The 3rd session of the 8th term of the Quang Tri Provincial People's Council recently reviewed and approved a resolution stipulating the scope of duties and powers of the Chairman of the Commune People's Committee that can be delegated to civil servants of the Commune People's Committee in the field of notarization within the province.

Accordingly, the Chairman of the People's Committee of the commune, ward, or special administrative region (commune level) is authorized to delegate the following tasks to civil servants of the commune-level People's Committee: Authenticating copies of documents and papers from originals issued or certified by competent agencies and organizations in Vietnam; competent agencies and organizations of foreign countries; or competent agencies and organizations of Vietnam in collaboration with competent agencies and organizations of foreign countries.
Authentication of signatures on documents (applicable to both fingerprint authentication and cases where the person requesting authentication cannot sign or provide a fingerprint). Authentication of the translator's signature on documents translated from a foreign language into Vietnamese, and from Vietnamese into a foreign language.
Authenticating contracts and transactions related to movable property, land use rights, and housing; authenticating wills; authenticating documents rejecting inheritance, authenticating agreements on the division of inheritance where the inheritance consists of movable property, land use rights, and housing; authenticating declarations of inheritance where the inheritance consists of movable property, land use rights, and housing; authenticating amendments, additions, and cancellations of contracts and transactions; correcting errors in contracts and transactions; issuing certified copies from original authenticated contracts and transactions.

According to a representative from the Provincial People's Committee, implementing a two-tiered local government model has resulted in a large number of administrative procedures in the field of notarization arising at the commune-level People's Committees, many of which require same-day receipt, processing, and delivery of results.
Meanwhile, the Chairperson of the People's Committee at the commune level simultaneously performs general management and administration duties while directly handling administrative procedures, leading to significant work pressure and affecting the progress and quality of document authentication processing.
Therefore, to ensure the timely and effective implementation of administrative procedures in the field of authentication; and at the same time promote administrative reform, shorten the process and time for handling dossiers, and enhance the responsibility of commune-level officials, it is necessary to issue a Resolution of the Provincial People's Council stipulating the scope of duties and powers of the Chairman of the Commune People's Committee that can be delegated to officials of the Commune People's Committee in the field of authentication.
Thus, with the resolution of the Provincial People's Council, the legal basis is now clear for the Chairman of the People's Committee at the commune level to delegate authority to civil servants based on the practical situation in the locality, ensuring compliance with current laws and the practical requirements of the locality. At the same time, it resolves difficulties and obstacles, ensuring the smooth and uninterrupted processing of administrative procedures, and above all, providing the best possible service to the people in carrying out these procedures.
