The Ho Chi Minh City Real Estate Association (HoREA) has just proposed that the City People's Committee and the Department of Construction adjust Decision 26/2025/QD-UBND, which completely prohibits short-term apartment rentals, including through platforms such as Airbnb.
According to Mr. Le Hoang Chau, Chairman of HoREA, the above ban has affected thousands of apartments that are being exploited for short-term stays. The association believes that short-term rentals are still in accordance with the law, because this is a legal real estate business activity and tenants still use the apartments for the right purpose of "living".
HoREA believes that there are contradictions between the 2014 Housing Law, the 2023 Housing Law and Decision 26, leading to inconsistent interpretations. Ho Chi Minh City's tightening of short-term rental activities in apartments, while many other localities do not have similar regulations, could create inequality in the market.
Therefore, HoREA proposed that Ho Chi Minh City allow short-term rental services to resume if the landlord meets legal conditions, declares residence and tax obligations; and at the same time recommends that the National Assembly soon clarify related concepts in the 2023 Housing Law.
