Resolution of the Special Session on Law Making in May 2025

The Prime Minister chaired the Government's special meeting on law making in May 2025.

The Government issued Resolution No. 158/NQ-CP dated June 3, 2025. Special session on law making in May 2025.

At the meeting on May 22, 2025, the Government discussed and gave opinions on the following Law projects and Law policy dossiers: the Law project on Temporary detention, temporary imprisonment and prohibition from leaving the place of residence; the Law project on Criminal Judgment Enforcement (amended); the Law policy dossier on the Law on Thrift and Anti-Waste (amended); the Law policy dossier on the Law on Food Safety (amended); the Law policy dossier on the Law on Population; the Law policy dossier on the Law on Judicial Expertise (amended) and the Guidelines for developing and perfecting decrees on decentralization, delegation, and division of authority associated with the implementation of the two-level local government organization model.

Research on regulations to enhance the application of science and technology in the management of people detained, imprisoned, and prohibited from leaving their place of residence.

Regarding the draft Law on Temporary Detention, Temporary Imprisonment and Prohibition from Leaving the Place of Residence , the Government assigned the Ministry of Public Security to promptly absorb the maximum opinions of Government members and the Government's conclusions, and complete the draft Law to ensure the following requirements: Review the provisions of the draft Law, ensure adherence to the Party's policies, especially the newly issued Resolutions and Conclusions; be consistent with the legal system, in accordance with relevant international treaties to which Vietnam is a member; and be consistent with relevant draft laws amended and supplemented at the 9th Session of the 15th National Assembly.

Research regulations to enhance the application of science and technology in the management of detainees, temporary prisoners, and people banned from leaving their place of residence; decentralize and delegate power, especially to the grassroots level in handling related procedures; thoroughly reform administrative procedures.

The Ministry of Public Security shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to complete the draft Law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Public Security shall be assigned, on behalf of the Prime Minister, to sign the Submission to the National Assembly for consideration and comments on this draft Law at the 10th Session of the 15th National Assembly (October 2025).

Regarding the draft Law on Criminal Judgment Execution (amended) , regarding the removal of the regulation that prisons receive money and assets voluntarily submitted by prisoners and their relatives at prisons to execute sentences: Consider appropriate and flexible regulations, ensuring the rights and legitimate interests of prisoners, creating the most favorable conditions for prisoners and their relatives, avoiding negativity.

Regarding the organization of labor for prisoners outside prison: Propose to organize a preliminary review of the results of the implementation of Resolution No. 54/2022/QH15 dated June 16, 2022 of the National Assembly on the pilot model of organizing labor activities, career guidance, and vocational training for prisoners outside prison. On that basis, propose to regulate the organization of labor for prisoners outside prison in the draft Law.

The Ministry of Public Security shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to complete the draft Law dossier in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Public Security shall be assigned, on behalf of the Government, to sign the Submission to the National Assembly for consideration and comments on the draft Law at the 10th Session of the 15th National Assembly (October 2025).

Research on strong enough sanctions with high deterrence against wasteful behavior

Regarding the Policy Profile of the Law on Thrift and Anti-Waste (amended) , the Government highly appreciates the Ministry of Finance for presiding over and coordinating with the Ministry of Justice and relevant agencies to research and prepare the Policy Profile of the Law on Thrift and Anti-Waste (amended) in accordance with the provisions of the Law on Promulgation of Legal Documents.

The Government requests the Ministry of Finance to study and carefully review the expected wasteful behaviors, along with a monitoring, inspection, examination and handling mechanism that is strong enough and highly deterrent, and to strengthen decentralization and delegation of authority to ensure conformity, synchronization and consistency with the provisions of the State Budget Law; Law on Management and Use of Public Assets; Law on Public Investment; Law on Management and Use of State Capital Invested in Production and Business at Enterprises; Land Law and laws on management and use of resources; Penal Code; Law on Handling of Administrative Violations; Law on Cadres and Civil Servants; Law on Public Employees and related laws.

The Ministry of Finance shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to urgently complete the Policy Document of the Law on Thrift and Waste Prevention (amended) in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Finance, authorized by the Prime Minister, on behalf of the Government, shall sign the Submission to the National Assembly Standing Committee to add this Law project to the National Assembly's 2025 Legislative Program and submit it to the National Assembly for comments and approval at the 10th Session of the 15th National Assembly (October 2025).

The Government assigned Deputy Prime Minister Ho Duc Phoc to direct the drafting of this Law project.

Special control of high-risk food products, misuse, and prohibited substances

Regarding the Policy Profile of the Food Safety Law (amended) , the Government requests the Ministry of Health to amend the Food Safety Law in the direction of applying risk management measures, shifting from pre-inspection to post-inspection for low-risk products. Apply and strongly implement administrative procedures in the electronic environment for food registration and declaration, for high-risk food products, misused products, containing prohibited substances... requiring special control and specific regulations.

The Ministry of Health shall preside over and coordinate with the Ministry of Justice, the Government Office and relevant agencies to urgently complete the Policy Profile of the Law on Food Safety (amended) in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Health, authorized by the Prime Minister, on behalf of the Government, shall sign the Submission to the National Assembly Standing Committee to add this Law project to the National Assembly's 2025 Legislative Program and submit it to the National Assembly for comments and approval at the 10th Session of the 15th National Assembly (October 2025).

The Government assigned Deputy Prime Minister Le Thanh Long to direct the drafting of this Law project.

Standardizing population policy to remove difficulties and obstacles from practice

Regarding the Population Law Policy Profile , the Government basically agrees with the 04 policies proposed by the Ministry of Health. The Ministry of Health fully absorbs the opinions of the Government and Government members to complete the policies to ensure the following requirements: Timely research and supplement to standardize policies to remove difficulties and obstacles from practice; shortcomings and limitations of current regulations on population.

The Ministry of Health coordinates with relevant ministries and branches to research and propose policies to ensure consistency, synchronization, and consistency with the policy content that has been codified in other related Law projects being submitted to the 9th Session of the 15th National Assembly.

The Ministry of Health shall preside over and coordinate with the Government Office and relevant agencies to complete the Population Law Policy Profile in accordance with the provisions of the Law on Promulgation of Legal Documents to submit the draft law to the National Assembly for comments and approval at the 10th Session of the 15th National Assembly (October 2025).

The Government assigned Deputy Prime Minister Le Thanh Long to direct the drafting of this Law project.

Regarding the policy dossier of the Law on Judicial Expertise (amended) , the Government assigned the Ministry of Justice to preside over and coordinate with relevant ministries and agencies to study, absorb and fully explain the opinions of the Government and the opinions of Government members, and complete policies to ensure the requirements: Review and ensure consistency and uniformity with the provisions of the Civil Code, the Penal Code, the Criminal Procedure Code and relevant laws; in accordance with international treaties to which Vietnam is a member; ensure rationality, feasibility and effectiveness.

The Ministry of Justice shall preside over and coordinate with the Government Office, relevant ministries and agencies to complete the Policy Dossier of the Law on Judicial Expertise (amended) in accordance with the provisions of the Law on Promulgation of Legal Documents. The Minister of Justice, authorized by the Prime Minister, shall, on behalf of the Government, sign the Submission to the National Assembly Standing Committee to add this Law project to the National Assembly's 2025 Legislative Program, and submit it to the National Assembly for comments at the 10th Session of the 15th National Assembly (October 2025) according to the simplified procedures.

The Government assigned Deputy Prime Minister Le Thanh Long to direct the drafting of this Law project.

In addition, the Government unanimously approved the content of the guidance on the development and completion of decrees on decentralization, delegation, and division of authority associated with the implementation of the two-level local government organization model submitted by the Ministry of Justice (Report No. 242/BC-BTP dated May 21, 2025 and Official Dispatch No. 2862/BTP-PLHSHC dated May 22, 2025); assigned the Ministry of Justice to continue guiding ministries and ministerial-level agencies in the process of commenting and appraising draft decrees on decentralization, delegation, and division of authority; ensuring the principles of decentralization, delegation, and division of authority in the Law on Organization of the Government, the Law on Organization of Local Government and the direction of competent authorities, ensuring the progress and quality of the documents.

Issuing a national training plan on organizing the operating apparatus of two-level local governments; decentralization, delegation of authority and assignment of authority.

Deputy Prime Minister Nguyen Hoa Binh has just signed Decision No. 1073/QD-TTg dated June 3, 2025 promulgating the National Training Plan on organizing the apparatus of operating two-level local governments; decentralization, delegation of power and assignment of authority.

Pursuant to the Law on Organization of the Government, the Law on Organization of Local Government, Conclusion No. 155-KL/TW dated May 17, 2025 of the Politburo and the Secretariat on a number of key tasks that need to be focused on implementing regarding the organization and arrangement of the apparatus and administrative units from now until June 30, 2025; Conclusion No. 160-KL/TW dated May 31, 2025 of the Politburo and the Secretariat on implementing the task of organizing the apparatus and administrative units, ensuring progress and requirements according to the resolutions and conclusions of the Central Committee, the Politburo and the Secretariat, the Government issued a National Training Plan on the organization and operation of the 2-level local government apparatus; decentralization, delegation of authority and assignment of authority (Plan).

Timely implementation of legal documents on the organization of local government at 2 levels

The purpose and requirements of the Plan are to ensure unified direction of the Politburo, Secretariat, Government, and Prime Minister on the principles of decentralization, delegation of power, and assignment of authority when operating the 2-level local government organization model, ensuring the implementation of the motto: "locality does, locality decides, locality is responsible".

Timely deploy legal documents on the organization of 2-level local government; decentralization, delegation of authority and assignment of authority. At the same time, equip knowledge and skills for cadres and civil servants, especially provincial and commune-level cadres and civil servants (new) after the arrangement on the basic issues of operation of 2-level local government and receiving authority, assignment of functions, tasks, delegation of authority and assignment of authority from the central to local levels.

Ministries and ministerial-level agencies promptly guide and resolve difficulties and problems, make recommendations and propose issues from local practices, ensuring unified, continuous, smooth, uninterrupted and effective operations when organizing the 2-level local government model.

The organization of professional training for cadres and civil servants must ensure substance and effectiveness, focusing on the following basic issues: (i) Organizing the apparatus of operating the local government at two levels; (ii) Decentralization, delegation of power and determination of authority. Clarifying the tasks and authority of the People's Council, People's Committee, Chairman of the People's Committee at the provincial and communal levels and clearly defining for localities the reception of tasks, authority, delegation and delegation of power according to each management area of ​​the central ministries and branches.

Organize nationwide online training on June 14 and 15, 2025

According to the Plan, nationwide online training will be organized at the following locations: Government Headquarters; People's Committees of provinces and centrally run cities and all district and commune level locations within the province or centrally run city.

Duration 1.5 days, starting from Saturday, June 14, 2025 to Sunday, June 15, 2025.

At the Government headquarters, the Prime Minister will chair the training conference.

Participants include: Ministers, Heads of ministerial-level agencies and representatives of relevant units of ministries and ministerial-level agencies decided by the Ministers and Heads of ministerial-level agencies.

At the People's Committees at all levels: Secretaries and Chairmen of People's Committees of provinces and centrally run cities chaired the Conference.

Participants at the provincial level include: Leaders of Party committees, authorities, cadres and civil servants of specialized agencies and equivalents under the Provincial People's Committee; at the district level include leaders of Party committees, authorities, cadres and civil servants of specialized departments and equivalents under the District People's Committee; at the commune level include leaders of Party committees, authorities, cadres and civil servants of commune level.

Implementing organization

The Deputy Prime Minister requested ministries and ministerial-level agencies to: Compile reports on decentralization, delegation of authority and assignment of authority within the scope of sectoral and sectoral management when implementing the 2-level local government organization model; compile forms, administrative decisions, and administrative procedures within the scope of sectoral and sectoral management for localities to apply consistently when operating the 2-level local government organization model. To be completed by June 8, 2025.

Submit all Decrees or draft Decrees on decentralization, delegation of powers and assignment of authority submitted to the Government for timely study and application by localities. Completed by June 8, 2025.

Send additional guidance documents on resolving difficulties, obstacles or transitional tasks in the sector when implementing the arrangement of administrative units at all levels and implementing the 2-level local government model. Completed by June 8, 2025.

The documents for the above training conference are requested to be sent to the Steering Committee for the arrangement of administrative units at all levels and the construction of a 2-level local government organization model of the Government (through the Ministry of Home Affairs) to be completed no later than 5:00 p.m. on June 8, 2025, and at the same time sent to the People's Committees of provinces and cities to serve as documents for the training conference.

Government Office: Print and send copies of documents to 63 provinces and cities to serve the Government's National Conference, to be completed no later than June 9, 2025. Issue invitations to relevant agencies, organizations and units about the Government's National Training Conference.

The People's Committees of provinces and centrally run cities shall prepare the material and technical infrastructure conditions to coordinate the organization of the Government's training conference in their localities. At the same time, print and send copies of documents to delegates attending the conference at all connecting points of the provinces and centrally run cities, to be completed no later than June 10, 2025 to serve the Government's National Conference.

The Government Office has just issued Notice No. 277/TB-VPCP on the conclusion of Permanent Deputy Prime Minister Nguyen Hoa Binh during his working trip to inspect and work on the Investment Project to build Facility 2 of Viet Duc Friendship Hospital and the Investment Project to build Facility 2 of Bach Mai Hospital in Ha Nam province.

Deputy Prime Minister Nguyen Hoa Binh acknowledged the efforts of the Ministries of Health, Construction, Finance, relevant agencies and contractors in implementing Resolution No. 34/NQ-CP dated February 13, 2025 on mechanisms and solutions to handle difficulties and obstacles in the Investment Project to build Facility 2 of Bach Mai Hospital and the Investment Project to build Facility 2 of Viet Duc Friendship Hospital in the past time. The early completion and putting into operation of 2 large-scale, modern hospitals in 2025 to serve the medical examination and treatment needs of the people is an urgent task, requiring urgent focus on rapid deployment, synchronous and effective implementation of solutions, ensuring quality, compliance with legal regulations, and completion on schedule, in the spirit of direction of General Secretary To Lam, of the Government in Resolution No. 34/NQ-CP and direction of the Prime Minister and Deputy Prime Minister; Do not let the situation of delay, project degradation continue, causing huge waste, the Ministry of Health is responsible.

The continued implementation of the 2 Projects must ensure quality, progress, compliance with Party and State regulations, prevent corruption, negativity, waste, and absolutely not allow new violations.

From now until the end of 2025, there are only more than 06 months left, which is a very short period of time to complete and put the 02 Hospitals into use. Relevant ministries and agencies are requested to promote the highest responsibility, proactively and urgently focus on implementing the tasks and solutions set out; in which, pay attention to some key tasks.

Urgently complete procedures to accept payment to contractors for completed work.

The Deputy Prime Minister assigned the Ministry of Health to focus on directing contractors to have sufficient resources and human resources to ensure quality and construction progress; closely coordinate and create favorable conditions for contractors to perform at the construction site; promptly complete procedures to accept and pay contractors for completed work; arrange sufficient human resources to supervise and prepare conditions for project acceptance to create favorable conditions for contractors with resources to continue implementing the project, ensuring progress.

Improve the capacity and enhance the responsibility of the Medical Construction Project Management Board (PMU); urgently consolidate and perfect the organization and apparatus, pay attention to immediately adding high-quality human resources to the PMU, in which priority is given to adding human resources from 02 Hospitals to soon participate in the Project implementation process, ensuring convenience for operation and putting into use later.

Regarding the procurement of medical equipment: First, use up all the allocated budget for purchasing medical equipment, promptly organize procurement bidding, select the most modern and best equipment suitable for professional needs, ensure compliance with regulations, and prevent further violations and negativity.

Proactively recruit and immediately train a team of doctors and medical staff

The Deputy Prime Minister requested Bach Mai Hospital and Viet Duc Friendship Hospital to closely coordinate with the Project Management Board and relevant units of the Ministry of Health during the construction process at the site, preparation and procurement of medical equipment; increase human resources for the Project Management Board from the two hospitals, especially high-quality human resources to meet the requirements on progress and quality.

Regarding the human resources working at Facility 2, in order for the 2 Hospitals to operate effectively immediately after the 2 Projects complete the construction part, ensuring the quality of medical services at Facility 2 is equivalent to the quality of medical services at Facility 1: Proactively recruit and immediately train a team of doctors and medical staff, prioritizing human resources from Ha Nam province and neighboring areas. Prepare plans and arrangements to arrange and rotate doctors and medical staff with high professional qualifications and skills to work at Facility 2 immediately after the 2 Projects are completed and put into operation, taking care not to affect the quality of human resources at local medical facilities.

In case of needing additional funding for training of doctors and medical staff working at Facility 2 of 02 Hospitals: The two hospitals shall proactively make plans and submit to the Ministry of Health to arrange funding for training according to their authority or report to competent authorities in cases exceeding their authority.

In case of need for additional funding to purchase medical equipment after completing 02 Projects: 2 Hospitals prepare projects and submit them to the Ministry of Health to report to competent authorities according to regulations.

Prioritize handling tasks and work related to 02 Projects

Ministries and agencies: Health, Finance, Construction, Government Office, according to their assigned functions and tasks, must prioritize handling tasks and work related to the 02 Projects; in case the dossier is incomplete, the ministries and agencies are responsible for providing full guidance or organizing meetings and direct exchanges, not allowing documents to be sent back and forth many times; promptly report to competent authorities in cases beyond their authority.

The People's Committee of Ha Nam province continues to closely coordinate with the Ministry of Health, the Project Management Board, and relevant agencies to support the implementation of necessary tasks and work to ensure that after the completion of the two projects, they will be put into convenient and effective use; at the same time, urgently build housing for the team of doctors and medical staff working at Facility 2 of the two hospitals.

Contractors: Need to focus highly, continue to prioritize the arrangement of enough human resources to work at the construction site to ensure the completion of construction work according to plan; do not let the current situation of the number of human resources at the construction site not meeting the progress continue.

The Government Inspectorate, the Ministry of Public Security and relevant agencies, in the process of performing related tasks, in addition to handling violations in accordance with legal regulations, need to individualize responsibilities, and at the same time provide maximum support for the Ministry of Health to focus on performing tasks and work and completing 02 Projects according to Resolution No. 34/NQ-CP in the spirit of the Politburo's direction to focus on overcoming and removing difficulties and bottlenecks, prioritizing the application of civil, economic and administrative measures first, allowing proactively overcoming violations and damages.

The Government Office has just issued Notice No. 276/TB-VPCP dated June 3, 2025, concluding the conclusion of Deputy Prime Minister Bui Thanh Son at the 5th meeting of the State Steering Committee for important national programs, works and projects, key to the energy sector.

Deputy Prime Minister Bui Thanh Son, Head of the State Steering Committee for important national programs, works and projects in the energy sector (Steering Committee), highly appreciated and welcomed the People's Committee of Soc Trang province and the Ministry of Industry and Trade for proactively and actively implementing and completing a number of assigned tasks on time; at the same time, he also requested ministries and agencies to seriously learn from their experiences in delaying the implementation of assigned tasks such as: delay in issuing the Plan to implement the adjustment of the VIII Power Plan; delay in handing over the construction site to clear the capacity of Nhon Trach 3 and Nhon Trach 4 thermal power plants; delay in implementing the Lot B - O Mon Gas - Power Chain project, Blue Whale Gas - Power Chain project, Long Phu I project, etc.

The above situation shows that the Steering Committee needs to be more drastic, have solutions to urge more regularly and closely; the standing agency must make more efforts, be more drastic, more timely, and propose more specific and effective solutions; the member agencies of the Steering Committee, especially the Corporations, General Corporations, and project investors must work faster, more effectively and with better quality; proactively remove difficulties for projects, focus resources on implementation and completion, and put projects into operation and exploitation early, especially when the Adjustment of Power Plan VIII has been issued.

Submit to the Prime Minister the plan to complete the Steering Committee before June 10, 2025

Regarding tasks and solutions in the coming time, the Deputy Prime Minister requested the Ministry of Industry and Trade to urgently submit to the Prime Minister the completion of the State Steering Committee for important national programs, works and projects, key to the energy sector before June 10, 2025, in which it is required to clearly state the names of the Steering Committee members to fully and consistently participate in the activities of the Steering Committee.

The Ministry of Industry and Trade reviews and proposes to amend the Working Regulations of the Steering Committee in the direction of holding regular meetings every 3 months to promptly direct the handling of problems for projects; at the same time, the Minister of Industry and Trade, Permanent Deputy Head of the Steering Committee, proactively inspects and urges to promote the early implementation of slow-progressing projects, meeting the needs of socio-economic development and serving people's lives.

Ministries, branches, and provincial People's Committees shall proactively handle, within their authority, difficulties and problems arising related to the state management functions of ministries, branches, and localities during the implementation of projects, proactively remove difficulties, and speed up project progress. Report to the Government and the Prime Minister on issues beyond their authority.

Urgently issue the Implementation Plan for Adjusting Power Planning VIII before June 15, 2025

The Ministry of Industry and Trade is responsible for urgently issuing the Plan for implementing the Adjustment of the VIII Power Plan, to be completed before June 15, 2025, without delaying the implementation of the plan approved by the Prime Minister; presiding over and closely coordinating with ministries, branches, agencies and localities to effectively implement the Adjustment of the VIII Power Plan.

Urgently issue a Circular amending Circular No. 16/2025/TT-BCT dated February 1, 2025 on regulations on the operation of the competitive electricity trading market, in which it is noted to clearly stipulate the "maximum" mobilization according to the gas supply capacity of domestic natural gas power projects to implement the policy of "prioritizing the development" of domestic natural gas power as directed by the Prime Minister.

The Ministry of Industry and Trade urgently directs localities to: Immediately deploy the selection of investors for power source projects in the Adjusted Power Plan VIII that do not have investors such as: Nghi Son LNG, Ca Na LNG to be completed in June 2025, Quynh Lap LNG to be completed in the third quarter of 2025; accelerate investment progress to complete no later than the third quarter of 2028 according to the direction of the Prime Minister in Directive No. 01/CT-TTg dated February 3, 2025.

Direct investors of power source projects expected to be completed and put into operation in 2026 - 2030, including projects under construction (such as: Quang Trach I, Long Phu I, Hiep Phuoc phase 1) and projects that have selected investors and are preparing Feasibility Study Reports (such as: LNG Quang Ninh, LNG Thai Binh, Quang Trach II, Hai Lang phase 1, BOT Son My I, BOT Son My II, Bac Lieu, Long An I, O Mon II, III, IV...) to urgently complete procedures to start construction, speed up project progress, commit to specific operation time, strive to complete and put into operation 1-2 years earlier than planned, according to the direction of the Prime Minister in Directive No. 01/CT-TTg dated February 3, 2025.

Oil and gas and power projects of Vietnam National Energy Industry Group

The Deputy Prime Minister assigned the Minister of Industry and Trade, Deputy Head of the Steering Committee to chair regular and monthly meetings with the Vietnam National Energy and Industry Group to urge and promptly remove difficulties and obstacles, promote the implementation of projects, ensure quality and operation progress according to the approved Adjustment of Power Plan VIII; every 3 months, summarize and report to the Head of the Steering Committee to chair meetings to resolve issues beyond his authority (if any).

Block B - O Mon gas and power project chain: PVN needs to focus on implementing more drastically, speeding up the project progress, in which the work needs to be completed specifically and earlier such as: drilling and completion of wells for field development, bidding must be completed in June 2025; completing the selection of contractors for O Mon IV plant before June 5, 2025; completing appraisal and approval of FS for O Mon III plant project before June 15, 2025.

Blue Whale gas-power project chain: PVN needs to focus on working with Exxon Mobile to agree on a plan to completely resolve the development of the gas field exploitation project, and report the results to the Prime Minister in June 2025.

Power source and transmission projects of Vietnam Electricity Group

Regarding the Quang Trach I and Quang Trach II Thermal Power Plant projects: The People's Committee of Quang Binh province urgently resolves difficulties and obstacles in compensation and site clearance, and hands over the entire site (coal import port area of ​​Quang Trach I plant; site of Quang Trach II plant) to the Investor before June 15, 2025 for construction implementation.

EVN speeds up the implementation progress, ensuring the grid connection of Unit 1 of Quang Trach I Thermal Power Plant on September 2, 2025 in accordance with the direction of the Prime Minister.

Strive to complete procedures and start construction of Quang Trach II Thermal Power Plant on December 19, 2025./.
