On the afternoon of November 3, the National Assembly Standing Committee gave its opinion (for the second time) on the Draft Law on Employment (amended).
Summarizing the draft Law on Employment (amended), Minister of Labor, War Invalids and Social Affairs Dao Ngoc Dung said that the draft law was received, reviewed, revised and restructured to include 9 chapters and 94 articles, 36 articles less than the draft law with Submission No. 410/TTr-CP.
Compared to the 2013 Law on Employment, the draft Law on Employment (amended) has a number of major amendments and supplements. In particular, in policy group 2, the draft law has expanded the subjects participating in unemployment insurance.
Specifically, additional subjects participating in unemployment insurance include: Employees with a labor contract with a term of 1 month or more (currently 3 months or more); Part-time workers with monthly salaries equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions, ensuring consistency with the Law on Social Insurance 2024.
According to Mr. Dao Ngoc Dung, the draft law also provides flexibility in unemployment insurance contribution rates. Accordingly, the unemployment insurance contribution rates are revised in the following direction: Employees pay a maximum of 1% of their monthly salary; Employers pay a maximum of 1% of the monthly salary fund of employees participating in unemployment insurance; The State supports a maximum of 1% of the monthly salary fund for unemployment insurance contributions of employees participating in unemployment insurance and is guaranteed by the central budget...
Notably, in policy group 4, the draft law has amended the regulations on capital sources for loans to create jobs. Accordingly, the amendment of regulations on capital sources for loans to create jobs aims to complete the legal basis, ensure the consistency and uniformity of the law, contribute to increasing capital sources and improving the efficiency of loans to create jobs in the following directions: Central budget allocated to the Social Policy Bank from other development investment expenditures; National Employment Fund source converted into Central budget source allocated to the Social Policy Bank (to ensure compliance with the provisions of the 2015 State Budget Law); Local budget source entrusted through the Social Policy Bank; Mobilized source of the Social Policy Bank; Capital source of other organizations and individuals entrusted through the Social Policy Bank.
At the same time, it is supplemented with regulations that the People's Councils at provincial and district levels arrange local budget capital including other development investment capital, regular expenses and other legal capital sources, and assign the People's Committees at the same level to entrust the implementation of loans to create jobs through the Social Policy Bank.
In the review report, Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh said that many contents and issues have been accepted, explained and reflected in the draft law by the Government and the drafting agency. However, there are still some contents that need to be explained and accepted to be more convincing.
The Social Committee recommends that the Government continue to study and complete the amendment of regulations on capital sources for loans to create jobs (Article 7), including transferring the National Employment Fund to the central budget source allocated to the Social Policy Bank and ensuring lending resources for local budget sources entrusted to the Social Policy Bank in localities that still receive support from the central budget.
In addition, research and supplement basic and appropriate principles to overcome shortcomings and limitations, in line with the development trend of the labor market and ensure the feasibility of regulations on policies to support job transition for workers in rural areas; public employment policies; policies to support employment for young people and policies to support employment for the elderly...
According to the proposal of the Social Committee, the draft Law on Employment (amended) is basically qualified to be submitted to the National Assembly for consideration and comments at the 8th Session.
It is recommended that the Government and the drafting agency continue to fully explain the contents of the National Assembly Standing Committee, the agency in charge of the review, and the National Assembly agencies participating in the review; continue to review and not stipulate in the draft Law the contents under the authority of the Government, ministries, branches, and contents already stipulated in other laws, and only stipulate the contents under the authority of the National Assembly.
