Minister of Construction Tran Hong Minh presented the Draft Law on Railways (amended).

On the afternoon of May 27, continuing the 9th Session, the National Assembly listened to the Presentation and Review Report on the draft Law on Railways (amended).

The draft Law on Railways (amended) presented by Minister of Construction Tran Hong Minh said that the development and promulgation of the Law is necessary to institutionalize the Party's policy, create institutional breakthroughs for railway development; at the same time, overcome shortcomings and limitations in the implementation of the 2017 Law on Railways.

The Draft Law is rearranged and restructured to include 7 Chapters and 67 Articles, 3 Chapters and 20 Articles less than the 2017 Railway Law, eliminating regulations on 20% of administrative procedures and 33% of business conditions compared to the current Railway Law to meet the requirements of simplification and reduction of administrative procedures and business conditions.

Regarding investment in developing railway infrastructure, the draft law supplements regulations to maximize the mobilization of local resources and other economic sectors to participate in investing in building railway infrastructure.

In particular, there are regulations on encouraging all organizations and individuals to participate in investing in developing railway infrastructure through many forms of contracts. At the same time, additional regulations are added allowing localities to use their budgets to participate in compensation, resettlement support, and investment in the construction of some items of national railway infrastructure.

Amending and supplementing regulations clearly defining the responsibilities of entities in investing in the construction of national railways, local railways, specialized railways and technical infrastructure works connecting to railways, national railways shared with local railways, and railways shared with roads.

The addition of these regulations creates a legal basis for investment in railway infrastructure, such as investment in the construction of bridges connecting railways and roads...

Clarifying the scope of regulation for urban and high-speed railways

Presenting the Report on the review of the draft Law, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy stated that the Committee believes that the draft Law has been seriously supplemented, explained, absorbed and revised according to the opinions of the National Assembly Standing Committee, the preliminary review opinions of the Agency in charge of the review, and the agencies of the National Assembly.

The Committee basically agrees with the name, scope of regulation, and subjects of application of the draft Law. However, it proposes to clarify the scope of regulation of the draft Law for urban railways, high-speed railways, and specialized railways; railway business, and exploitation of land funds in the vicinity of railway stations.

The Committee also basically agrees with the general regulations on railway classification and railway technical levels. However, it is recommended to review and clarify the regulations on specific technical standards for each type of railway; the connection between these types in the national railway transport system; the rationality and feasibility in classifying the railway system in association with the management objects and investment resources.

Regarding the development of railway industry and railway vehicles, the Committee proposed to study and supplement regulations on the development of supporting industries in the railway sector, helping the railway industry develop sustainably and meet requirements in the context of rapidly developing technology.

Research and supplement regulations on the development and application of digital technology in the railway sector; clearly stipulate the mandatory transfer of all or part of technology; propose regulations on specialized research centers on railway technology, cooperation with research institutes and universities, etc.
