Vietnam Civil Aviation Law: Safety is the absolute priority

The draft Law on Civil Aviation of Vietnam (replacement) is expected to be submitted by the Government to the National Assembly for consideration and approval soon.

The current Law on Civil Aviation of Vietnam was issued in 2006, the most recent amendment and supplement was also 11 years ago (Law amending and supplementing a number of articles of the Law on Civil Aviation of Vietnam 2014). In the context of many changes in the economy and society, requiring timely policy responses, the Government Standing Committee has requested the Ministry of Construction to proactively assess, review, amend and supplement mechanisms and policies according to the management field to promptly overcome limitations in practice.

Responding to practical development requirements

According to a report from the Ministry of Construction, the Law on Civil Aviation of Vietnam (replacement) has been submitted to the National Assembly (Submission No. 698/TTr-CP dated August 15, 2025), the Standing Committee of the National Assembly has met and given opinions.

Based on the Conclusion Notice No. 3263/TB-VPCP dated September 5, 2025 of the National Assembly Standing Committee and Report No. 935/BC-UBPLTP15 dated September 4, 2025 of the Committee for Law and Justice on the preliminary review of the draft Law, the Ministry of Construction has drafted a Report on reception, explanation and revision of the draft Law on Vietnam Civil Aviation (replacement).

There is a need for a new Law on Civil Aviation of Vietnam (replacement) to ensure national defense and security in the new era of the nation.

According to the leader of the Civil Aviation Authority of Vietnam, after 19 years since the Law on Civil Aviation of Vietnam 2006 took effect, a legal corridor has been established for Vietnam's aviation activities; the aviation safety management and supervision system has been established in accordance with the standards of the International Civil Aviation Organization (ICAO); ensuring the capacity to supervise flight safety according to international standards, creating conditions for Vietnamese airlines to access high-demand markets such as North America and Europe.

Vietnam is considered by the international community to be one of the leading countries in the region in terms of aviation safety monitoring and management capacity. In addition, the supply chain of flight assurance services and the flight control system ensure high reliability, availability, redundancy and operational safety for all airport airspaces.

The Flight Information Region (FIR) is managed and operated by Vietnam. The aviation security system in Vietnam is fully established, operates effectively, creates a favorable environment, ensures absolute security and safety of civil aviation activities, is highly appreciated by ICAO; meets the requirements of flight routes with high standards of aviation security: the United States, Europe, China,...

Airports and airfields that have been invested in, built, renovated and upgraded have improved their operational capacity, ensured security and safety, served national defense and security needs, and actively contributed to the local economic and social development, and implemented regional and international linkages.

By the end of 2024, the number of aircraft operated by 5 Vietnamese airlines will be 211 and all airlines have plans to continue to add and strengthen their fleets. The international transport market share always reaches more than 42% with the increasing competitiveness of airlines.

General aviation activities have initially been formed and developed in a diverse and rich manner with many basic types of exploitation to meet economic needs and people's needs... However, in the process of implementing the Law on Civil Aviation of Vietnam, there have been some problems in the specialized state management of civil aviation.

On the other hand, regulations on aviation security responsibilities also need to be updated to ensure legality because the state management of aviation security has been taken over by the Ministry of Public Security. At the same time, there are no regulations on the development plan of Vietnamese airlines' aircraft fleets to be consistent with the infrastructure plan and capacity, aviation safety supervision capacity of aviation authorities...

Therefore, the Law on Civil Aviation of Vietnam needs to be reviewed for replacement, in order to institutionalize the Party and State's guidelines and policies, continue to improve mechanisms and policies in the field of civil aviation; overcome difficulties and shortcomings as well as propose and solve new and emerging problems. At the same time, remove bottlenecks, create new driving forces for economic and social development, international integration, and ensure national defense and security in the new era of the nation.

Building a culture of aviation safety

Implementing the spirit of innovation in law-making thinking, the draft Law on Civil Aviation of Vietnam (replacement) only regulates framework issues of principle and contents under the authority of the National Assembly. Therefore, the draft Law has been arranged, expected to consist of 11 chapters and 106 articles (96 articles less than the current Law).

Some of the new highlights proposed by the Drafting Committee in this draft of the Civil Aviation Law include: Amending and supplementing regulations on aviation authorities, aviation security authorities, aircraft accident and incident investigation agencies to clearly define the position, role and functions of agencies performing state management tasks on civil aviation, in accordance with the organizational model of the state apparatus in the new period, while also fulfilling the obligations of member states of the 1944 Chicago Convention on Civil Aviation and ICAO. Next is the addition of regulations on research, application of science and technology, digital transformation, technology transfer and aviation industry development.

These are regulations aimed at improving domestic production capacity and being proactive in technology in the field of civil aviation, implementing the Party's policy on promoting research, application of science and technology, digital transformation and development of the aviation industry in the spirit of Central Resolutions and in accordance with other provisions of law.

At the same time, a new chapter on establishing an aviation safety management system was added, in accordance with the new aviation safety regulations of the Chicago Convention, to affirm: Safety is an absolute priority in all civil aviation activities.

With the declaration "Safety is the absolute priority in all civil aviation activities" and the goal of maintaining a safe and reliable air traffic system, the draft Law proposes principles and framework regulations on the Aviation Safety Management System (SMS), the Vietnam Civil Aviation Safety Program (SSP), collection, evaluation, processing and sharing of aviation data, etc. to meet the requirements of the ICAO with 8 key elements of the national aviation safety management system.

The draft Law also amends and supplements regulations on aircraft incident and accident investigations to ensure transparency, objectivity and independence in accordance with the latest recommendations of the ICAO's 2024 aviation safety inspection in Vietnam. In addition, the draft Law also stipulates the building of an aviation safety culture to determine the responsibilities of all organizations and individuals participating in civil aviation activities in the conduct and implementation of aviation safety cultural standards, raising public awareness of aviation safety.

It can be said that the construction of the Law on Civil Aviation of Vietnam (replacement) this time was carried out in compliance with the Constitution, policies of the Party and State; ensuring compatibility with international treaties to which the Socialist Republic of Vietnam is a member.

At the same time, strengthen international integration in the field of civil aviation on the basis of sharing goals, benefits, values, resources and complying with common regulations within the framework of international treaties; promote the advantages of the Law on Civil Aviation of Vietnam, supplement and replace inappropriate contents that hinder the development of the field of civil aviation and selectively absorb aviation development experience of advanced countries in the world.
