The provincial People's Court has just tried cases related to the practice of TXTL and then mortgaging or selling for appropriation. Through the above cases, it can be seen that TXTL still has many loopholes, creating conditions for subjects to easily commit crimes.

The case recently brought to trial by the Provincial People's Court on the charge of "Abuse of trust to appropriate property" against defendant Le Hoang Vu (born in 1983, residing in Phu Hoi ward, Hue city) is a typical example.

According to the indictment, because he needed money for personal expenses, Vu went to the TXTL facility to rent a Porsche car from Mr. Nguyen Hoang S. (born in 1990, residing in Thuan Hoa ward, Hue city) as a means of transportation. After that, Vu had the intention of appropriating this "super car", so he pawned the car at another pawn shop owned by Mr. Vo Van Xuan H. (born in 1981, residing in Tay Loc ward, Hue city) for 4 billion VND. After receiving the money, Vu used this money to pay off debts and for personal expenses. For this act, Vu was sentenced by the Provincial People's Court to 5 years in prison for the crime of "Abuse of trust to appropriate property".

Another case is Nguyen Van Hoanh (born in 1995, residing in Huong Hoa district, Quang Tri province) who was recently sentenced by the Provincial People's Court to 15 years in prison for two crimes: "Abuse of trust to appropriate property" and "Using fake documents of agencies and organizations".

According to the investigation agency, Hoanh went to the TXTL facility in Da Nang City three times to rent cars for transportation. After that, Hoanh had the idea of ​​appropriating these cars to pay off debts and for personal expenses. At the police station, Hoanh confessed that because he needed money to spend and gamble, he had the idea of ​​renting cars to pawn, in order to appropriate property.

To carry out the appropriation, Hoanh went online to find and forge a citizen identification card and 3 car registration certificates for rented cars. The owner of these fake registration certificates is Nguyen Van Hoanh to facilitate the pawning. After that, Hoanh took 3 cars and the forged papers to pawn at a pawn shop in Hue City. The investigation agency assessed that the value of the property that Hoanh appropriated from the victim was more than 2.1 billion VND.

Previously, the Provincial People's Court held a first-instance trial of the case of "Abuse of trust to appropriate property" against Tran Anh Tuan (born in 1982) and Tran Xuan Ngoc (born in 1987, both residing in Gia Lac commune, Gia Vien district, Ninh Binh).

According to the case file, while traveling in Thua Thien Hue, Tuan called a friend to ask him to find someone in Hue for TXTL to serve his business. Through an intermediary, Tuan contacted Mr. T. A (in Phu Bai Ward, Huong Thuy Town) to negotiate a car rental. Tuan and Ngoc picked up the car in Huong Thuy Town, then drove together to Quang Nam.

Due to lack of money, Tuan had the idea of ​​taking possession of the car, so he discussed with Ngoc about pawning the rented car to get money. Because the car was not “registered”, Tuan and Ngoc begged a person in Quang Nam to help them look at it because they needed money for something, and they agreed to pawn it for 230 million VND. Tuan and Ngoc divided this money for personal use.

Currently, Tran Anh Tuan is facing a sentence of 6 years in prison and Tran Xuan Ngoc received a sentence of 5 years and 6 months in prison for the crime of "Abuse of trust to appropriate property".

According to the authorities, the subjects who TXTL and then sell or pawn the vehicle often use methods such as: renting a nice phone number and then using this phone number to contact and ask for TXTL; creating fake vehicle papers, unclear ID cards, and household registrations; willing to deposit a high amount of cash to create trust for the rental facility owner. But immediately after TXTL, the subject will run to the pre-arranged garage to remove the GPS and take the vehicle to sell or pawn without coming to redeem it.

In addition, there are subjects who pretend to be business owners renting cars for companies. Then, they gain the trust of car rental companies, are willing to rent cars at high prices, rent cars for long periods of time by month or year... and then commit acts of appropriation.

From the above incidents, the authorities recommend that businesses and individuals providing TXTL need to be more vigilant against the tricks of criminals, need to carefully verify the information of the car renter, fully implement the procedures and measures to legally bind the car renter. Regularly monitor the vehicle's travel schedule, if there are any abnormalities, must directly use measures to prevent the subjects from appropriating property and notify the nearest police agency to avoid unfortunate risks.
