The Directive aims to enhance the effectiveness of state management, mobilize the entire political system to resolutely fight against smuggling, trade fraud, counterfeit goods and intellectual property infringement. The goal is to protect the rights of people and businesses, ensure security and public health, and create a stable environment for socio-economic development. This work is identified as a long-term task, requiring the synchronous participation of Party committees, authorities, the Fatherland Front, businesses and the people. Functional forces are required to coordinate closely, strictly handle violations, step up propaganda, and avoid causing trouble for people and businesses.
Accordingly, the Chairman of the City People's Committee requested all levels, sectors, agencies and units in the city to seriously implement the directions of the Prime Minister , the National Steering Committee 389, and the City People's Committee on launching a peak period to combat, prevent and repel smuggling, trade fraud, counterfeit goods and intellectual property infringement; proactively direct the organization of forces and means, and have appropriate solutions to effectively carry out the task of combating smuggling, trade fraud, counterfeit goods and intellectual property infringement in the fields and areas under management. Clearly identify key subjects and items to focus on the fight with the motto "no forbidden areas, no exceptions"; improve management capacity, define responsibilities, functions and tasks, avoid overlapping or missing tasks, and leave no gaps in state management...
Propose that the Vietnam Fatherland Front Committee of the city and its member organizations closely coordinate with Departments, Boards, sectors, and local authorities to mobilize union members, association members, and people to build a mass movement to fight against smuggling, trade fraud, counterfeit goods, and intellectual property rights infringement.
The city police directed forces to establish special projects, fight fiercely, and strictly handle criminal acts; coordinate with prosecution agencies to speed up the investigation, prosecution, and trial of cases; clarify the responsibilities of related organizations and individuals, report, and propose handling according to regulations; promptly publicize the results on mass media for general deterrence and prevention.
The City Military Command directed its subordinate units to step up propaganda and mobilize officers and soldiers in the force to raise political awareness, identify roles and responsibilities in the fight against smuggling, trade fraud and counterfeit goods in the area; coordinate with functional forces to handle subjects and means of violation under the management of military units. Organize to review and rectify the management and use of warehouses and factories on national defense land, not to allow the situation of taking advantage of military facilities to hide, store smuggled goods, prohibited goods, and illegally produce and trade.
The Border Guard Command and the 38th Fleet shall concentrate their forces, strengthen the work of collecting information, grasp the situation, patrol and strictly control the maritime border areas and sea areas; proactively develop and deploy plans to increase forces, means and professional measures to combat, prevent and destroy, not to allow the formation of warehouses, gathering places, and storage of smuggled goods, and acts of illegal trading and transportation of goods; preside over and coordinate with functional forces to develop plans, strengthen patrol and control forces at key routes that are often exploited by subjects to smuggle, trade, store, transport prohibited goods, illegally carry and transport goods; step up propaganda and mobilize people to strictly comply with the provisions of the law, not to participate in, assist and actively fight and denounce crimes, acts of smuggling and illegal transportation of goods across the maritime border. Proactively advise and propose timely solutions to overcome loopholes and shortcomings in the fight against smuggling, trade fraud and counterfeit goods.
The Coast Guard Region Command directs the force to deploy plans to increase patrols, inspections, controls, grasp the situation, detect, combat, and promptly handle acts of smuggling and illegal transportation of goods in the sea areas. Proactively coordinate with functional forces and local authorities to closely control the situation at sea, combat, and promptly and effectively prevent smuggling, trading, and illegal transportation of goods in the sea areas.
The Department of Industry and Trade directs the Market Management force to strengthen inspection, control, and strictly handle cases of smuggling, production, and trade of counterfeit goods, poor quality goods, intellectual property rights infringement, and goods of unknown origin, especially violations in the cyberspace environment. Strengthen inspection and review of production and business establishments in the city, focusing on essential goods, goods that are prone to violations under the management scope; business activities on the internet platform. Proactively or coordinate with the Departments of Health, Agriculture and Rural Development, Natural Resources and Environment, and Science and Technology in post-inspection of goods quality.
The Department of Science and Technology shall strengthen inspection and review of establishments under its management functions and tasks; the situation of production, business, and circulation of goods in the area related to quality, technical standards, measurement, and intellectual property. Focus on essential goods and products at high risk of counterfeiting and intellectual property infringement; inspect and appraise the quality of products and goods when there are signs of violations, promptly provide inspection and appraisal results to serve the investigation and handling of violations.
The Department of Health strengthens inspection and review of facilities under its management functions and tasks; the situation of compliance with food hygiene and safety, especially in industrial zones/clusters, schools, restaurants, collective kitchens... Strengthen inspection, examination, and strict handling of the trading and trading of counterfeit drugs, smuggled drugs, and fake pharmaceuticals; do not allow counterfeit drugs, smuggled drugs, cosmetics, and functional foods of unknown origin and origin in the city; resolutely fight and repel, and end the situation of counterfeit drugs, considering the care and protection of people's health as the top priority. Focus on appraisal, testing, and post-inspection; coordinate the appraisal of samples of goods suspected of being counterfeit or poor quality goods under its management.
The Department of Agriculture and Rural Development strengthens inspection and strictly handles violations related to forestry, aquatic products, production and trade of fake plant varieties, livestock, fertilizers and pesticides; controls the use of stimulants and chemicals; quarantines fruits, beverages, foods, livestock and poultry, ensuring quality and food safety, not affecting people's health. Focuses on appraisal, testing and post-inspection; coordinates in taking samples for appraisal of goods suspected of being counterfeit or poor quality goods under its management.
The Department of Culture and Sports shall strengthen the inspection and supervision of advertising, display and introduction of products and goods in the area, especially on media, social networks, fairs and trade exhibitions, to ensure compliance with legal regulations; proactively monitor, detect and strictly handle acts of false advertising, especially on social networks.
The Department of Finance shall preside over and work with relevant agencies and units to advise and propose to the City People's Committee to direct the implementation of contents related to price, fee, charge, tax, and budget management in the work of preventing and combating smuggling, trade fraud, counterfeit goods, and intellectual property infringement. Coordinate with functional forces in inspecting and handling organizations and individuals who commit acts of fraud in prices, invoices, and payment documents to evade taxes and legalize smuggled and counterfeit goods.
The Department of Justice advises on the completion and guidance on the application of legal documents and regulations related to the prevention and combat of smuggling, trade fraud and counterfeit goods; supports the dissemination of laws to units, organizations and individuals.
The Department of Construction strengthens the inspection and control of construction materials and fuels; focuses on appraisal, testing, and post-inspection. Coordinates the appraisal of suspected counterfeit and poor quality goods. Directs strict control of freight transport activities on roads, railways, and waterways to detect and prevent illegal goods in circulation and at stations, bus stations, wharves, and assembly locations.
The Department of Education and Training inspects kitchens at educational institutions; directs functional departments to closely inspect and monitor food sources used in educational institutions in the city, not to miss any fake foods that affect the health of students and teachers.
The Hai Phong Economic Zone Management Board inspects kitchens in industrial parks; directs businesses to closely inspect and monitor food sources used in processing industrial meals to serve workers and laborers in companies and businesses in industrial parks in the city.
District People's Committees shall strengthen the management of areas and markets, grasp the situation, subjects, methods and tricks of smuggling, trade fraud, counterfeit goods and intellectual property infringement; proactively coordinate with functional forces to develop plans to inspect and control key routes, areas and sectors. Proactively organize interdisciplinary or specialized inspection teams, conduct surprise inspections of hotspots and key areas of smuggling, trade fraud, counterfeit goods and intellectual property infringement. Promote the sense of responsibility of heads of agencies, units and localities in the fight against smuggling, trade fraud and counterfeit goods.
The Regional Customs Branch III has measures to detect, promptly prevent, investigate and handle acts of smuggling, trade fraud, counterfeit goods and intellectual property infringement in import and export activities. Closely inspect and monitor goods in transit, port transfer, temporary import and re-export, especially shipments of consumer goods, groceries and goods at risk of smuggling and recirculation into the city. Strengthen and improve the quality of post-inspection and post-clearance inspection, promptly detect and handle cases of taking advantage of the open policy on customs control and clearance for smuggling and trade fraud.
The Tax Department of Region III strengthens inspection and review of high-risk establishments related to counterfeit goods, goods of unknown origin... to promptly detect signs of violations regarding invoices, documents, tax evasion, tax fraud and origin of goods. Strengthen tax inspection and examination, promptly detect and handle violations and fraud in tax declaration and payment; on management and use of invoices to prevent, detect and handle cases of using invoices to legalize the origin of smuggled goods. Strengthen tax management for business activities on social networking platforms.
Press agencies in the city should increase propaganda to raise public awareness in the fight against smuggling, trade fraud, counterfeit goods, implementation methods, skills to identify and distinguish infringing goods; closely coordinate with functional agencies to report official news, orient public opinion, avoid spreading false information, causing confusion among the people.
In recent times, the city's departments, branches, localities and functional forces have made efforts to combat smuggling, trade fraud, counterfeit goods, and intellectual property infringement, achieving many positive results. Many cases, lines and groups of violations have been detected and strictly handled. However, the situation is still complicated with an increasingly large scale, affecting production and business, health, people's trust and social order and safety. The main reason is that the direction in some places is still not drastic and not close to reality; coordination and information sharing between units are still limited; forecasting and consulting are not timely; violations are increasingly sophisticated, especially in cyberspace. In addition, propaganda is still weak, the law is still inadequate, creating loopholes for subjects to take advantage of violations.
