law on regulations on auctioning automobile license plates; there were opinions suggesting studying and expanding the auction to include license plates of trucks, passenger cars and motorbikes.

The National Assembly Standing Committee basically agreed with the Government 's reports and found that the implementation of Resolution No. 73/2022/QH15 in the recent past has brought positive results, proving the effectiveness and feasibility of this new policy. In the 5 months of implementation, 15,185 car license plates were successfully auctioned online, with a total auction price of VND 2,052,740,000,000 and 14,062 car license plates were auctioned and paid by customers with the amount of VND 1,395,960,000,000; the license plate auction has received great attention, agreement and support from public opinion.

The legalization of the provisions of Resolution No. 73/2022/QH15 into the draft Law on Road Traffic Safety is very necessary, combined with the issuance and management of license plates according to the vehicle owner's identification code, contributing to reforming administrative procedures, reducing the number of documents when registering, vehicle registration work, meeting the goals of digital citizens, digital government according to Project 06 of the Government and effectively exploiting and managing public assets. Expanding the auction of license plates for transport business vehicles and motorbikes is very necessary. If this Law is not promptly included in the draft Law but waits until the end of the pilot implementation period, conducts a summary, and reports to the National Assembly, then the procedures for amending and supplementing the new Law must be carried out by the National Assembly, which will be costly and wasteful in both time and budget.

To legalize the content of vehicle license plate auctions, according to the proposal of the majority of delegates, the National Assembly Standing Committee directed the design of 02 options:

Option 1: Add 01 article to the draft Law on Road Traffic Safety (Article 37 of the revised draft Law), in the spirit of inheriting the content of Resolution No. 73/2022/QH15 on pilot auction of adjusted license plates to overcome difficulties and problems in the implementation of the above Resolution.

Option 2: Add the content of vehicle license plate auction to the draft Law amending and supplementing a number of articles of the Law on Property Auction.

The Standing Committee of the National Assembly recommends that the National Assembly deputies choose Option 1, because including the provisions in the draft Law on Road Traffic Safety is consistent with the opinions of the National Assembly deputies, consistent with the scope of regulation of the draft Law on Road Traffic Safety as a specialized law, will fully and specifically regulate the contents of vehicle license plate auctions and create consistency with other regulations on vehicle license plates such as management of road vehicles, issuance and revocation of vehicle registration certificates and license plates.

Careful impact assessment needed when expanding the scope of auctions

Speaking at the meeting, delegate Nguyen Minh Tam ( Quang Binh delegation) agreed with option 1, accordingly including the content of vehicle license plate auction in the draft Law.

According to the delegate, it is necessary to legalize the regulations on vehicle license plate auctions in this Law, combined with the issuance and management of vehicle license plates according to the vehicle owner's identification code to contribute to reforming administrative procedures, reducing the number of documents when registering, vehicle registration work, meeting the goals of digital citizens, digital government according to Project 06 of the Government and effectively exploiting and managing public assets.

However, delegate Nguyen Minh Tam said that license plates are a type of public property, like land, water resources, forest resources, mineral resources, etc., so managing license plates is similar to managing other types of public property.

Therefore, this law only regulates the content such as the type of license plate to be auctioned, the starting price, the rights and obligations of the auction winner, vehicle registration, the license plate number of the auctioned vehicle, etc., while the form such as the order and procedures of the auction are implemented according to the provisions of the Law on Property Auction to ensure consistency and synchronization between specialized laws and the Law on Property Auction; the Government is not assigned to regulate the order and procedures as in Clause 11, Article 37 of the draft law.

Delegates also proposed expanding the license plate auction to all road motor vehicles.

Meanwhile, delegate Dong Ngoc Ba (Binh Dinh delegation) suggested considering expanding the auction of license plates. For now, if it is legalized, it will only be legalized within the scope of the pilot implementation, that is, license plates of cars with white backgrounds and black letters and numbers, not yet expanded to other license plates.

“When legislating like this, there needs to be additional assessment of social impacts, especially cultural aspects,” the delegate suggested.

Regarding legislative techniques, delegates suggested that if this law stipulates auctions, it is necessary to amend the provisions in the Law amending and supplementing a number of articles of the Law on Property Auctions, including some contents such as deposits...

Sharing the same view, delegate Ho Thi Kim Ngan (Bac Kan delegation) also suggested careful consideration when including in the draft Law the regulation on expanding the auction of license plates for motorbikes and mopeds, and a full impact assessment is needed.

“Practice shows that the process of auctioning license plates according to the National Assembly Resolution has received public attention, met people's needs, and contributed to increasing budget revenue. However, the auction of license plates is a new procedure and new regulation, and is in the pilot phase, so its application will encounter difficulties and shortcomings,” said the delegate.

Therefore, the delegate proposed to study, consider, and have a comprehensive, specific, and comprehensive summary of the results of the implementation of Resolution No. 73/2022/QH15 on pilot auction of automobile license plates to supplement the draft Law accordingly. At the same time, the delegate also proposed to clarify the basis and basis for regulating the starting price of the types of license plates put up for auction as proposed in the draft Law.
