The General Department of Customs has just issued a document requesting the Customs Departments to stop carrying out customs procedures for imported and exported gasoline and raw materials of Hai Ha Waterway Transport Company Limited and Xuyen Viet Oil Trading, Transport and Tourism Company Limited.
According to the General Department of Customs, these two enterprises have had their certificates of eligibility to act as petroleum traders revoked by the Ministry of Industry and Trade. Up to now, these two enterprises are not eligible to carry out procedures for import and export, temporary import for re-export, transit, and export processing of petroleum and raw materials for blending petroleum.
Previously, the Investigation Police Agency - Ministry of Public Security prosecuted and temporarily detained Ms. Tran Tuyet Mai - Chairwoman of the Board of Members and General Director of Hai Ha Waterway Transport Company Limited - for not paying the amount of money set aside for the Petroleum Price Stabilization Fund and using the Price Stabilization Fund money against the law, causing a loss of more than 317 billion VND in state assets.
According to Tien Phong reporter, Hai Ha Waterway Transport Company Limited has attracted attention recently when it was continuously named for its large tax debts. In addition, after being granted a license, Hai Ha Waterway Transport Company Limited did not ensure the distribution system according to regulations. Specifically, in 2018, Hai Ha Petro had 36/40 retail agents for gasoline; in 2019, it had 34/40 retail agents; in 2020, it had 39/40 retail agents and in 2021, it had 38/40 retail agents for gasoline.
Hai Ha Waterway Transport Company Limited was also proposed to be handled for violations of the law in the process of declaring and paying environmental protection tax on gasoline, as well as using the price stabilization fund for the wrong purpose.
Hai Ha Waterway Transport Company Limited was suspended from carrying out procedures for importing and exporting gasoline.
According to the inspection conclusion, Hai Ha Petro has set aside and spent the Price Stabilization Fund for the volume of gasoline and oil exceeding the volume on the books by 110,242 m3. This has led to the incorrect setting up of the Price Stabilization Fund, exceeding the volume. In addition, this company often owes environmental protection tax, but it was not until February 16, 2023 that the Thai Binh Provincial Tax Department issued a document on paying the tax debt to the state budget. Thereby confirming that as of December 31, 2022, the company still owes the budget VND 1,114 billion in environmental protection tax.
According to the inspection conclusion, Hai Ha Petro issued value-added invoices to the Military Petroleum Corporation for petroleum output that did not match the actual petroleum output.
Previously, Ms. Mai Thi Hong Hanh - Director of Xuyen Viet Oil Trading, Transport and Tourism Company Limited and Ms. Nguyen Thi Nhu Phuong, - Deputy Director were also prosecuted and temporarily detained for "Violating regulations on management and use of State assets causing loss and waste".
Expanding the investigation, the Investigation Police Agency, Ministry of Public Security prosecuted a series of cases of "Lack of responsibility causing serious consequences; Giving bribes; Receiving bribes; Taking advantage of positions and powers to influence others for personal gain occurring at Xuyen Viet Oil Company and a number of related agencies and organizations".
In early August 2023, the Ministry of Industry and Trade established a team to inspect compliance with legal regulations on petroleum trading in 2023 for 4 key petroleum traders, including: Xuyen Viet Oil Trading and Tourism Company Limited; Hung Phat Production and Trade Company Limited; Thien Minh Duc Group Joint Stock Company; Hai Ha Waterway Transport Company Limited.
After inspection, the Ministry of Industry and Trade discovered many violations related to the petroleum business activities of these key enterprises, and the Ministry of Industry and Trade itself was pointed out by the Government Inspectorate for many violations in the management and licensing of petroleum.
