The land plots must have the same duration and purpose of use.

Mr. Nguyen Thanh Nhiem's family ( Lam Dong ) is having trouble merging adjacent plots of land with different land use terms. Plot No. 10, map sheet No. 5, land use term until July 1, 2058, land use purpose: CLN; Plot No. 11, map sheet No. 5, land use term until July 1, 2064, land use purpose: CLN.

Mr. Nhiem requested the competent authority to guide his family to carry out land consolidation.

The Ministry of Agriculture and Environment responded to this issue as follows:

The content of your reflection is a specific case under the jurisdiction of the locality and needs to be based on the archived records and specific regulations issued by the locality under its authority to implement the Land Law for consideration and resolution; therefore, the Ministry has no basis to respond. The Ministry would like to state some principles as follows:

Article 220 of the Land Law stipulates the conditions and principles of land consolidation. Accordingly, at Point b, Clause 3 stipulates:

"b) In case of land plots with different land use purposes, land use periods, and land rent payment methods, it is necessary to carry out the procedures for changing land use purposes, adjusting land use periods, and changing land rent payment methods at the same time to unify according to one purpose, one land use period, and one land rent payment method according to the provisions of law".

For the case of adjusting the land use term of an investment project as prescribed in Section III, Part VII, Appendix I issued with Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the division of authority of local authorities at 02 levels, decentralization and decentralization in the field of land.

In case of adjusting other land use terms, the Ministry of Agriculture and Environment will review, research and advise competent authorities in the process of drafting legal documents.
