The Ministry of Health has issued Circular 11/2023/TT-BYT regulating the implementation of smoking-free locations and the awarding of the Smoke-Free Environment Award.
In places where smoking is prohibited, signs, letters or symbols with the content of no smoking shall be placed, printed or arranged.
The Circular clearly states the general requirements for all places where smoking is prohibited as follows: Place, print, arrange (place) signs or letters or symbols with the content of no smoking (sign).
Signs must ensure the following requirements: 1- Message content is clear, easy to understand, and concise; 2- Sign material is durable and difficult to fade; signs placed outdoors can withstand the impact of the external environment; 3- Size and font size of the sign are suitable for the location and space where the sign is placed; bold, easy to read letters; color of letters and symbols contrast with the background color; 4- Signs placed in public places in conditions of insufficient light: have reflectors or sign lighting or other suitable forms to ensure visibility.
The placement of signs must ensure the following requirements: 1- The distance between signs must be appropriate to the scale and space of each location; 2- Place signs in easily observable locations, areas with high traffic; entrance gates to campus areas, outdoor parking areas; for indoor areas, place signs at entrances, front halls, reception areas, waiting seats, stairwells, in elevators, covered corridors, parking garages, and restrooms.
The Circular clearly states that there are no ashtrays, smoking utensils, cigarette butts and ashes in places where smoking is prohibited.
The Circular also specifies specific requirements for places where smoking is completely prohibited indoors and on premises; places where smoking is completely prohibited indoors; and public transport where smoking is completely prohibited.
Rooms designated for smoking must have separate ventilation.
According to the Circular, places where indoor smoking is prohibited but where a designated smoking area is permitted must have a sign indicating the way to the designated smoking area.
Areas designated for smokers must meet the following requirements: 1- Have signs stating that smoking is permitted; 2- Rooms designated for smokers: Ensure that they are separate and have their own ventilation; do not open doors, vents, or exhaust fumes to non-smoking rooms, areas, or corridors shared with other rooms; 3- Have items to store cigarette butts and ashes; 4- Have fire prevention and fighting equipment in accordance with the provisions of law on fire prevention and fighting.
Hotels, motels, guesthouses, resorts and other tourist accommodation establishments must at least place signs in the lobby, reception desk, common areas and accommodation rooms. A designated smoking area (if any): not located in the common lobby, not arranged as accommodation for non-smokers.
For ships: A designated smoking area is located on the deck or a separate room is arranged that meets the requirements as prescribed.
For trains: The designated smoking area should be located at the end of the train, not in the connecting area between two passenger cars.
The Circular takes effect on August 1, 2023.
