This provision is emphasized in the Government 's Decree , which stipulates the minimum wage for employees working under labor contracts.
Effective from January 1, 2026, the decree clearly states that the minimum monthly wage is the lowest wage used as a basis for negotiating and paying wages to employees applying the monthly salary payment method.
Also according to the decree, employers operating in a region will apply the prescribed level for that region.

For employers whose units and branches operate in areas with different minimum wages, the minimum wage prescribed for the area in which the unit or branch operates shall apply.
“Employers operating in industrial parks, export processing zones, high-tech zones, and concentrated digital technology zones located in areas with different minimum wages shall apply the minimum wage in the area with the highest minimum wage,” the Government stated.
Also according to the newly issued decree, employers are responsible for organizing a review of agreements in labor contracts, collective labor agreements and regulations of the employer to adjust and supplement accordingly.
The Government requires that overtime, night work, in-kind compensation and other benefits as prescribed by labor laws must not be eliminated or reduced.
For agreed contents, commitments in labor contracts, collective labor agreements or other legal agreements that are more favorable to employees than those prescribed in this Decree, they shall continue to be implemented, unless the parties have other agreements.
In the case of adjustment of the applicable area where the minimum wage associated with the area is lower than the minimum wage prescribed by the Government at December 31, 2025, the employer must continue to apply the minimum wage at this time to employees.
