Mr. Ha Anh Duc - Director of the Department of Medical Examination and Treatment Management ( Ministry of Health ) said that after more than a year of implementation, some contents in the Decree and Circular 32/2023 have revealed many shortcomings and need to be revised and supplemented. A notable point in the Draft Amendment to Decree 96/2023 is the proposal to adjust the regulations on the authority to determine prices for medical examination and treatment services.

Currently, provincial People's Councils are assigned to regulate specific prices for medical examination and treatment services in cases where the Ministry of Health has not yet issued prices, or for services performed by local facilities but not under the system of the Ministry of Health or central ministries and branches.

According to this Draft, the Ministry of Health prescribes specific prices for medical examination and treatment services on the list paid by the health insurance fund and the state budget, as well as services not on the list paid by health insurance but not on-demand services, applicable to facilities under the Ministry of Health.

For facilities under other ministries and sectors, the draft clearly states that medical examination and treatment prices must not exceed the level prescribed by the Ministry of Health. Provincial People's Councils continue to determine service prices for local state facilities if the Ministry of Health has not yet issued regulations, or in cases where the service is not performed by facilities under the Ministry of Health but the locality has a need to provide it.

The draft also stipulates that the competent authority will price services in the health insurance list according to the technical expertise of the medical facility. Medical examination and treatment facilities must develop a price plan if they propose to price services, based on the technical hierarchy and the health insurance payment list.

Previously, at the workshop to collect opinions on amending Decree 96/2023 guiding the implementation of the Law on Medical Examination and Treatment, Mr. Duc said that on January 9, 2023, the 15th National Assembly issued Law No. 15/2023/QH15 on Medical Examination and Treatment, effective from January 1, 2024.

Based on the Law on Medical Examination and Treatment, on December 30, 2023, the Government issued Decree No. 96/2023/ND-CP detailing a number of articles of the Law on Medical Examination and Treatment; on December 31, 2023, the Ministry of Health issued Circular No. 32/2023/TT-BYT detailing a number of articles of the Law on Medical Examination and Treatment. However, in the process of implementing the decree and circular, some shortcomings arose that needed to be adjusted and amended.

The drafting committee expects that in June 2025, the new draft Decree replacing Decree No. 96/2023/ND-CP will be submitted to the Government for promulgation, helping units implement the Law on Medical Examination and Treatment and the Decree and Circular effectively, with quality, and in accordance with Central regulations./.
