In the official dispatch, Minister Pham Thi Thanh Tra requested Deputy Ministers to direct the units under the Ministry assigned to review the assigned tasks based on their functions and tasks, ensuring quality and progress, and not delaying or being late with any task.
For Heads of affiliated and subordinate units, it is necessary to thoroughly instruct civil servants, public employees, and employees to strictly implement regulations on protecting state secrets, disciplining speech, managing and using information on social networks; proactively prevent the disclosure of information, state secret documents, and internal secrets related to the arrangement and streamlining of the apparatus.
The Minister of Home Affairs assigned the Department of Organization and Personnel to preside over and coordinate with relevant units to advise the Minister on many important tasks.
In particular, monitor and regularly update on a weekly basis the number of cadres, civil servants and public employees who quit their jobs due to organizational restructuring, proactively send to the Ministry of Finance to allocate the budget, provide additional funds to promptly pay benefits to cadres, civil servants and public employees who quit their jobs due to restructuring; review and evaluate the impact of policies and regimes on cadres, civil servants, public employees and workers affected by restructuring, especially ethnic minorities and religious people.
Urgently develop a Decree on the regime and policies to support part-time workers at the commune level and submit it to the Government no later than May 30, 2025.
In addition, the Department of Organization and Personnel is also assigned to urgently complete the draft Decree on the functions and tasks of specialized agencies under the People's Committees at the provincial and communal levels.
At the same time, proactively report to the Heads of the Working Group assisting the Steering Committee on the implementation of the Plan to develop decrees on decentralization, delegation of authority, and division of authority associated with the implementation of the 2-level local government organization model; urge ministries and ministerial-level agencies to ensure the progress of implementing Plan No. 447/KH-CP dated May 17, 2025 of the Government on developing decrees on decentralization, delegation of authority, and division of authority associated with the implementation of the 2-level local government organization model.
Synchronous preparation for relevant laws to come into effect soon
The Department of Local Government is assigned to preside over and coordinate with relevant units to urgently advise competent authorities to issue 01 Resolution of the National Assembly Standing Committee, 4 Decrees of the Government guiding the implementation of the Law on Organization of Local Government (amended) to ensure that the guiding documents are issued to take effect at the same time as the Law takes effect (before June 24, 2025, the date the National Assembly passes the Law on Organization of Local Government).
At the same time, proactively coordinate closely with the Committee on Law and Justice to appraise 01 Project on rearranging provincial-level administrative units and 34 Projects on rearranging commune-level administrative units to submit to the Standing Committee of the National Assembly and the National Assembly for approval as a basis for localities to implement the rearrangement to ensure operation at the commune level from July 1, 2025, and at the provincial level after August 30, 2025.
The Department of Civil Servants and Public Employees is assigned to preside over, Coordinate with relevant units to urgently advise the Minister to submit for promulgation 7 Decrees and issue under authority 01 Circular detailing and guiding the implementation of the Law on Cadres and Civil Servants (amended) to ensure that the guiding documents are issued to take effect at the same time as the Law takes effect, paying attention to the issue of restructuring and improving the quality of cadres, civil servants and public employees to meet the requirements of decentralization, delegation of power and the 2-level local government model (before June 24, 2025, the date the National Assembly passes the Law on Cadres and Civil Servants).
The Legal Department was assigned to urgently complete the draft documents: Decree on the decentralization of local government authority according to the 2-level local government organization model; Decree on decentralization and delegation of authority in state management by sector and field with clear transitional provisions, leaving no gaps or interruptions in work, ensuring the implementation of a number of key principles.
That is the principle: The Central focuses on macro management, building institutions, strategies, planning, and synchronous and unified plans, playing a constructive role and strengthening inspection and supervision; decentralizing and delegating sufficiently, clearly, and reasonably the tasks being performed at the Central level to the localities in accordance with the spirit of "locality decides, locality does, locality is responsible".
At the same time, review and implement decentralization and delegation of authority among relevant sectors and fields to ensure consistency, comprehensiveness, connectivity, and no omissions or overlaps or interference with tasks.
Minister Pham Thi Thanh Tra also assigned the Department of State Records and Archives to continue to urge and guide the digitization of documents to ensure the safety of documents of agencies, units and localities according to regulations; at the same time, inspect and supervise the review, inventory, editing or destruction of records and documents to prepare for handover when there is no district-level organization, merging of commune-level administrative units (to prevent the risk of loss, loss or destruction of documents, especially documents related to land, investment projects, etc.).
In recent times, the support policies and regimes for part-time workers at commune, village, and residential group levels who are redundant due to mergers have been an issue of concern to many people.
Currently, part-time workers at the commune, village, and residential group levels who are redundant due to the rearrangement of administrative units at the commune level and retire within 12 months from the date of the rearrangement decision by the competent authority are entitled to policies according to the provisions of Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating the policy of streamlining payroll.
However, because the monthly allowance for non-professional workers at the commune, village and residential group levels is currently not high, the subsidy level for these subjects is redundant due to the arrangement of administrative units at the commune level, which is still low.
Therefore, to facilitate policy settlement for part-time workers at the commune, village and residential group levels, according to Conclusion 137-KL/TW in 2025, based on proposals from localities, the Ministry of Home Affairs is urgently developing a Decree on regimes and policies to support part-time workers at the commune level to submit to the Government.
Most recently, Conclusion No. 157-KL/TW of the Politburo also requested the Party Committee of the Ministry of Home Affairs to preside over and coordinate with relevant agencies and units to urgently issue documents regulating and guiding the standards for civil servant titles in communes, wards, and special zones, along with plans for training and professional development; and policies to support part-time workers at the commune level, to be completed before June 15, 2025.
