Disciplinary action by expulsion: There are cases where students do not return to school.

The Ministry of Education and Training is seeking opinions on a draft Circular regulating rewards and discipline for students, including the abolition of the most severe form of 'expulsion from school for students who violate the law'.

Thus, the draft Circular regulating rewards and student discipline no longer includes the form of expulsion for students. The current Circular has 5 forms of discipline for students depending on the level of violation: Reprimand in front of the class, reprimand in front of the school's disciplinary council, warning in front of the whole school, 1-week expulsion and 1-year expulsion.

Regarding the draft to eliminate the disciplinary measure of "no more expulsion for students" who violate the law, there are currently two opposing opinions: agreement and opposition.

The goal of positive forms of discipline education is to transform students.

As a teacher who is assigned to be in charge of the school's Discipline Committee, I have advised the principal many times to make decisions on temporary suspension of students who violate school rules and regulations. It must be said that temporary suspension of students who violate school rules and regulations also has an educational impact on preventing students from violating their behavior, and has brought about positive results. However, there have been some unfortunate cases that have caused me and many teachers to feel regretful about our inadequate responsibilities.

Remember the 2015-2016 school year, NHD, a student of class 8/2 at Trinh Phong Secondary School, Dien Khanh, Khanh Hoa , frequently violated school rules such as not wearing a scarf, not tucking his shirt into his pants, having long hair... especially hitting his friends causing injuries. Although the homeroom teacher reminded him and asked him to write a self-criticism, he continued to violate school rules. The homeroom teacher asked the school's Discipline Committee to handle the situation, we advised the principal to decide to let NHD take 3 days off school, during which time he had to borrow his friends' notebooks to copy the lessons completely before coming to class. Unfortunately, NHD stopped going to school afterwards.

Thus, it can be said that disciplining students in the form of temporary suspension (expulsion) does not meet the needs of educating students as in the case of NHD mentioned above.

The goal of positive disciplinary education is to transform students who violate rules with sympathy, love, and tolerance, not with harsh punishments such as expulsion that make students afraid and ashamed so they do not repeat the offense.

It is necessary to specifically classify violators according to their level.

In school, it is inevitable that students violate school rules, and the situations of violation are unpredictable: swearing, fighting, being disrespectful to teachers... Therefore, there is no general formula for handling student violations.

For students who systematically violate school regulations, at a serious level, if only handled by requiring them to write a self-criticism or forcing them to go to the library to read books and write their feelings, it is still not enough of a deterrent as some schools are currently applying. Therefore, in order to apply positive discipline to students who violate regulations effectively, it is necessary to specifically classify violators according to the level of violation to choose the appropriate method; along with that, it is necessary to implement synchronously, combining many methods with the patience and tolerance of the teacher.

Positive education is through sympathy, love, tolerance.

When students correctly perceive violations, they will change into correct actions, "convinced" by the way teachers handle them so that they do not make mistakes again. In other words, with the right form of punishment for the right subject and the right violation, there will be positive effects. On the contrary, if the form of punishment is not appropriate, it will have the opposite effect and can destroy the future of students when they are still students.

In school, if students violate school rules, they are just committing a mistake. Depending on the severity of the mistake, the school will base on the appropriate forms of handling according to regulations with 3 forms: reminder, criticism and request to write a self-criticism, which is reasonable and appropriate.

Schools should use education to "raise high and hit lightly", using common sense to influence students who violate the law to realize their mistakes and cultivate their character, which is the noble purpose of education. The abolition of expulsion has a noble humanistic meaning that needs to be implemented. After all, no form of discipline is optimal, if there is one, it is only the judgment of each person's conscience.

According to the provisions of the law when students violate the level of "crime"

In case a student violates the nature and level of "crime" stipulated in the law, the law enforcement agency will base on the behavior, nature and level of the crime to handle it according to the provisions of the law, the right person for the right crime. This will ensure both the rights and obligations of students in particular and the rights and obligations of citizens in general... Clause 1, Article 15 of the Law on Handling Administrative Violations 2012 stipulates: "A person from 14 years of age or older, but under 16 years of age, must be held responsible for very serious intentional crimes or especially serious crimes". Thus, the disciplinary handling of students will ensure more fairness, clear people, clear work, clear responsibilities.
