Strictly punish acts of counterfeiting seals and documents of agencies and organizations.

Recently, the prosecution agencies have prosecuted and brought to trial many cases of "forging seals and documents of agencies and organizations" and "using fake seals and documents of agencies and organizations".

Go to jail for greed

The 14 defendants who stood before the provincial People's Court on March 31 were all fully aware of their criminal acts, but still disregarded them for immediate benefits. As defendant Le Thi Khoan (born in 1965, in Dong Nai province) confessed: "Having been sentenced to 2 years of suspended imprisonment for this act, I know that the law strictly prohibits the forgery of documents of agencies and organizations. However, because many people have needs, and I am only an intermediary who enjoys the difference in money, I once again took a risk!"

Khoan is the mastermind in the case of "forging seals and documents of agencies and organizations". From 2019 to 2020, realizing that many people working as ship drivers did not have all the required professional certificates, Khoan colluded with an individual named Hien (unknown background), connected with Tran Thi Hien Hoa (born in 1988, in Hoai Nhon town), Nguyen Tan Hai (born in 1968, in Quang Ngai province) to receive photocopied ID cards and ID cards/CCCDs of fishing boat owners in Binh Dinh to forge 33 mechanic certificates and 1 chief engineer certificate.

In this case, Khoan was the one who raised the issue of being able to make fake diplomas and certificates of all kinds with Hoa; while Hoa connected with Hai to find people who needed to make certificates for mechanics and chief engineers. Hai directly worked with those in need. Khoan illegally profited 6.9 million VND; Hoa received 31 million VND, Hai received 21 million VND. In addition, a number of other defendants illegally profited from 600 thousand VND to 2.2 million VND.

Previously, just to earn 100,000 VND/certificate, defendant Tran Thi Tao (born in 1970, in Tam Quan Bac ward, Hoai Nhon town) accepted to make 8 fake certificates for mechanics and chief engineers. Tao was sentenced by the Provincial People's Court to 2 years in prison for "forging seals and documents of agencies and organizations". Meanwhile, defendant Tu Minh Thien (born in 1998, in An Lao district) "used fake documents of agencies and organizations" to defraud and appropriate other people's property. Specifically, Thien rented a car, went online to order 2 fake car registration certificates in her name; pawned these 2 cars for 460 million VND for personal use and debt repayment.

Raising awareness

Article 341 of the 2015 Penal Code stipulates that anyone who forges seals, documents, or papers of an agency or organization, or uses forged seals, documents, or papers to commit illegal acts, may be fined from 30 to 100 million VND, or imprisoned for up to 7 years. Along with administrative or criminal sanctions, violators may also be subject to civil liability and disciplinary sanctions depending on the consequences of the act and the person's position in accordance with the law.

From December 1, 2022 to present, the People's Procuracy at two levels has prosecuted 1 case of counterfeiting seals and documents of agencies and organizations and 2 cases of using fake seals and documents of agencies and organizations. Meanwhile, the Provincial People's Court has also brought 5 related cases to trial.

According to the Director of the Provincial People's Procuracy, Tran Van Sang, taking advantage of the development of information technology, the subjects mainly use Facebook and Zalo to advertise and offer to make fake documents. "Many subjects use high technology to create fake documents (such as land use right certificates, fake degrees and certificates) that are very difficult to recognize with the naked eye. In addition to focusing on propaganda, the unit also actively coordinates with relevant agencies to investigate and strictly handle this type of crime," said Mr. Sang.

To solve this crime at its root, in addition to the fierce fight of the functional sector, there needs to be the synchronous participation of state management agencies. Notary offices, units and organizations, when receiving documents and records, need to carefully check diplomas and certificates; promptly notify the authorities when detecting suspicious signs. Above all, people must raise awareness of the consequences and implications of using fake documents.
