The Draft Decree consists of 6 chapters and 72 articles (21 articles less than the current Decree). The subjects of application are civil servants specified in Clause 2, Article 1 of the Law on Cadres, Civil Servants and Civil Servants Management Agencies (including: Competent agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, socio-political organizations at the Central level; Agencies of the National Assembly; Provincial Party Committees, City Party Committees directly under the Central Government; Office of the President, State Audit; Supreme People's Court, Supreme People's Procuracy ; Ministries, ministerial-level agencies and organizations established by the Government and the Prime Minister that are not public service units; People's Committees of provinces and centrally run cities).
According to the Submission of the Ministry of Home Affairs , the draft Decree focuses on amending, adjusting, supplementing, and replacing contents related to 5 contents: Recruitment of civil servants according to job positions; subjects of admission to civil service; arrangement of job positions for recruited civil servants, change of job positions and ranking of civil servants corresponding to job positions; termination regime for civil servants; responsibilities of ministries, branches, and localities in the management of civil servants under their management authority.
In which, Article 4 - Methods of recruiting civil servants stipulates:
Civil service examinations are conducted in the case of recruitment for positions of senior specialist and equivalent, specialist and equivalent, officer and equivalent.
Civil servant recruitment is conducted in the case of recruitment for job positions in the following cases: People who commit to voluntarily work for 5 years or more in areas with particularly difficult socio -economic conditions; people who study under the recruitment regime according to the provisions of the Law on Education, after graduation, they work in the locality where they were sent to study; excellent graduates and high-quality human resources according to the provisions of law; recruitment for job positions ranked as senior specialists and equivalent, senior experts.
Article 19 - Arrangement of job positions and civil servant ranks for those who pass the civil servant recruitment exam stipulates: The arrangement of job positions for those who pass the exam or selection at the civil servant employing agency must be consistent with the job positions determined in the recruitment plan, ensuring consistency between the assigned tasks and powers and the requirements of the recruited job positions. The head of the civil servant employing agency is responsible for assigning work in accordance with the requirements of the recruited job positions, training, monitoring, and evaluating the performance of the duties and responsibilities of civil servants. The head of the agency competent to recruit civil servants decides to arrange job positions and rank civil servants corresponding to the recruited job positions for those who pass the civil servant recruitment exam.
The draft Decree also omits some contents in the recruitment of civil servants and the use and management of civil servants; at the same time, amends and supplements some contents: Recruitment; appointment; amends and supplements cases eligible for severance allowance; amends regulations on determining retirement age; amends and supplements the authority and responsibility of ministries, branches and localities in civil servant management...
