The Ministry of Industry and Trade has just issued Decision No. 1398 dated May 20 on the Plan for peak monitoring, inspection and handling of smuggling, trade fraud, counterfeit goods and infringement of intellectual property rights in the new situation.
The Decision aims to effectively implement Directive No. 13 dated May 17, 2025 of the Prime Minister on strengthening the fight against smuggling, trade fraud, and counterfeit goods in the new situation; Official Dispatch No. 65 of the Prime Minister dated May 15, 2025 on launching a peak period of fighting to prevent and repel smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
At the same time, focus on fighting, preventing, repelling, and eventually ending smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights (IPR) to protect the legitimate rights and interests of people and businesses, protect security and health for the people, and contribute to the country's rapid and sustainable development.
The decision also aims to strengthen market inspection and control activities, and handle violations of the law according to assigned functions, tasks, and authorities; focus on inspecting and strictly handling violations of the law in smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights.
Create breakthrough changes in the fight against smuggling, trade fraud, counterfeit goods, and infringement of intellectual property rights associated with the process of arranging administrative units at all levels; improve management capacity, define responsibilities, functions, and tasks, avoid overlapping or missing tasks, and leave no gaps in state management.
Decision No. 1398 requires the Chief of the Ministry's Office, Director of the Department of Domestic Market Management and Development, Director of the Department of E-commerce and Digital Economy , Director of the Department of Import and Export, Chairmen of People's Committees of provinces and centrally-run cities to closely follow the spirit and content of Directive No. 13 and Official Dispatch No. 65 of the Prime Minister to ensure proper implementation of the focus, key points, substance, and no formality.
Direct and request relevant units to grasp the market situation, local management work, coordinate with local agencies and functional forces, conduct inspections and strictly handle cases of smuggling, production and trade of counterfeit goods, infringement of intellectual property rights, goods of unknown origin, especially in key areas such as: Hanoi, Lang Son, Quang Ninh, Hai Phong, Hung Yen, Thanh Hoa, Phu Yen, Da Nang, Hue, Ho Chi Minh City, Long An, An Giang, Tay Ninh, Can Tho... thereby pointing out the causes of violations, loopholes and inadequacies in regulations that subjects take advantage of to violate the law to propose solutions to competent authorities.
Along with that, the Ministry of Industry and Trade requested relevant units to focus on inspection in the e-commerce environment, strictly and promptly handle violations of the law on production and trading of essential goods serving people's lives, especially dairy products, modern medicines, health protection foods, etc.
It is recommended to focus on monitoring, inspecting, controlling the market and strictly handling according to the law the essential goods serving people's lives, especially dairy products, modern medicines, medicinal herbs, cosmetics, functional foods, processed foods, foods from animals and plants... on small retail channels, unofficial agents, especially e-commerce platforms and social networking sites, where there are many potential risks of counterfeit goods, goods of unknown origin, poor quality goods, goods that infringe intellectual property rights.
At the same time, it is required to promote the application of information technology and digitalization in management, build a system to collect and share data and market information for common use throughout the industry and trade sector and connect with other functional agencies to promptly grasp and forecast the risk of smuggling and trade fraud, especially in the field of e-commerce.
