The Ho Chi Minh City Inspectorate has just issued a notice of inspection conclusion on the implementation of the An Phu - An Khanh Urban Area project (Thu Duc City) invested by the Housing Development and Trading Joint Stock Company. The inspection agency has pointed out a series of violations related to this project from the time of land allocation until now.
Legally, the project increased the land area, changing the boundary compared to the Prime Minister 's decision in 1999. In 2005, the Prime Minister allowed the project to adjust the area.

However, up to now, the investor has not yet completed the legal procedures on land allocation boundaries, and has not been specifically measured and calculated by specialized agencies to fulfill financial obligations as prescribed.
In the preparation and approval of the 1/2000 detailed plan, the Chief Architect of the city at that time approved an increase in the project land area compared to the land allocation decision but did not ask for the Prime Minister's opinion. The project was also pointed out for violations related to the preparation and adjustment of the 1/500 detailed plan and the adjustment of the 1/2000 zoning plan.
Regarding compensation and resettlement support, the Housing Development and Trading Joint Stock Company agreed on compensation for some cases but did not coordinate or provide information to the Thu Duc City Compensation and Site Clearance Board for inspection, comparison, and supplementation, causing data discrepancies.

During the project implementation period, the Department of Construction in 2008 approved the project to build two apartment buildings here which did not comply with regulations. The Department of Natural Resources and Environment of the city is also responsible for issuing certificates for a part of the project area when the investor had not yet fulfilled its financial obligations.
In addition, the project investor has bought and sold a part of the land in area C of the project for the wrong purpose. Previously, this area was approved as a place to arrange resettlement land and exchange agricultural land. This has led to a shortage of land for resettlement of households whose land has been recovered.
During the inspection period, the inspection team received 8 petitions from people related to the transfer of house land at this investor's project from 1998 and 2000.
From the conclusion of the City Inspectorate, the Chairman of the Ho Chi Minh City People's Committee assigned the Directors of the Departments of Planning - Architecture, Natural Resources and Environment, Construction, and the Chairman of the Thu Duc City People's Committee to urgently rectify and overcome violations and shortcomings, direct the organization of inspections, determine the level of violations to handle responsibilities for organizations and individuals related to the violations and shortcomings mentioned.
The Ho Chi Minh City Inspectorate needs to transfer the case file on the illegal acts of the Housing Development and Trading Joint Stock Company in transferring land use rights for the land lots to the Ho Chi Minh City Police Investigation Agency for further investigation, clarification and handling according to regulations.
