Ensure maximum rights and legitimate interests for people with disabilities

In the 2021-2025 period, the Thai Nguyen Provincial Justice Sector has completed the strategic goal of ensuring that 100% of people with disabilities (PWDs) facing financial difficulties, when requested, have access to free and quality legal services in a timely manner, in accordance with the provisions of the Law on Legal Aid (LLA). TGPL activities are assessed to be of good quality, ensuring maximum rights and legitimate interests for PWDs. The process of implementing the cases has received satisfaction from the assisted people, without any complaints or denunciations.

Mr. Pham Quoc Trung, Deputy Director of the Department of Justice, shared: Implementing the legal aid program for people with disabilities in the period of 2021-2025, as a member of the working group on people with disabilities of the province, over the past 5 years, the Department of Justice has deployed key activities such as: Disseminating and thoroughly grasping the Party's guidelines and policies and the State's laws related to people with disabilities within the scope of assigned functions and tasks; regularly directing the Provincial State Legal Aid Center to develop an action plan, ensuring timeliness and suitability with the practical situation; assigning specialized staff to directly monitor and urge the implementation of legal aid activities for people with disabilities. Along with that, it is necessary to strengthen the coordination mechanism with departments, branches, unions, district and commune People's Committees and associations of people with disabilities to organize communication and legal advice activities, ensuring wide coverage.

Realizing that this is an important task to protect the legitimate rights and interests of vulnerable groups, the Department has synchronously deployed many solutions, creating a solid foundation for effective policy implementation. Timely and systematic direction and management have created an important premise, helping affiliated units, especially the State Legal Aid Center, effectively implement the goals and tasks of the program.

Mr. Vu Van Chinh, Director of the State Legal Aid Center No. 1 - Thai Nguyen province, said: 135 cases have been implemented effectively and flexibly, including: Legal advice for 58 cases, participation in litigation for 75 cases; representation outside of litigation for 2 cases are the numbers that have been successfully handled and implemented by the Center.

To achieve the above results, communication work was identified by the Justice sector as a breakthrough solution to improve awareness and access to legal aid for people with disabilities. Promoting communication and strengthening coordination with commune-level authorities has helped proactively detect and promptly inform about cases of people with disabilities in need of legal aid, ensuring that no one is left behind.

511 communication points on legal aid directly at the grassroots level with over 18,000 people listening; compiling, publishing and providing documents and legal leaflets on legal aid policies to help people with disabilities easily find information; equipping information boards and legal leaflets for prosecution agencies, detention facilities, associations of people with disabilities and social protection facilities to ensure that information is disseminated to the right audience. These are proofs of the industry's communication work over the past 5 years.

In addition, the Justice sector has effectively utilized digital media channels such as the province's Fanpage and Electronic Information Page for popularizing and educating the law to post short, easy-to-understand news and articles, helping people with disabilities and their families easily grasp the policies. These activities have significantly contributed to helping people with disabilities understand their rights to free legal aid, the procedures for requesting support; thereby proactively resolving legal problems in life.

The sector always directs the Provincial State Legal Aid Center to increase exchange activities and experiences, not only in professional knowledge but also in skills in providing legal aid to people with disabilities. In the past 5 years, 265 officials have been trained and fostered, contributing to improving the quality of legal aid services in the province. Coordination with prosecution agencies and local authorities has also been strengthened.

It can be affirmed that the legal aid program for people with disabilities in the 2021-2025 period has been seriously implemented, bringing practical values, contributing significantly to the common goal of building a fair, barrier-free society, where people with disabilities are respected and participate equally in social activities.

TGPL work has become an effective tool, supporting PWDs to promote their abilities, confidently rise up, participate equally in socio-economic activities, and contribute to common development.

Many litigation cases have been recorded as successful when the defense and protection views of the legal aid practitioners were accepted by the litigation agencies, bringing direct and legitimate benefits to the disabled.

Despite the above positive results, the implementation of the program still reveals some shortcomings that need to be seriously recognized and objectively evaluated to find solutions in the coming time. These include: A group of PWDs, especially PWDs in rural and mountainous areas, still lack legal knowledge, have inferiority complex, and are afraid to contact, making them not proactive in sharing and requesting legal aid in a timely manner, leading to the person assigned to provide legal aid being unable to provide the best support to protect their rights.

Financial and human resources are limited, making it difficult to organize specialized legal aid activities. Coordination between the Legal Aid Center and relevant agencies and organizations is sometimes not timely and tight, limiting the ability to detect legal aid needs at the grassroots level.

Based on a comprehensive assessment of the legal aid program for people with disabilities in the 2021-2025 period, in the 2026-2030 period, the Justice sector has identified key directions and tasks, which are: Continuing to improve the quality and effectiveness of legal aid activities, ensuring that people with disabilities in the province have access to legal services in the most convenient, equal and effective way.

Along with that is strengthening connection and coordination of activities at the grassroots level, further tightening the coordination relationship between the State Legal Aid Center with the People's Committees at the commune level, associations of the disabled, social protection facilities of the province, schools, units, businesses, and media agencies to build a solid network to proactively detect and inform about legal aid needs.

At the same time, we focus on improving the professional capacity of the legal aid implementation team, training and coaching staff not only in professional skills and legal knowledge but also in essential soft skills such as understanding psychology and communication skills, ensuring the most professional, timely and effective service provision.
