At the second session of the 9th session, the National Assembly will question two ministers, including Minister of Education and Training Nguyen Kim Son. Among the issues expected to be questioned and answered is the implementation of legal regulations on extra teaching and learning.
Manage extra teaching and learning, not ban it.
Before the question-and-answer session, the Minister of Education and Training reported on a number of related issues. According to the Minister, the issue of extra teaching and learning is not a new issue. Nearly three decades have passed, with legal regulations on extra teaching and learning, the warning about rampant extra teaching and learning remains relevant.
Instead of decreasing, extra teaching and learning are increasingly occurring on a larger scale in many forms. Not only does it put great pressure on students and parents, but it also goes against the spirit of innovation shifting from "transferring knowledge" to "developing learners' qualities and abilities".
This also goes against the goal of the 2018 GeneralEducation Program, which emphasizes building people who are autonomous, creative, and capable of lifelong learning, while rampant extra teaching and learning is undermining the true value of learning.

Correctly assessing the importance of properly managing extra teaching and learning to limit the consequences of widespread extra teaching and learning and improve the quality of education, in the draft Law on Teachers, the Ministry has advised the Government to include violations of regulations on extra teaching and learning as regulations that teachers are not allowed to do.
The Ministry of Education and Training has issued Circular 29, which regulates the management of extra teaching and learning, but "does not prohibit it". The organization of extra teaching and learning must ensure that it does not affect the organization and implementation of the school's educational plan, and does not affect the implementation of the subject program and the teaching plan of teachers. Proposal to add tutoring and extra learning to the list of conditional business lines
Regarding limitations, Minister Nguyen Kim Son assessed that from 2020, when private tutoring and tutoring are no longer conditional business lines, management becomes more difficult, and localities do not know the sanctions to handle violations.
The list of acts requiring administrative sanctions in the education sector currently lacks some violations of regulations on extra teaching and learning that need to be supplemented (localities have proactively based on the sanctions regulations under the Law on Civil Servants and Public Employees and other relevant laws to handle violations)...

Since the implementation of Circular 29, some localities have not issued regulations on extra teaching and learning according to their authority, leading to confusion in implementation. The coordination between departments and branches in implementing regulations on extra teaching and learning outside of school has not been timely and drastic in some places, so there are still cases of intentional violations of the Circular's regulations on extra teaching and learning outside of school.
According to the Minister, there are many reasons, including the removal of tutoring and learning services from the list of conditional business lines, leading to a situation in some localities where tutoring and learning in and out of schools is uncontrolled and spontaneous due to the inability to manage the licensing of tutoring and learning.
To help manage tutoring and learning activities in localities and educational institutions more closely, the Ministry has repeatedly recommended and proposed to the Government and the National Assembly to include tutoring and learning services in the list of conditional business lines of the Investment Law at the 9th Session of the 14th National Assembly.
However, to date, this proposal has not been approved. Therefore, Circular 29 is aimed at not prescribing conditions (to manage conditional business lines).
The Minister said that extra teaching and learning is a complex issue with great social impact. Therefore, a circular regulating the management of extra teaching and learning cannot solve all the problems. There must be systematic, synchronous, drastic solutions, and implementation needs a roadmap.
Accordingly, the Ministry of Education and Training continues to propose to the Government to include tutoring and learning services in the list of conditional business lines.
