The draft Decree has been developed by the Ministry of Finance in accordance with the provisions of the Law on Promulgation of Legal Documents 2015 with a structure including 8 chapters with 84 articles and 2 appendices, 78 document templates used in business registration. Of which, 18 articles on business household registration are abolished; 2 articles on business registration for credit institutions and transitional regulations for securities companies are abolished; 8 new articles are added; 2 appendices including 78 forms used in business registration (currently regulated in Circular No. 01/2021/TT-BKHĐT) are added; most of the remaining articles are amended and supplemented.
Reporting at the meeting, Deputy Minister of Finance Nguyen Duc Tam said that in recent times, the Party and State have had many important guidelines and policies on the arrangement of administrative units with a two-level government organization model, many of which directly affect the provisions in the draft Decree on business registration. Therefore, it is necessary to continue to study, amend and supplement to meet the requirements and tasks in the new period.
Currently, the Ministry of Finance is submitting to the Government a draft Decree regulating the registration and operation of business households. However, on May 4, the Politburo issued Resolution No. 68 on private economic development. To ensure the completion and full and specific institutionalization of the contents and instructions of the Politburo in Resolution No. 68, the Ministry of Finance proposes to postpone the deadline for the Decree on business households to continue researching and completing it in accordance with new policies and regulations.
In order to meet the requirement of "ending the operation of district-level administrative units and organizing two-level local government", the Ministry of Finance proposed that the Government assign the Ministry of Finance to preside over and immediately develop a Decree amending Decrees No. 01/2021/ND-CP, Decree No. 92/2024/ND-CP, Decree No. 113/2024/ND-CP according to simplified procedures and processes to decentralize and delegate authority to the People's Committees at the commune level (or specialized agencies of the People's Committees at the commune level) to handle procedures for registering cooperative groups, cooperatives, cooperative unions and business households and some other related contents, implemented from July 1, 2025.

After listening to the report of the Ministry of Finance and the opinions of relevant ministries and branches, Deputy Prime Minister Nguyen Chi Dung basically agreed with the proposal to postpone the deadline for the Decree on business registration to update new contents on the basis of implementing the prescribed procedures, ensuring its promulgation before July 1, 2025.
The Deputy Prime Minister noted that it is necessary to review and update new issues immediately with a sense of urgency. In particular, focusing on how to implement business registration when there is a two-level government, how to assign it to communes and departments. Also in the spirit of decentralization and delegation of power, it is necessary to cut down procedures, apply digitalization to the process according to the new policies and regulations in Resolution 68-NQ/TW and Resolution 57-NQ/TW.
"The amendment must be done in a systematic and urgent manner, immediately meeting the requirements of removing obstacles in the business registration process," the Deputy Prime Minister emphasized.
Regarding the procedures for registering cooperatives, cooperative unions, and business households, the Deputy Prime Minister agreed that the Ministry of Finance should preside over and immediately develop a decree amending relevant decrees.
