According to the Spanish prosecutor's office, player Jenni Hermoso gave testimony on Tuesday (September 5) and has a complaint being processed by prosecutors.
Following the complaint, RFEF President Rubiales is suspended and could face criminal charges in addition to an ongoing investigation by the National Sports Tribunal into what it considers “serious misconduct” and an investigation by world football’s governing body FIFA. Representatives for both Hermoso and Rubiales have not commented on the matter at this time.
Late last month, the Spanish Supreme Court prosecutor’s office said Rubiales could face sexual assault charges, which carry a prison sentence of between one and four years if Hermoso successfully files a lawsuit. The Supreme Court has jurisdiction over the case because the incident occurred overseas — in Sydney, Australia.
Hermoso (No. 10) said this action made her vulnerable.
Accordingly, player Hermoso said she did not want to be kissed and she felt "vulnerable and a victim of this behavior".
As for the RFEF president, Mr. Rubiales still refuses to resign despite heavy pressure, saying the kiss was "spontaneous, mutual, excited and consensual". Besides, the RFEF president is also ready to go to court.
Early on September 6, head coach of the Spanish women's team Jorge Vilda was also fired after his reaction was said to support Mr. Rubiales' action of not resigning.
