Ms. Mai Thi Anh, Director of the Legal Department (Ministry of Education and Training), said that the draft law amending and supplementing a number of articles of the newEducation Law was announced by the Ministry of Education and Training to amend in the direction of eliminating school councils in public preschool and general education institutions.
This aims to streamline the apparatus, increase enforcement effectiveness and create conditions for substantial innovation in school activities based on existing democratic institutions such as Party committees, trade unions, parent-teacher representative boards, pedagogical councils, etc.

In the summary report on the implementation of the Education Law in 2019, many localities reflected the current situation of school boards in public kindergartens and general schools operating in a formal manner, lacking real power, overlapping roles, and not creating real governance values.
The current public kindergarten and primary school system has not been given autonomy in finance, personnel or organizational structure, so the role of the school board is not designed to be linked to practical functions.
Furthermore, in most schools, the principal is also the chairman of the school board and the party cell secretary, leading to overlapping roles and blurring the supervisory and critical functions of the school board.
Therefore, according to the Ministry of Education and Training, maintaining a school council is not only ineffective but also increases administrative burden. Therefore, in the spirit of streamlining the organization and increasing the principal's self-responsibility for public schools, removing the school council regulation in public kindergartens and general schools is a necessary step.
However, many opinions say that regulations on school councils are very necessary in private schools due to the characteristics of the birth and development of this model.
At a recent discussion session to give comments on the draft law, Ms. Nguyen Thi Minh Thuy, Principal of Nguyen Sieu Secondary and High School ( Hanoi ), proposed that the draft law should add regulations on school boards for the system of private educational institutions to avoid overlap between the positions of chairman of the board of directors, chairman of the school board and school principal.
Cut and simplify more than 50% of administrative procedures
The Ministry of Education and Training also said that the draft law has amended, supplemented, and abolished many regulations related to administrative procedures. The Ministry of Education and Training focuses on cutting and simplifying over 50% of administrative procedures to create maximum convenience for learners, educational institutions, and investors.
"The revised and supplemented regulations are expected to have a direct impact on 69 administrative procedures under the management of the Ministry of Education and Training," the Ministry of Education and Training stated.
According to the ministry, the above adjustments will help shorten processing time, reduce costs and paperwork for learners and investors; facilitate the implementation of online public services in the education sector; enhance transparency, accountability, reduce the risk of negativity arising in the process of implementing administrative procedures; remove bottlenecks, promote investment in non-public education and expand autonomy for educational institutions.
The Ministry of Education and Training has just posted the draft law amending and supplementing a number of articles of the Education Law on the Ministry's electronic information portal for agencies, organizations and individuals to contribute their opinions until July 9.
