At the conference, citizen Nguyen Quang Oanh, residing in Residential Group No. 4, Hoa Mac Ward (Duy Tien Town) requested the competent authority to consider granting a Land Use Rights Certificate (LURC) to his family.

Specifically, the land origin, land use process and current status of the land plot are as follows: According to the map of Dong Van town (now Dong Van ward) established in 1989, the land location that citizen Nguyen Quang Oanh (residing in residential group number 4, Hoa Mac ward, Duy Tien town) requested to be granted a Land Use Rights Certificate is land plot number 500, map sheet number 3, area 1,270 m2, the land user is Duy Tien District Pharmaceutical Company.

On April 20, 1994, Duy Tien District Pharmaceutical Company issued Document No. 03/TT requesting to liquidate and transfer the pharmacy store area in Dong Van town due to no longer having a need to use it. On July 8, 1994, Nam Ha Provincial People's Committee issued Notice No. 38 - TB/UB on agreeing to auction the 2-storey building with an area of 700 m2 of land of Dong Van town pharmacy store belonging to Duy Tien District Pharmaceutical Company. On August 2, 1994, Duy Tien District Pharmaceutical Company announced the auction of the above assets of Dong Van town pharmacy store with a minimum price of 302,000,000 VND. The minutes of the public auction results on August 12, 1994 showed that Mr. Nguyen Quang Oanh won the auction of a 2-storey building with an area of 700m2 of land of the Pharmacy store in Dong Van town with the amount of 302,099,000 VND (Mr. Nguyen Quang Oanh completed the auction winning amount).

On January 9, 1995, the People's Committee of Dong Van town and Duy Tien District Pharmaceutical Company assigned the auctioned land to Mr. Oanh. In addition to the land received for liquidation from Duy Tien District Pharmaceutical Company, Mr. Oanh was also assigned land by the People's Committee of Dong Van town beyond his authority in 1995 with an area of 200 m2 of residential land. Thus, the total area that Mr. Oanh is using and has not been granted a Land Use Rights Certificate is 900 m2. In 2006, Mr. Oanh had 155.25 m2 of land reclaimed to implement the investment project to upgrade and renovate the intersection between National Highway 38B and National Highway 1A and the North-South railway. In 2018, Mr. Oanh had 189 m2 of land reclaimed to implement the Dong Van New Urban Area Construction Project. Mr. Oanh's household received compensation and handed over the site.

However, implementing the policy of the Provincial People's Committee to expand the central market of Dong Van town by an additional 554.6 m2 (this area is located in the land that Mr. Oanh won the auction to buy from Duy Tien District Pharmaceutical Company), but during the construction of the market expansion, Binh Minh Company Limited - the unit assigned to implement the Project could not reach an agreement with Mr. Oanh on the land use rights. Therefore, Binh Minh Company Limited requested the People's Committee of Duy Tien town to report to the Provincial People's Committee for permission not to carry out construction items on the land area to expand Dong Van central market and was approved. Thus, according to the current map of Dong Van ward established in 1999, the land location that Mr. Oanh is requesting to be granted a Land Use Rights Certificate is plot number 60, map sheet PL 11, with an area of over 1,291 m2 of residential land (in addition to the legally assigned land, during the use process, Mr. Oanh has encroached on more than 391 m2).

After listening to the Departments, branches and localities clarifying a number of issues regarding the origin of the land, the implementation of financial obligations of citizens for the land area for which the Land Use Rights Certificate was requested, the settlement process of competent levels and branches; reviewing the additional land of Mr. Oanh, Comrade Le Thi Thuy, Member of the Party Central Committee, Secretary of the Provincial Party Committee, Chairman of the Provincial People's Council emphasized: The citizen's request is legitimate, however, the matter has been going on for many years without being resolved for the citizen, the responsibility lies with both the functional agencies and the authorities at all levels. Therefore, the Secretary of the Provincial Party Committee requested: this matter needs to be considered comprehensively to resolve, ensuring the rights of citizens.

The Provincial Party Secretary assigned the Party Committee of the Provincial People's Committee to direct the Provincial People's Committee to assign the Provincial Inspectorate to preside over and coordinate with relevant agencies to consider and resolve the citizen's request. During the implementation process, it is necessary to clarify: the origin, the process of land use and compare the provisions of the law at each time to consider and resolve the matter. The Provincial Party Secretary noted that during the settlement process related to the citizen's request, there are 3 parts of land area that need to be reviewed, including: the citizen bought and liquidated 700 m2 of assets in 1994, bought 200 m2 in 1995 and the area of 391 m2 that the citizen actually used but was not shown in the books, from which there is a direction to resolve according to the provisions of the law. At the same time, clarify the planning and planning management of the land area requested by the citizen, review the implementation process of the Projects (New Urban Area and Dong Van Market construction) to see if the procedures have been completed according to regulations.

The Provincial Party Secretary also requested citizens to closely coordinate with relevant agencies to have sufficient grounds for resolution and is expected to respond to citizens within 3 months (until January 23, 2024), ensuring the legal and legitimate rights of citizens./.
