'Dark corners' when implementing regulations to tighten extra teaching and learning: Orders are not enough

Circular 29 initially shows that extra teaching and learning in schools seems to be "more peaceful", but outside of schools, because of many goals, needs and realities of teaching and testing, the orders in the circular are not enough to solve the problem.

Confused about managing extracurricular teaching

The licensing of individual business households to open private tutoring establishments has long been very simple at the financial planning offices of districts and towns, and there is no legal corridor for these establishments, so the management process of the Department of Education and Training has encountered many difficulties. "People submit applications to register for private tutoring establishments. If they meet the requirements, we will issue them according to regulations. Whether they can operate or not, and how they operate, is not within our scope of management," said an officer of the licensing unit for private tutoring establishments.

Mr. Tran The Cuong, Director of the Hanoi Department of Education and Training, said that since Circular 29 took effect, the number of centers with the function of tutoring has increased significantly, with an estimated 15,000 centers and businesses related to tutoring established. Somewhere, the fee collection level is much higher than before, even though it is voluntary. According to Mr. Cuong, the rapid increase in the number of tutoring centers also puts pressure on inspection and examination work while the human resources for this work have not increased; Circular 29 has not yet stipulated sanctions for violations of tutoring outside of school...

Similarly, at a national conference on this issue after a period of implementing Circular 29, Mr. Nguyen Bao Quoc, Deputy Director of the Department of Education and Training of Ho Chi Minh City, said that the number of private tutoring units in individual business households is more than 10,000, the city is worried about how to control safety and prevent fires in private tutoring classes...

Mr. Pham Quoc Hieu, Deputy Director of the Department of Education and Training of Hai Phong , also said that the management of extracurricular activities outside of school faces many difficulties, especially with spontaneous extra classes and extracurricular facilities that do not comply with regulations. Meanwhile, the number of managers and human resources managing extracurricular activities in localities is still small, and they have to take on many tasks, so regular monitoring and inspection face many difficulties.

In fact, the legal representative who registers the individual business household for DTHT does not have the conditions of qualifications or professional qualifications in the field of education, and even many elderly people are also the business household’s name. In particular, there are many business households that register to teach extra classes when there is only a private house with 2 or 3 bedrooms that is requisitioned as a classroom, located in a deep alley that does not ensure fire safety...

From the above difficulties, the Department of Education and Training of Hai Phong proposed that the Ministry of Education and Training soon issue specific legal guidelines for DTHT facilities. If the DTHT facility is an educational institution, it must have a public administrative department so that functional units can base on it to implement, inspect and supervise.

Assessing after 4 months of implementing Circular 29, the Ministry of Education and Training said that since 2020, when private tutoring is no longer a conditional business, management has become more difficult, and localities do not know the sanctions to handle violations. The list of behaviors requiring administrative sanctions in the education sector currently lacks some violations of regulations on private tutoring that need to be supplemented. "There is still a small number of managers and teachers who, following old habits, do not fully understand the new regulations of the Circular or, for personal gain, when private tutoring gradually becomes an important source of income, still deliberately violate the regulations of Circular 29. The situation of private tutoring in disguise in many forms is still quite common, showing that there is still a gap between policy and practice," the ministry's report stated.

Need to review why "banned" but students still find ways to study extra

As Thanh Nien has reported in previous articles, although Circular 29 prohibits extra tutoring for primary school students, in reality, every family still lets their children take extra classes, even from grade 1. In the discussion on the Law on Teachers, National Assembly delegate To Van Tam (Kon Tum Delegation) raised the question: "Is the program and the amount of knowledge in the program too heavy?" and suggested that the Ministry of Education and Training should review the program and the amount of knowledge in our current program to see if it is reasonable or too heavy?

Delegate Tran Khanh Thu (Thai Binh) pointed out that the long-term restriction of DTHT has not achieved the desired results and there are many forms of non-coercion but students still have to participate in programs that put pressure on students, especially at the primary level. Therefore, Ms. Thu believes that banning spontaneous DTHT is necessary. In addition, it is necessary to have a set of DTHT regulations in a public direction and develop specific regulations to limit the spread of spontaneous DTHT, avoiding waste and unnecessary.

Sharing her views with Thanh Nien , Associate Professor Chu Cam Tho (Vietnam Institute of Educational Sciences) said: Many studies on general education have announced that "the curriculum is not heavy, the exams are not so heavy that almost all high school students have to take extra classes". But in reality, public opinion always complains about pressure from society and schools. Specifically, exams, especially important exams such as the entrance exam to grade 10 (in big cities), university entrance exams, are very competitive. This creates great pressure for both students and parents; the crowd effect when seeing their children's friends taking extra classes, parents also feel worried and afraid that their children will fall behind; and pressure from teachers, in some cases teachers can encourage students to take extra classes to consolidate knowledge or prepare for exams.

Besides, according to Ms. Tho, parents are always worried about their children's abilities. Every parent wants their children to get good results in exams, and they believe that extra classes are the way to achieve that. Parents believe that extra classes will make up for the lack of knowledge.

Meanwhile, Mr. Dang Tu An, Director of the Vietnam General Education Innovation Support Fund, former Director of the Department of Primary Education, said: "Specialized and selective schools, such as high-quality schools, key schools, special schools, talent training schools, etc., are being opened by districts and counties in large numbers, recruiting students like an exam. From here, students have to take extra classes to be able to answer very tricky and challenging entrance assessment questions. Taking extra classes is to put students in "disguised" specialized schools, which is very inconsistent with the goal of educational innovation. Without innovating, even "revolutionizing" the specialized school system, it will never be possible to manage DTHT effectively and thoroughly."

Ministry of Education and Training: "Need systematic and synchronous solutions"

In a report to the National Assembly at the ongoing session, Minister of Education and Training Nguyen Kim Son said: "DTHT is a complex issue with great social impact, so a circular regulating DTHT management cannot solve all the problems. It is necessary to have systematic, synchronous, drastic solutions, and implementation needs a roadmap...".

Accordingly, the Ministry of Education and Training is conducting a review of the implementation of the 2018 General Education Program to continue to propose solutions to improve the quality of education; instructing to teach 2 sessions/day, thereby reducing widespread DTHT and strengthening the organization of educational activities to develop qualities and capacities for students.

Regarding the pressure of exams and the quality of formal teaching, the Ministry of Education and Training commits to instructing educational institutions to focus on improving the effectiveness of professional work, improving the quality of teaching and learning in formal hours, diversifying teaching methods and forms, increasing the application of information technology; continuing to innovate testing and assessment methods and forms towards forming and developing learners' qualities and capacities for the progress of students. The creation of regular and periodic tests and assessments, admission to the first level, entrance exams to grade 10, and university admission must be consistent with the requirements of the 2018 General Education Program.
