
The Government abolished all 8 decrees.
According to the Ministry of Justice , in recent times, a number of ministries and ministerial-level agencies have reviewed and discovered a number of legal documents that are no longer applied in practice, but there is no legal basis to determine their expiration according to the provisions of the Laws on Promulgation of Legal Documents (1996, 2008, 2015 and the Laws amending and supplementing a number of articles of the Law on Promulgation of Legal Documents). The Ministry of Justice has proposed to develop a Decree regulating the total or partial abolition of 10 decrees in many areas of state management of ministries and branches, in order to avoid confusion and difficulties in searching.
On that basis, the Government issued Decree 285/2025/ND-CP abolishing a number of Government decrees that are no longer applied in practice, not prescribing new policies or amending or supplementing existing policies in documents, thus not creating additional human and financial resources in implementing and enforcing the Decree after it is issued by the Government.
Abolish all 8 decrees
Specifically, Decree No. 285/2025/ND-CP abolishes the following 8 decrees:
1. Decree No. 35/2005/ND-CP dated March 17, 2005 of the Government on disciplinary action against officials and civil servants.
2. Decree No. 105/2006/ND-CP dated September 22, 2006 of the Government detailing and guiding the implementation of a number of articles of the Law on Intellectual Property on the protection of intellectual property rights and state management of intellectual property.
3. Decree No. 35/2007/ND-CP dated March 8, 2007 of the Government on electronic transactions in banking activities.
4. Decree No. 27/2010/ND-CP dated March 24, 2010 of the Government regulating the mobilization of other police forces and communal police to coordinate with the road traffic police to participate in patrolling and controlling road traffic order and safety when necessary.
5. Decree No. 119/2010/ND-CP dated December 30, 2010 of the Government amending and supplementing a number of articles of Decree No. 105/2006/ND-CP dated September 22, 2006 of the Government detailing and guiding the implementation of a number of articles of the Law on Intellectual Property on the protection of intellectual property rights and state management of intellectual property.
6. Decree No. 137/2013/ND-CP dated October 21, 2013 of the Government detailing the implementation of a number of articles of the Electricity Law and the Law amending and supplementing a number of articles of the Electricity Law.
7. Decree No. 04/2015/ND-CP dated January 9, 2015 of the Government on implementing democracy in the activities of state administrative agencies and public service units.
8. Decree No. 63/2020/ND-CP dated June 8, 2020 of the Government regulating the security industry.
2 decrees were partially abolished
In addition, Decree 285/2025/ND-CP also partially abolishes the following two decrees:
Abolish Clause 1, Article 12 of Decree No. 65/2017/ND-CP dated May 19, 2017 of the Government on specific policies on breeds, capital and technology in the development of cultivation and exploitation of medicinal herbs.
Abolish Chapter III of Decree No. 08/2018/ND-CP dated January 15, 2018 of the Government amending a number of Decrees related to investment and business conditions under the state management of the Ministry of Industry and Trade .
This Decree comes into force from December 30, 2025.
