According to Ho Chi Minh City Social Insurance, according to the provisions of civil law and social insurance, employees have the right to authorize others to prepare documents and receive one-time social insurance withdrawals.

Currently, the Social Insurance agency handles the enjoyment of social insurance benefits with authorization procedures through a power of attorney (Form No. 13-HSB issued with Decision No. 166/2019 of Vietnam Social Insurance) or according to the provisions of civil law on authorization.

Specifically, the attached documents include: closed social insurance book; application for one-time social insurance benefit; authorization paper according to form 13-HSB or notarized/certified authorization contract.

In addition, the authorized person coming to the Social Insurance agency to submit the application must bring identification documents, a notarized copy of the ID card/CCCD of the authorized person, to submit the application for social insurance benefits or receive the settlement results.

People line up to submit documents to withdraw social insurance one time

According to current regulations, the one-time social insurance benefit is calculated based on the number of years of social insurance contributions. Each year, 1.5 months of the average monthly salary for social insurance contributions is calculated for years before 2014 and 2 months of the average monthly salary for social insurance contributions for years from 2014 onwards.

In case the social insurance payment period is less than 1 year, the social insurance benefit level is equal to the paid amount, the maximum level is equal to 2 months of the average monthly salary for social insurance payment.

In addition, within 10 days from the date of receiving a complete application as prescribed for one-time social insurance benefits, the social insurance agency is responsible for resolving and organizing payment to the employee; in case of non-resolution, a written response must be given stating the reason.

In Ho Chi Minh City, recently, the issue of withdrawing social insurance one time has received special attention from employees.

In April 2023, at the Social Insurance Office of Hoc Mon District (HCMC), there was a situation where a large number of people gathered in front of the Social Insurance Office gate waiting to complete the procedures for withdrawing Social Insurance at one time. Many people even spread out mats and hammocks to lie down and wait for the opening time, and many people even waited overnight.

Deputy Director of Ho Chi Minh City Social Insurance Tran Dung Ha said that in the first quarter of 2023, the unit was overloaded with documents. Specifically, in the first quarter, Ho Chi Minh City Social Insurance received 516,294 documents of all kinds, returning results to 495,060 documents. Of which, from the beginning of the year to April 10, the total number of one-time social insurance documents received in the whole city was 40,111.

Ho Chi Minh City Social Insurance emphasizes that currently, the settlement of one-time social insurance benefit applications does not distinguish between places of residence, the procedures for receiving benefits and the calculation of the benefit levels are the same. Employees can submit one-time social insurance benefit applications at any district or commune social insurance agency nationwide.

The Social Insurance Agency also strictly prohibits district and county Social Insurance agencies from passing on the task of receiving one-time Social Insurance applications.
