
- Pursuant to Decision No. 88-QD/TW dated December 1, 2022 of the Politburo on functions, tasks, powers and organizational structure of the Central Propaganda Department;
- Pursuant to Regulation No. 101-QD/TW dated February 28, 2023 of the Secretariat on responsibilities, powers, appointment, dismissal, commendation, and discipline of leaders of press agencies (hereinafter referred to as Regulation No. 101-QD/TW);
The Central Propaganda Department guides a number of articles in the Regulations on responsibilities, powers, and the appointment, dismissal, reward, and discipline of leaders of press agencies, as follows:
I. GENERAL PROVISIONS
1. Subjects of regulation (Article 1)
The person assigned the task of the head of the press agency (assigning the authority of the head, assigning responsibility for the press agency): Is the deputy head of the press agency or the deputy head of the governing agency assigned the task of being in charge of the press agency.
2. Responsibilities and powers of the directing agency, press management agency and press management agency (Article 4)
The agency responsible and authorized to appraise and give opinions on the proposal of the press management agency on the appointment and reappointment of the press agency's leaders is the Central Propaganda Department and the Ministry of Information and Communications .
II. APPOINTMENT AND DISMISSAL
1. Standards and conditions for appointment (Article 5)
1.1. Working in the field of journalism and publishing (Clause 5, Article 5): People working in the field of journalism and publishing are people working at press agencies and publishing houses; people performing professional tasks in journalism and publishing at press and publishing directing agencies, press and publishing management agencies, journalists' associations at all levels, press and publishing management agencies; lecturers specializing in journalism and publishing at publicuniversities .
1.2. Conditions and standards for leaders of the governing body assigned to the task of head of the press agency: Have good health to complete assigned tasks; have a university degree or higher; meet Clause 2, Clause 3, Article 5 of Regulation No. 101-QD/TW.
1.3. Certificate of training in state management of journalism (Clause 4, Article 5): Is a certificate issued by a public university training institution licensed to train in journalism; a training and professional training facility of a state management agency of information and communication as prescribed.
1.4. Have complete documents and be confirmed by competent authorities (Clause 6, Article 5):
- List of records for appointment and reappointment of leaders of press agencies under the management of the Politburo and Secretariat: According to Party regulations and State laws.
- List of dossiers for appointment of leaders of press agencies in agencies of the Party, State, Vietnam Fatherland Front, socio-political organizations: According to Appendix I of this Guide. List of dossiers for reappointment of leaders of press agencies in agencies of the Party, State, Vietnam Fatherland Front, socio-political organizations: According to Appendix II of this Guide.
- List of appointment dossiers for leaders of press agencies not under the management of the Politburo and Secretariat and not under the Party, State, Vietnam Fatherland Front and socio-political organizations: According to Appendix II of Regulation No. 101-QD/TW.
2. Age of appointment (Clause 7, Article 5)
Special cases under 70 years old only apply to heads of press agencies of religious organizations; scientific magazines; specialized magazines in which the main specialty is consistent with the principles and purposes of the magazine, with a scientific score of 0.75 points or higher.
3. Appointment process and procedures (Article 7)
3.1. The steps to implement the procedure for appointing leaders of press agencies not under the management of the Politburo and Secretariat are as follows:
(1) The press management agency shall prepare a document (with attached documents) and send it to the Central Propaganda Department and the Ministry of Information and Communications.
(2) Based on the appraisal of the dossier, the Central Propaganda Department has a document requesting the Ministry of Information and Communications for comments.
(3) Ministry of Information and Communications:
- In case of agreement with the opinion of the Central Propaganda Department: The Ministry of Information and Communications shall have a written response to the Central Propaganda Department and at the same time respond to the press management agency according to regulations.
- In case of other opinions: The Ministry of Information and Communications shall send a written document to exchange opinions with the Central Propaganda Department.
+ In case of agreement with the opinion of the Ministry of Information and Communications, the Central Propaganda Department shall have a written response to the competent authority.
+ In case of disagreement with the opinions of the Ministry of Information and Communications, the Central Propaganda Department will organize a meeting with the Ministry of Information and Communications to discuss the contents with different opinions. Based on the consensus at the meeting, the Central Propaganda Department and the Ministry of Information and Communications will send a written response to the competent authority.
(4) The Central Propaganda Department has a written response to the press agency.
(5) The press management agency shall issue a decision to appoint the leader of the press agency after receiving written agreement from the Central Propaganda Department and the Ministry of Information and Communications and send the appointment decision to the Central Propaganda Department and the Ministry of Information and Communications for updating and monitoring.
3.2. When a press agency leader is in office and requests to re-issue a press activity license or to issue an additional press type, the competent authority only needs to report and notify in the official dispatch or request file, and does not have to re-do the appointment process.
3.3. The Central Steering Committee and Press Management Agency shall only review and appraise the dossier and respond when the competent authority has submitted complete documents as prescribed.
4. Term of office (Article 8)
4.1. The head of a press agency shall not hold office for more than 02 consecutive terms (10 consecutive years) at a press agency. The next term shall only be held at least 05 years after the end of the second term.
4.2. The term of assignment of tasks by the head of a press agency to the deputy head of the press agency shall not exceed 18 months. The leader of the governing agency (not the head of the governing agency) shall be assigned the task of being in charge of the press agency for no more than 12 months.
The competent authority shall issue a document assigning tasks to the head of the press agency after receiving written agreement from the Central Propaganda Department and the Ministry of Information and Communications.
5. Reappointment (Article 9)
Process and procedures for reappointing leaders of press agencies in Party, State, Vietnam Fatherland Front, socio-political organizations: Implement according to Party regulations, State laws, and governing agencies. List of reappointment records according to Appendix II of this Guide and send to the Central Propaganda Department, Ministry of Information and Communications for appraisal and comments.
6. Discipline (Article 13)
6.1. The Central Propaganda Department is the agency that issues documents reminding press agencies and press agency leaders after discussing and reaching an agreement with the Ministry of Information and Communications and consulting the Vietnam Journalists Association (if necessary) (Clause 2, Article 13, Regulation No. 101-QD/TW).
6.2. Within 12 months, if a press agency is reminded twice in writing by the Central Propaganda Department, the leader of the press agency will be disciplined by warning or dismissal (Point a, Clause 3, Article 13, Regulation No. 101-QD/TW).
III. IMPLEMENTATION ORGANIZATION
1. The press management agency is responsible for reviewing and making a list of press agency leaders, including the following contents: (1) Full name; (2) Age; (3) Gender; (4) Year of first appointment; (5) Political theory level; (6) Professional level; (7) Certificate of training in state management of the press and sending it to the Central Propaganda Department, Ministry of Information and Communications before December 15 every year or upon request.
2. The press management agency pays attention to and focuses on planning, training, and fostering human resources to meet the requirements of leadership and management of press agency activities.
3. This instruction takes effect from the date of signing. During the implementation process, if any problems arise, relevant agencies shall send a written document to the Central Propaganda Department for study, consideration and adjustment.
