Recently, the Ministry of Education and Training has issued Circular 29 regulating extra teaching and learning with many new points that are said to be aimed at overcoming the shortcomings in this activity in the past.
Some teachers wonder whether tutoring one or a few students in a very small number of places at home is allowed and whether a business registration is required.
Regarding this, Mr. Nguyen Xuan Thanh, Director of the Department of SecondaryEducation (Ministry of Education and Training) said: “Extra tutoring is due to the needs of both students and teachers. However, through monitoring and understanding the reality, we see that there are also students who have the need and voluntarily take extra classes, but there are also situations where students do not want to but still have to take extra classes organized by their own teachers and schools. A part of students are having to take extra classes just to avoid being out of place with their friends, not feeling guilty towards their teachers or even because the test is not unfamiliar.”
According to Mr. Thanh, the newly issued Circular 29 specifically stipulates that organizations and individuals who teach extra classes and collect money from students must register their business according to the law. In addition, teachers who are teaching at schools are not allowed to teach extra classes outside of school and collect money from their students in class...
“That regulation is to ensure the rights of students, to avoid teachers “pulling” students out of class to teach extra classes.
If students are not in need of extra classes at school, they have the right to take extra classes outside of their own free will. At that time, parents and students will research and consider the value of extra classes, whether they can help them progress and understand the problem more deeply.
Studying to become better and develop yourself is a legitimate desire, so the Ministry of Education and Training does not prohibit it; however, organizations and individuals who teach extra classes must register their business and must publicly disclose the location, subjects, study time, costs... and must strictly follow the provisions of the law on working hours, safety, security, fire prevention and fighting...", Mr. Thanh said.

Mr. Thanh also emphasized that the new circular does not prohibit teachers from teaching extra classes outside of school. However, they must register their business or teach at registered centers.
“If teachers make an effort, are good teachers, are truly dedicated, and bring value to students, there will certainly be no shortage of students seeking to learn. Only in cases where teachers are assigned by the school to teach students in the school are they not allowed to teach extra classes for money outside the school to limit the situation where teachers take students out to study extra classes, cutting down on knowledge in class to teach extra classes,” said Mr. Thanh.
Mr. Thanh said that the regulation is like that, but to be effective, there needs to be a monitoring mechanism and the roles and responsibilities of management agencies. "The Circular has clearly defined the responsibilities of each unit from the Provincial People's Committee, the Department of Education and Training to schools, People's Committees of wards and communes in the area for inspection and supervision," Mr. Thanh said.
According to Circular 29/2024/TT-BGDDT recently issued by the Ministry of Education and Training, organizations or individuals organizing extra teaching and learning activities outside of school with fees from students must comply with the following requirements:
- Register business according to the law;
- Publicly announce on the electronic information portal or post at the location of the tutoring facility the subjects that are taught extra; the duration of extra teaching for each subject according to each grade level; the location, form, and time of organizing extra teaching and learning; the list of tutors and the tuition fees before enrolling students in extra teaching and learning classes.
Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subjects they teach.
Teachers who are teaching at schools and participate in extra-curricular teaching must report to the principal or director or head of the school about the subjects, location, form, and time of extra-curricular teaching.
The fee for extra-curricular tuition is agreed upon between parents, students and the tutoring facility.
