Just a few hours after KFC Vietnam warned about brand counterfeiting on social media sites, Jollibee Vietnam and Texas Chicken Vietnam also made similar moves.

On the morning of May 10, on its official fanpage, the American fried chicken brand Texas Chicken Vietnam posted information stating that recently, Texas Chicken Vietnam has recorded the appearance of many accounts impersonating the brand on social networking platforms such as Facebook and TikTok.

These fake channels not only use unauthorized logos, images and brand names, but also have the ability to distort information, affecting customer choices and experiences.

Texas Chicken Vietnam warns about the appearance of many fake brand accounts on social networks

The brand warns that all content that does not originate from the official system does not represent the brand's voice and may pose a risk to users.

Texas Chicken entered the Vietnamese market in late 2012, and now has 30 restaurants in Ho Chi Minh City, Binh Duong, Nha Trang, Hanoi , Hai Phong and Bien Hoa.

On the same day, fast food chain Jollibee Vietnam continued to announce that many fake Jollibee brand accounts appeared on social networks, especially TikTok.

Jollibee Vietnam also issued a warning about fake accounts on social media.

These accounts illegally use Jollibee's name and image, spreading false and misleading information and negatively impacting customer experience.

Previously, on May 9, KFC Vietnam also said that it had recently recorded many cases of impersonating this brand as well as restaurant branches on social networking platforms, especially Facebook and TikTok.

Many incorrect and substandard contents, messages and images are being spread more and more widely, causing customers to seriously misunderstand this brand.

To protect consumers, all three fried chicken brands have included official social media links in their announcements.

According to records, on social networking platforms such as TikTok and Facebook, recently there have been a series of fake accounts impersonating the brands Texas Chicken Vietnam, Jollibee and KFC Vietnam.

A series of fake channels on social networks

These accounts use similar names and logos to brands, then comment on many videos with content related to promotional programs, statements comparing with competitors, or comments that are controversial, even insulting to others... causing misunderstandings.

From a legal perspective, Lawyer Truong Van Tuan, Head of the Trang Sai Gon Law Office, said that Article 12 of the 2006 Law on Information Technology stipulates the following prohibited acts: " Distorting, slandering, insulting the reputation of organizations, honor, dignity, and reputation of citizens" .

Accordingly, the above behavior can be considered a prohibited and illegal behavior because it impersonates the electronic information page of another organization or individual.

Pursuant to Clause 3, Article 99 of Decree 15/2020/ND-CP, amended by Clause 1, Article 1 of Decree 14/2022/ND-CP of the Government stipulating administrative sanctions for violations in the fields of post, telecommunications, radio frequencies, information technology and electronic transactions, acts of forging electronic information pages; providing false information, distorting, slandering, insulting the reputation of organizations, honor and dignity of individuals can be fined up to 30 million VND.

In addition, violators may also have their vehicles used to commit this violation confiscated. And they must take remedial measures to remove all misleading and untrue information...

More seriously, this behavior can also be criminally prosecuted under Article 155 of the 2015 Penal Code, which stipulates the "crime of humiliating others".

Specifically, if the authorities determine that the act of creating fake channels on social networking platforms Facebook and TikTok and then making false statements, comparing competitors has seriously offended the dignity and honor of others, the violator may be prosecuted for the crime of "Humiliating others".

For this crime, the offender may be subject to a maximum prison sentence of up to 5 years. In addition, he or she may be subject to additional penalties such as being banned from holding certain positions, practicing a profession or doing certain jobs from 1 to 5 years.

"To avoid being punished, or more seriously, being prosecuted, people should not create fake channels of individuals or organizations for any purpose," Mr. Tuan advised.
