Speaking with the People's Representative Newspaper, Vice Chairwoman of the Law and Justice Committee NGUYEN THI MAI PHUONG said that the legislative work in recent times has fully, correctly and promptly institutionalized the Party's policies and guidelines; there have been many innovations in methods, thinking and legislative processes, promoting the role of "being one step ahead in terms of institutions", affirming the important role of the National Assembly in perfecting institutions and laws, originating from the overall interests of the country.
Promoting the role of " being one step ahead in terms of institutions ", being flexible and responding promptly to new, difficult, and complex situations that arise in practice
- Could you please tell us the purpose and significance of the first time the National Assembly Standing Committee organized the Law-making Forum?
- The organization of the first Law-making Forum in the context of the whole country striving to compete to achieve achievements to welcome the 14th National Party Congress; towards the 80th anniversary of the first General Election to elect the National Assembly of Vietnam; The 10th Session of the 15th National Assembly has gone halfway and is focusing highly on completing a huge amount of legislative work, is of great significance in continuing to perfect the institutions to meet the requirements of national development in the new era - the era of development, prosperity and strength.
The first Law-making Forum is an important event of the National Assembly to exchange, discuss and comprehensively evaluate the law-making work from the beginning of the term of the 15th National Assembly to the present, focusing on the implementation of innovation in thinking and orientation of law-making, evaluating outstanding results in the legislative work of the National Assembly, drawing lessons and good practices to continue promoting and expanding, at the same time assessing the limitations and points that need to be further improved, summarizing theory and practice to propose solutions to continue improving the effectiveness of the National Assembly's legislative activities, contributing to perfecting the institution so that the institution is truly a competitive advantage, an institution that creates rapid and sustainable development.
- The 15th National Assembly term took place in the context of the country and the world facing the Covid-19 pandemic, along with many complex international fluctuations and natural disasters causing serious consequences. In that context, under the leadership of the Party, the National Assembly has accompanied the Government and agencies and organizations in the political system to issue many important and unprecedented policies, flexibly and effectively responding to the situation, in the spirit of "being one step ahead in terms of institutions". Could you please tell us about some outstanding results in the constitutional and legislative activities of the National Assembly this term?
- The 15th National Assembly is a special term, operating in a context of facing many difficulties and challenges, complex global pandemics, natural disasters, severe climate change, and unpredictable fluctuations in the world political and economic situation. In that situation, the National Assembly has always affirmed its role as the highest state power organ, the highest representative body of the People, achieving many great achievements in legislative work, reflected in the following 5 key contents:
Firstly , the National Assembly amended and supplemented a number of articles of the 2013 Constitution with 100% of the delegates present voting in favor, vividly demonstrating the National Assembly's timely institutionalization of the Party's correct policy on reorganizing the state apparatus in the direction of " streamlining, efficiency, effectiveness, efficiency, close to the people, close to the people, close to reality ", demonstrating high consensus and unity between " the Party's will and the people's heart ".
Second , for the first time, the National Assembly has developed and submitted to the Politburo for consideration and approval the Orientation of the Law-making Program for the entire term of the National Assembly, which is an important basis for agencies to proactively implement early, closely coordinate to ensure the progress and quality of projects submitted to the National Assembly; promptly amend the Law on Promulgation of Legal Documents and issue Resolution No. 197/2025/QH15 on a number of special mechanisms and policies to create breakthroughs in law-making and law enforcement to institutionalize the Party's policy on innovation orientation, perfecting the law-making process, innovating the work of law-making and law enforcement, meeting the requirements of national development in the new era.
Third , the National Assembly has considered and passed a very large number of laws and resolutions (by the end of the 9th Session, the National Assembly had passed 99 laws and 41 legal resolutions, and the total number of laws and resolutions expected to be passed during the 15th National Assembly term is 148 laws and 45 legal resolutions, double that of the previous term) , with many historic decisions to promptly remove difficulties and obstacles, and promote socio-economic development.
In particular, at the last four sessions of the term, the National Assembly's law-making work has demonstrated more clearly and deeply the spirit of innovation in law-making thinking. The draft laws passed by the National Assembly are guaranteed to be concise and clear, only regulating issues under the authority of the National Assembly, giving the Government proactive and flexible authority in the process of organizing law implementation; reforming administrative procedures, promoting decentralization and delegation of power.
Fourth, the National Assembly has promoted its role of " being one step ahead in terms of institutions ", demonstrating flexibility, responding promptly to new situations, deciding on difficult and complicated issues posed by real life such as mechanisms and policies for preventing and fighting the Covid-19 pandemic, allowing the Government to issue resolutions adjusting other provisions of the law in some special cases... these are unprecedented legislative initiatives. Thereby, the National Assembly accompanies the Government and the entire political system under the leadership of the Party to help the country overcome difficulties, fulfill the development goals set out in the Resolution of the 13th National Party Congress and firmly enter the new era.
Fifth , for the first time, the National Assembly organized a Law-making Forum, a Forum on supervision activities, ensuring close connection between law-making and law enforcement, and organized a number of economic forums, cultural seminars, etc. These are outstanding highlights in the National Assembly's legislative activities, demonstrating proactiveness, openness, listening, and removing practical obstacles in the process of building and perfecting institutions.
Clearly and deeply demonstrate the spirit of innovation in thinking in law-making
- The 15th tenure also marked strong innovations in constitutional and legislative activities in line with the direction of General Secretary To Lam in his speech at the National Assembly. How has this direction been demonstrated in legislative work, Madam?
- At the Eighth Session of the 15th National Assembly, General Secretary To Lam delivered a very important speech in the Hall on innovation in thinking about law-making. Since then, the law-making work of the National Assembly has made breakthroughs, clearly and more deeply demonstrating the spirit of innovation in thinking about law-making.
Specifically, first , the legislative work in recent times has fully, correctly and promptly institutionalized the Party's policies and guidelines; there have been many innovations in methods, thinking and legislative processes, promoting the role of " being one step ahead in terms of institutions ", affirming the important role of the National Assembly in perfecting institutions and laws, starting from the overall interests of the country; making institutions and laws a competitive advantage; promoting democracy, respecting, ensuring and effectively protecting human rights and citizens' rights; ensuring the balance and rationality between the level of rights restrictions and the legitimate interests achieved.
Second , the laws passed in recent times have deeply demonstrated the spirit of innovation in thinking in law-making. The laws are concise, clear [1] , simple, easy to implement, and center on people and businesses; only regulating issues under the authority of the National Assembly, creating favorable conditions, giving proactive and flexible authority to the Government in the implementation process; thoroughly cutting and simplifying administrative procedures, investment and business conditions, reducing compliance costs, creating the greatest convenience for people and businesses; for new issues that are in the process of being mobilized, and in practice that are frequently changing and not yet stable, only the framework and principle provisions are provided and assigned to the Government, ministries, branches, and local authorities to ensure flexibility in operation and in accordance with practice.
Third , the legal system has been continuously improved in recent times, achieving the following outstanding results.
That is the work of building and perfecting the law on the organization of state agencies in the direction of streamlining, efficiency, effectiveness, and efficiency, promoting decentralization, delegation of power, and implementing the organization of a 2-level local government model according to the Party's policy, which is implemented synchronously and systematically, creating a solid legal foundation for the formation of a 2-level local government model, associated with thorough and synchronous decentralization and delegation of power, creating initiative for agencies and organizations in the implementation.
The work of building and perfecting institutions on science, technology, innovation and digital transformation has had many important breakthroughs; the laws and resolutions promulgated have promptly removed barriers and bottlenecks, creating an open legal corridor for the development of science, technology, innovation and digital transformation, unlocking financial and budgetary resources, and strongly supporting the science, technology and innovation ecosystem.
The legal framework for a socialist-oriented market economy is being improved in the direction of facilitating business investment, unlocking social resources, promoting economic development, especially digital economy, green economy, circular economy... to suit reality, remove legal "bottlenecks", and meet the development requirements of a socialist-oriented market economy and international integration.
The work of perfecting the law on culture and society has contributed to perfecting the institution, building and developing an advanced Vietnamese culture imbued with national identity; creating a solid legal corridor to develop high-quality human resources, enhancing national competitiveness, promoting international integration in education; improving the capacity of the health system, developing the pharmaceutical industry, basic medicine and preventive medicine, while ensuring social security and people's rights in accessing quality health care services.
The legal system on national defense, security and foreign affairs has been constantly improved, contributing to maintaining political stability, creating favorable conditions for the country's socio-economic development, and international integration has continuously developed in both breadth and depth.
- As one of the "backbone" Committees, assigned to take charge of very important tasks of the National Assembly related to constitutional and legislative work, how has the Committee performed its functions and tasks to realize the directions of the General Secretary and the Chairman of the National Assembly related to strong innovations in legislative work, Madam?
- In order to promptly implement the direction of the General Secretary and the Chairman of the National Assembly regarding the strong innovation of the National Assembly in legislative work, the Committee on Law and Justice has been active, proactive, and made efforts to overcome all difficulties in implementing assigned tasks, closely coordinating with relevant agencies in each step of implementation, with many innovations and creativity in organization and implementation, application of digital technology, artificial intelligence, promoting democracy, promoting responsibility, getting involved early, resolutely, and determinedly completing the tasks and plans set out on schedule, ensuring quality with the following outstanding results:
Firstly , the Committee on Law and Justice chaired and advised the National Assembly Party Committee to develop the Project "Innovation and improvement of the professional, scientific, timely, feasible and effective law-making process" to submit to the Politburo for consideration and approval.
On that basis, the Politburo issued Conclusion No. 119-KL/TW dated January 20, 2025 on the Orientation for innovation and improvement of the law-making process, as a basis for comprehensively amending the Law on Promulgation of Legal Documents at the 9th Extraordinary Session (February 2025) and renewing thinking, improving the quality and effectiveness of law-making work. The Law on Promulgation of Legal Documents 2025 has made major reforms and changes in the process, procedures, authority and responsibilities of agencies in proposing, building, drafting, receiving and revising draft laws, ordinances and resolutions of the National Assembly and the Standing Committee of the National Assembly, contributing to speeding up the progress and clearly defining the responsibilities of agencies in developing and promulgating legal documents.
At the same time, at the Ninth Session, the Committee on Law and Justice chaired the review, coordinated with the Ministry of Justice and relevant agencies to absorb, revise, and submit to the National Assembly for approval the Law amending and supplementing a number of articles of the Law on Promulgation of Legal Documents, Resolution No. 197/2015/QH15 on a number of special mechanisms and policies to create breakthroughs in law making and enforcement to promptly institutionalize the Party's policies in Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo on innovation in law making and enforcement, meeting the requirements of national development in the new era and new requirements in building a 2-level local government model, Resolution No. 206/2025/QH15 on special mechanisms to handle difficulties and obstacles due to legal provisions to promptly remove difficulties, obstacles, institutional " bottlenecks ", and clear up resources, creating flexibility for the Government, ministries, branches and local authorities in management and operation, proactively responding to changes in practice.
Second , the Law and Justice Committee is a standing body that directly advises and assists the Committee in drafting amendments and supplements to a number of articles of the 2013 Constitution to submit to the National Assembly for consideration and approval of the Resolution amending and supplementing a number of articles of the Constitution of the Socialist Republic of Vietnam, creating a constitutional basis for implementing the two-level local government model.
Third , the Committee is always active, proactive and responsible in ensuring the full institutionalization of the Party's policies and guidelines on innovation in law-making thinking in the process of chairing, participating in examining, receiving and revising all draft laws, ordinances and resolutions submitted to the National Assembly and the Standing Committee of the National Assembly for consideration and approval, contributing to the goal of making institutions and laws a competitive advantage, a solid foundation, a strong driving force for development, creating room to promote "double-digit" economic growth, improving people's lives, ensuring national defense, security and foreign affairs of the country.
