On October 9, the Ho Chi Minh City National Assembly Delegation held a conference to collect comments on the draft Law on Construction (amended), the Law on Planning (amended), the resolution on mechanisms and policies to remove obstacles and difficulties in implementing the Land Law, and proposed amendments and supplements to Resolution 98/2023/QH15 on special mechanisms and policies for the development of Ho Chi Minh City.

At the conference, Associate Professor Dr. Nguyen Quoc Dung, former Director of the Regional Political Academy II, suggested that for the Law on Construction (amended), it is necessary to consider further simplifying construction licensing procedures, and it is necessary to remove the provisions on granting construction permits (GPXD). Instead, the state plans construction areas, manages height, design, and construction zoning. In addition, there should be regulations on improving the quality of construction appraisal and supervision, and applying technology in managing the quality of key projects. In addition, it is necessary to closely link construction planning with land and urban planning, clearly defining the coordination responsibilities between the Ministry of Construction , the Ministry of Agriculture and Environment, etc.

Regarding the Law on Planning (amended), Associate Professor, Dr. Nguyen Quoc Dung recommended strengthening the connection between types of planning. Specifically, it is necessary to supplement regulations clearly defining the hierarchical relationship between national - regional - provincial - sectoral planning; ensuring that lower-level planning is consistent with higher-level planning. This avoids overlap and conflicts, helping to unify the orientation of national development planning. In addition, the publicity and transparency of planning information is also a content that needs to be added to the upcoming regulations.

According to Dr. Nguyen Vinh Huy, Vice Chairman of the Ho Chi Minh City Business Association, the amended Construction Law has not yet recognized digitalization in the law and there is no interconnected database. In addition, regulations related to construction are still overlapping. Regarding the regulations on granting construction permits according to current regulations, the time to grant paper construction permits is prolonged. Therefore, the amended regulations need to stipulate the online granting of construction permits for some projects.

Meanwhile, Mr. Le Hoang Chau, Chairman of the Ho Chi Minh City Real Estate Association, said that the Construction Law (amended) should aim to exempt construction permits for townhouses outside of housing projects with 1/500 planning. Instead, strict regulations should be added on post-inspection after construction of housing projects.

Regarding the general planning of Ho Chi Minh City, Mr. Vo Hoang Ngan, Director of the Department of Planning and Architecture of Ho Chi Minh City, informed that the establishment, appraisal and approval of the general planning of Ho Chi Minh City according to the current Law on Urban and Rural Planning, the general planning of the city is according to the approval decision of the Prime Minister . However, the draft Law on Planning needs to be decentralized to the People's Committee of Ho Chi Minh City for approval. This creates initiative for the city and speeds up progress, ensuring suitability.

At the end of the workshop, there were 11 comments from experts and representatives of relevant departments. The comments will be recorded and compiled by the Ho Chi Minh City National Assembly Delegation to be sent to the drafting agency for consideration and comments.
